Evanescence has 3 albums and the only ones you see this Carly chick sing are the songs that also belong to her guitarist. Really people, come on. But for a band thats just starting up, to have song material that you have legal rights to is handy.

But I thought maybe out of respect they would avoid bad media about band feud by not playing songs by Evanescence. They don't HAVE to, but maybe just out of respect they'd try not to. Let's say he was solely responsible for Creating Evanescence (which he wasn't) it wouldn't matter. When he and Amy signed with W.U.R. they sign the rights to them. Amy is allowed to perform and record EV. music because that is who W.U.R. recognizes as Ev. Ben Mooody lost all that the day he quit and broke his agreement with the label. If he recorded one of Ev.'s old songs he would be sued,even if he wrote it.
They should be apologizing to Evanescence, Amy Lee and Wind up Records for ripping off their look and sound.
Ben Moody is going through great lengths to try and prove that he is Evanescence not Amy Lee. He is in a very dangerous zone with Copy right in infringement with the Band Name and sound on the Song Bury Me Alive. Some of the music and riffs are right from older Ev. songs. I'm sure Amy could sue but is a bigger person. Wind Up Records might want to though.

EV is a BAND, not just it's lead singer. To my mind EV will always be ALL IT'S BAND MEMBERS. Which means the guys who now make up part of WATF AND AMY LEE. Ben moody has intellectual property rights to anything he's written, cowritten would need to be discussed by both parties. So any evanescence song you think this band has ruined and has no right to preform on stage may very well be his song to do with as he pleases.

@rogue9094 Actually, Amy only fired John. And Troy and Will were/are ten times better to watch than John OR Rocky. And the phrase that was used was "electronic pop," which is completely different from pop, and is heard in Together Again, which is the least bit pop. Carly's voice really isn't anything spectacular. And of course Amy sounded tired - she toured continously over the years while rocking out (Carly just seems to stand there) and sounded AMAZING at the secret show in NYC last year.

@dustyntylr Lee was responible for the majority of the songs on Fallen. My Immortal was written mostly by Moody, but Lee did cooperate with that. Moody was not repsonible for "most" of the songs on Fallen. And second of all you said it partially yourself. That sound elongs to them both. The diffrence being, TOD retained some of their old sound and matured while WATF attempted to recreate Fallen. Which is imposible. The only "style" Moody has is the one that he thinks will make the most money.

2. she has an epilepsy foundation that she did for her brother.

I know they are trying to be different to Evanescence, but with having 3 of the first band members that helped bring out Fallen and partly The Open Door (apart from Moody), they will forever be linked with Ev and in every interview I've seen they are asked about the time with Evanescence.

They left Amy due to her massive ego and the fact that Evanescence cannot keep band members (Amy's the only original one left) with them very long is proof of this. Amy wants total creative control...a band cannot survive that way.

There is only 3/5 of the original lineup from EV in this band, they should all pretend that they never made any music before now and only play new stuff.
I Love Amy but she doesnt have the copyright on this type of music and since she only makes a album once in a blue moon dont complain if someone else does.

For those who think Moody has rights to Ev. music....He does not.
Let's say he was solely responsible for Creating Evanescence (which he wasn't) it wouldn't matter. When he and Amy signed with W.U.R. they sign the rights to them. Amy is allowed to perform and record EV. music because that is who W.U.R. recognizes as Ev. Ben Mooody lost all that the day he quit and broke his agreement with the label. If he recorded one of Ev.'s old songs he would be sued,even if he wrote it.

EV is a BAND, not just it's lead singer. To my mind EV will always be ALL IT'S BAND MEMBERS. Which means the guys who now make up part of WATF AND AMY LEE. I agree that Carly does not do a very good job at trying to copy Amy in the EV songs but she has a good voice and I look forward to seeing growth in this genre as long as she is singing her way and not trying to be Amy. @rogue9094 Actually, Amy only fired John. And Troy and Will were/are ten times better to watch than John OR Rocky. And the phrase that was used was "electronic pop," which is completely different from pop, and is heard in Together Again, which is the least bit pop. Carly's voice really isn't anything spectacular. And of course Amy sounded tired - she toured continously over the years while rocking out (Carly just seems to stand there) and sounded AMAZING at the secret show in NYC last year.

@rogue9094 I completely disagree with you and i never heard Evanescence say they're going pop and i too follow their news and check if there's anything new EVERYDAY and i never seen they're going pop Amy Lee also said in an interview that the hard sound that the fan's love wouldn't be surprised and last time i checked Pop doesn't have a hard rock sound

@FlyCaptainDenzel But that's exactly why they really shouldn't be a band. There's already an Evanescence out there, and the world doesn't need two. Even if they're not trying to duplicate them (But I mean, come on. I think Carly tries to look exactly like Amy) they've still made something pretty similar.

@FlyCaptainDenzel But Ben wasn't wearing a "goth" outfit and being all goth and dark to attract the masses, Amy Lee was...she's "original" and "new" and most people are her fans, not Evanescence fans. So many people who loved Fallen now say it's the worst piece of shit since the Ben fallout...completely ignoring the fact that they loved the band because of that album and its songs, which have Ben written all over the place in most cases. In TOD they can see what Amy's about, that's hers.

@FlyCaptainDenzel No he gets a new band time for new music. Not whats already out in the world that ppl love cause thats just goin to make ppl like me hate the band & not give them the chance. Now if they came out with something different from the songs that are already in Evanescence, they will have a much better chance at being accepted by the world. Obviously Ben isnt prepared for this band or hes not the brain behind the words. He needs to step up his game or get the hell out of the game.

I would like yo see her singing in direct... She is pathetic, and THEY are pathetic... I don't know why they try to be like Evanescence when any group will be able to be like them and "We are the Fallen" (oh! what a coincidence--> FALLEN) is just a copy, even if they try to deny this evidence... You know people, evanescence was Bens idea just as much as it was amys. He wrote most of the music for origin and fallen and some lyrics, and he came up with the name as well. I'm just saying...he has the right to...cover his own songs...o.O
He and Amy cut the cloth with evanescence, so he's not really copying anything. He formed this band because this is his thing, his style too I guess. All the hate here is senseless

@dustyntylr Lee was responible for the majority of the songs on Fallen. My Immortal was written mostly by Moody, but Lee did cooperate with that. Moody was not repsonible for "most" of the songs on Fallen. And second of all you said it partially yourself. That sound elongs to them both. The diffrence being, TOD retained some of their old sound and matured while WATF attempted to recreate Fallen. Which is imposible. The only "style" Moody has is the one that he thinks will make the most money.
