Giuliani could have used his powers to discourage illegal aliens from living and working in the city. He could have used the health department against restaurants that hire illegal aliens. He could have used building inspectors to prevent illegals from working in construction. He could have used fire inspectors to combat residential overcrowding. Lastly and most importantly, he could have given the police the power to arrest illegals on the spot.

That's NOT what this executive order is about. The executive order prevents city workers reporting illegal aliens when they use critical city services. So you can go to the health service to get vaccinated, without being reported to INS. If you get robbed, you can call the cops. Your kids can go to school. The alternative is illegals spreading disease, criminals roaming free, and kids on the street increasing crime.

Its major rationale is to encourage the use of ALL city services by noncitizens - with the exception of legalese added to comply with federal law. Moreover, in practice benefits legally denied to aliens were in fact given to aliens. Giuliani fought tooth and nail to prevent Congress from cutting off benefits to non-citizens and then ignored the law when it passed.

That would be great if the INS would actually deport them. When you have the INS only willing to deport 0.5% of the illegals in your city, you have to deal with the reality that they are there. You either allow them access to cops and hospitals or you deal with unchecked crime and disease.

How about using mayoral powers to discourage illegals from living and working in the city? If they can't find jobs or get benefits, most can't remain in the city. Rudy used cabaret laws to crack down on nightlife, why didn't he use health, building, and safety inspectors to crack down on illegal alien employment? It is a serious issue because illegal alien employment lowers wage levels for American workers.

It's not only a federal issue. It has local impact and can be addressed by the use of local laws, regulation and enforcement. Giuliani actively opposed such activities. He sued to the Supreme Court to overturn federal law which prohibited city governments from telling their employees not to cooperate with INS. When he lost in court, he vowed to ignore the law.
