On the one hand, here a fag can mean a cigerette. If I say fag, I don't like people to assume I mean a homosexual...
However, words are constantly changing slightly. I have nothing wrong with people taking words and reusing them.. it's just something that happens. Gay was necessary for a rebranding of the word homosexual when it was illegal in most western countries still, fag probably came about when the LGBT took queer, so it isn't usually offensive anymore..

Speaking as a Canadian, whom has been charged with a few assaults, the police here can charge you whether the offended party wishes to press charges or not.Then it is up to the prosecution to procede.I doubt they will. There was a "gay bashing" in Vancouver a couple years back where there was talk of using the "Hate Crime" law.And more recently a fellow who was talking about the Jews in Nazi Germany. The court found him not guilty of a hate crime, but I do not know the specific law off hand.
