With that said, The darker skinned ones ain't no match for the girl standing in front of Luke (the light skinned one) As for their faces, from the back the one in front of Mr. Mixx with the shorter hair doesn't look really all that promising. The Supreme Court case doesn't say it's fair use, per se, as some people seem to be suggesting. They just reverse the Circuit Court and remand so the defendant (2 Live Crew) can attempt to prove the affirmative defense of fair use, including showing that their use would not harm the market for rap derivative works of the original song

Remember, when testing for fair use, and using criteria #1 about "purpose and character of use," the more transformative the use, the less important the other three factors.

And yes, if your professor doesn't agree it's parody, and she sits on the Federal Appeals Court, she's getting her ass reversed.

We just discussed this today in my class. It being a parody is your own opinion. Our professor is a lawyer and said she doesn't believe its fits a parody b/c it is not referencing or making an opinion about the original in her opinion. But a lot of our class said that it is b/c its referencing/making fun of writing lovey songs about pretty women and this version makes fun of that by talking about other types of women.

actually, the fact that it's a parody is the opinion of the supreme court of the united states. read the opinion. Souter refers to the song as a parody (not satire) dozens of times. so, unless your professor is Sandra Day O'Connor, i really don't care what she thinks.

Actually the Supreme Court just said that the 6th Circuit was incorrect in state a presumption that parody was not fair use. It was remanded for a new decision without the presumption applied by the 6th Circuit. On remand, the parties settled and 2 Live Crew agreed to license the music for an undisclosed amount of consideration.
