You can own the 360, do whatever you want to it, but as soon as you connect to Xbox Live, you are required to follow the term of service. As soon as you disconnect, you are again able to do anything you want.

What gives microsoft the right to scan my xbox? I can see them banning me if im caught modding a game or get reported. But i believe Microsoft actually executes a code on my machine that does nothing but checks if it has been modded. Its really a faggy thing to run a code on someone elses computer without their consent especially when it has no end value to the user.

They can only start the scan if you're connected to xbox live, which would mean that you are breaking the terms of service by being connected to Xbox Live with a modified Xbox.
