To reiterate: DSP knows very little about copyright.
Using a short clip, for commentary, is fair use.
Using character artwork for a joystick is infringement.
Basically, you must add to or modify the original material. Extra leeway is given to reporters/news, and parody. Therefore, the joysticks he's selling are infringement, and he can be sued. Meanwhile, if he sued Machinima, he could never win.
I'm older than you. Also, do you seriously think it matters if he uses his printer, or a store printer?
The only difference is, if he goes to a store, Kinko's could theoretically be sued as well as DSP.
Try going into some of these stores. A lot of them refuse to print or scan anything unless you sign a document asserting you own the copyright. They do this because they're worried about being sued.

To reiterate: DSP knows very little about copyright.
Using a short clip, for commentary, is fair use.
Using character artwork for a joystick is infringement.
Basically, you must add to or modify the original material. Extra leeway is given to reporters/news, and parody. Therefore, the joysticks he's selling are infringement, and he can be sued. Meanwhile, if he sued Machinima, he could never win.

The only difference is, if he goes to a store, Kinko's could theoretically be sued as well as DSP.
Try going into some of these stores. A lot of them refuse to print or scan anything unless you sign a document asserting you own the copyright. They do this because they're worried about being sued.
