It's just wrong for him not to get the money back. Because the plaintiff was being forced to pay child support while attending school he was unable to afford the test, a simple as that. The defendants' boyfriend/husband/creep knew he was the father, and because someone else was paying for his kid he was fine with it. After all, doesn't he already have to pay to support the other 17 kids? That is my opinion.

I have always had problems with this law.
Every child should have a paternity test done at birth, and this should be required by law.
It saves a lot of heartache later on.
The only ones who would disagree with this, are the ones trying to get away with something.

@RemoteMemory that may be true, but consider the costs of a paternity test: between 400 and 2000 dollar. Who is going to pay for that? The fresh parents? The state? I don't think that is going to fly... just consider how much money that would be if it was done for every single birth, the US already has a struggling economy, to throw that law out there just to give emotional comfort to something that should not need it is pretty dumb, no offense.

I see what you mean, but I see this as part of a bigger program to have a DNA database... with the goal of having every persons' DNA on record.
This would be very helpful in solving crimes like murder, and making sure the right people are punished for their crimes.
I know there are constitutional issues with this, but I still feel it is the right path to be going on.
I think this is a case where giving up a freedom, allows for a trully better society.

The people who disagree with this are people are like the Constitution. The Constitution requires that the government shall not enforce unlawful search. That is unlawful to require someone to submit to a test without a warrant under penalty of jail or fine. But I see your point. :-)

Yes it is unconstitutional, I agree.
The constitution has been ammended when the values of society evolve, and perhaps this is a case where it could be as well.
Think of a database with everyone's DNA on record.
This would help in solving crimes, getting dangerous people off the street sooner, and save money overall in the future.
I am one who tries to question everything, however sometimes there are things which just seem to make sense.
This is one to me.
