  • @mikerowphone Considering that the Church of Scientology ended up giving AO a cash settlement, apparently he wasn't trespassing and the Church wasn't within their rights in terms of how they handled the situation.

  • This is unlawful detainment. In most states (by which I mean every state except California), this could warrant the use of lethal force in self-defense (i.e. guns with live rounds).

  • @mikerowphone FYI, they weren't trespassing, the Scientology guards broke the law. First off, AnonOrange was baited into going onto that property by the security guards who kept messing with his car. Second, there were no visible signs or fences marking the property line. The only visible property sign they had was yards behind where the incident took place. Third, AO wasn't given a fair warning to leave the property before he was assaulted by the guards. All the charges against AO were dropped.

Which is why the cops, upon arriving on the scene arrested - the protestor. They also attempted to arrest the woman in the video, but she was removed from the scene. And then the local Board of Supervisors, in response to this incident - fast tracked an ordinance banning protests against Scientology in their county. Hopefully I can be a badass like u 1 day!

    FYI, Anon Orange did in fact file a suit against the Church and settled with them for an undisclosed amount.

  • Were they tresspassing? If so, this is all entirely legit. Based on what I've seen from Anonymous, they probably were. Anytime someone so much as brushes one of them, they scream that they're gonna call the cops.

  • @Zaros105 This incident was reported to the local Sheriff's department, which refused to allow charges to be filed against the Scientology security guards.

    However, AO DID file a civil suit against Scientology and just won a settlement against them within the last few days.

  • The Church of Scientology did press charges against AO (who you see being assaulted in the video), but the DA ended up dropping them. That opened the way for him to file a civil suit against the Church and the guards (the DA has refused to move on his criminal complaint against the guards).

  • That would be nice, but it's not going to happen. The DA's office refused for months to even allow charges to be filed and the Sheriff's department shows no sign of following through and arresting anyone (except AO, who was arrested for trespassing).

    The good news is that all the charges against AO have been dropped, and he has subsequently filed a civil suit against the guards and the Church of Scientology.

  • Not sure that the security guards actually had the authority to do more than ask AO (the person being assaulted by them) to leave and then call the cops.

    In any event, AO is facing trespassing charges and is fighting them. He's consulted maps and surveys he claims show he was on public property. The case is set to go to trial 10/30.

    The DA had actually offered to drop the trespassing charge for a guilty plea of verbal assault but AO refused the offer, believing he can beat it in court.

  • Why is he surveying the property? This information should be public information. Also, how come he was trespassing and the other people weren't? And if he is not trespassing, why isn't he charging those assholes of assault? Also, who the fuck is the local DA? Why aren't you people pressuring him?

  • On the surveying issue; AO has consulted the publicly available records. He says they show he was on public property, with the exception of a survey conducted by the Church after this incident. His survey goes right up to the spot he was attacked.

    Why didn't the guards attempt to arrest the other protestors? Don't know, you'd have to ask them.

    The DA has refused to allow him to press charges against the guards and has destroyed evidence relating to his defense.

  • I'm not trying to extend the issue, but it seems to me that this DA should have a complaint against him at the Bar Association, since he is acting unethically and should also be investigated by the state attorney office. If they disbar him he cannot serve as DA anymore. Also, to charge anyone for trespassing, if the private property is a continuation of public property without any visible signs of trespassing, they committed assault and kidnapping. Please keep us posted.

  • AO does have an attorney representing him and they have appealed to those with authority over the DA's office.

    Scientology has since moved the no trespassing signs forward and then back again; at the time of the assault, the signs were further back towards the fence.

    Some context is in order; Scientology wields significant sway in Riverside County due to large campaign contributions to individuals such as Board of Supervisors Chairman Jeff Stone. His son works in the DA's office.

  • So they are tempering with evidence too. This seems to be a case to be reviewed by a federal prosecutor, since local enforcement is obviously corrupt.

  • Last week the DA dropped all of the charges against AO, including felony assault, misdemeanor trespassing and misdemeanor verbal assault. This despite the fact that the DA had previously expressed confidence in the strength of their case and stated they were looking forward to it.

    They gave no explanation whatsoever for their sudden 180-degree shift.

    AO has subsequently filed a civil suit against the guards for assault. Stay tuned.

  • Thanks for letting us know how it went. They didn't give explanation to avoid lawsuits, however, since it's not the judge who dismissed it I believe that this guy should first sue the DA to explain why he dropped the charges and sue the ass out of the church of scientology and the police for assault, filing false charges, illegal arrest, kidnapping, etc.

    I believe it's best to find from the DA why, because it will make his case stronger in the lawsuit.

  • A civil suit has already been filed against the Church and the security guards, for several of the items you mention.

    I don't believe there are any plans to sue the DA; the dropping of charges against the AO opens the door to him being able to file a civil suit against the Church.

    Civil Suits can become quite expensive, and though AO has put a lot into fighting this case, I don't think he or his counsel feel it would be particularly useful to sue the DA.

  • I'm not suggesting to sue the DA in civil court, I'm just suggesting that if the DA doesn't release the reasons and evidence why he was charged in the first case, you guys should subpoena the evidence, since it can contain damaging information you can use against the church of scientology, including property limits, false charges, lying on a police report, etc.

  • Nyguy, it's doubtful the DA has much evidence that would be useful to AO's case. Their "investigation" seemed to consist of relying mostly on whatever the Church told them.

    AO is being well-represented by attorney Graham Berry. Just a few weeks before the case was dropped, GB had presented a hundred page request for pertinent evidence to the Church. He was seeking the sort of information you've mentioned.

    It's possible that the case was dropped to save them the trouble of responding.

    It was also posted on Gawker where it has racked up some 74,000 views there.

    This incident has been a massive footbullet for COS; they have resorted to buying off politicos in Rivco to try and ban protesting there. The result has been the biggest protests at Gold base EVER.

    Secondly, they claimed they were enforcing a citizen's arrest. That does not entitle them to seize the guy's camera. Asking for the camera probably wouldn't have done any good as you can see from the way they responded; they realized there may be footage they didn't like, which is why they made such an effort to get it back from her.
