I filed the same complaint with Fitzgerald’s state bar proving he lied more than 10 times. All thrown out of federal court due to Feres despite evidence. Fitzgerald got promoted to Major.
My son Michael Fremer was killed at Fort Polk, La on 2/13/08 because of Army Negligence. The Army can not be held accountable because of the Feres Doctrine. This law needs to be changed. Why is the Army exempt from being held accountable for Negligence? Our young men and woman are risking their lives. This is how our country treats the soldiers and the families? The Feres Doctrine needs to be overturned!

All types of cancer affect people in different ways, I also had a family member with cancer who did have that type of story. On a side note, I live on a marine corps base and hear of stories like this one too often. Don't be too quick to criticize unless you see it first hand.
Excutive order 13139 makes all military lab rats. The gulf war sickness was due to the use of depleted urainium on the battle fields. I lost a lot of friends to that sickness, seeing him just break my heart. So much life was in him, and to die like that is just not right!
What I forgot to write is Clinton signed that order in to action, and that this was a good Marine, strong, and full of life. They tried to kick me and my family out on the street in FT Drum NY, and tried to stop me from getting medical help for my injuries. This was a good Man and he will be remembered!

I went to the ER last april because I could harldy breath. When I got there my heart rate was 170 resting. I sat in the waiting room 3hrs before they saw me. they couldnt figure out what was wrong and I over heard a nurse outside my door saying she was worried to have me as a patient because she thought I wouldnt make it. they gave me morphine which I found out increases heart rate. They discarged me 11hrs later with the flu w/o and flu symptoms and they never got my heart reate down past 130

This is how the military is. Right now I am going through a high risk pregnancy and the damn military doctors wont do anything for me and they refuse to let me see a civilian. They can't, that would result in getting shot by their comanders in times of war. This is a lot impart too not following the Constitution and bill of rights. I cried when I viewed this video. I am so sorry that our veterans are being mistreated. It is just so wrong. It is part of the bigger problem of corruption in our government. The corruption and cover up of the outrageous offenses against individuals has to stop.
You should look around a little and discover the real world, there are multitudes of horror stories about doctors removing the wrong leg, or removing a leg from the wrong patient for example. Unnecessary apendectomies, breast removals, cancer treatments are very common in the private practice of medicine in the US, and all around the world.

I do feel that the doctors should be held accountable for the lack of doing their job...our Crew Chiefs or anyone else whom have to maintain a certain level of competency and certification to do their job are held to that standard if they fail to meet the standards they are most likely punished but most certainly are DECERTIFIED.
He was scheduled for surgery after he his body had already started to poison itself to death. He was backing up with fecal matter that was causing the poisoning which was literally killing him. Had the doctors taken a more interest in his condition rather than to discard it as IBS then maybe my husband would not have the residual effects that he does now almost 6 yrs later.
Post #4..... Finally, after the tenth (or so) return to the ER they turned my husband over to the Chief of the Hospital...he finally diagnosed my husband with an intestinal disease which had by that time infected his ENTIRE SMALL INTESTINE.
Post #3.... My husband was having severe abdominal cramping to the point of passing out, diahria and was quickly losing weight. They did MRI's of is abdominal area multiple times, they ruled out his appendix since it had been removed years earlier. But this continued for almost a year.
I don't believe that it is 100% the doctors as much as it is the govt that guides them. I have met some really great doctors through my 10yrs and at the same time I have met some really sh!tty doctors that only made me feel as if they were there because they were protected by the Feres Doctrine and have many times felt unheard and rushed like a cattle call. They are under pressure from their supervisors not to diagnose sickness that can effect any Airman or Soldier from deploying. The doc who finally diagnosed me said that he was catching hell from his commander for finding my cancer. They were pissed that I couldnt work or deploy. Not that I was misdiagnosed.

There are so many horror stories concerning military health care. I rememeber being told "tough it out.... dont go to the hospital, we need you to deploy to the Persian Gulf". I had known a fellow Airman that also died from Cancer after seeing an AF doctor. They gave him losengers and sent him on his way. He later complained about a nagging sore neck while deployed to Saudi Arabia while there several months later they discovered he had throat cancer. Should have been caught sooner.

I believe it trust me. They misdiagnosed my non-hodgsking lymphoma in 1998. I almost died. They said I had a small cough. I was seen by the same doctor 3 times after comming home from the Persian Gulf. They never took an ex-ray until it was almost to late. Then they let me go with no retirement!!!!! So I am living proof now I have a heart condition from the chemo treatments.
I can't believe this story doesn't have more views. Congress should've fixed this flaw a looong time ago. I feel terrible for the Rodriguez family--and am appalled at U.S. government.

All types of cancer affect people in different ways, I also had a family member with cancer who did have that type of story. On a side note, I live on a marine corps base and hear of stories like this one too often. Don't be too quick to criticize unless you see it first hand.

Excutive order 13139 makes all military lab rats. The gulf war sickness was due to the use of depleted urainium on the battle fields. I lost a lot of friends to that sickness, seeing him just break my heart. So much life was in him, and to die like that is just not right!

Joining the US military was the best damn decision of my life.

It's been two years since I've last cried and I'm fucking crying right now. God damn this shit! This brother didn't have to fucking DIE!!! Anyways... the military should improve its care for its military members. They missed a small cavity, which became huge after two years... DUH! Then I got wounded by one of our bombs and they put on my medical record that my scars were from "mole removal" because my operation was supposed to be secret.
Sometimes we do get fucked by our own country.

This is so sad. The Feres Doctrine is almost criminal. If it wasn't in place, I guarantee you that military personnel would be better trained and would be more caring with their patients. I was in the Navy and I know that not all are bad, but some can be almost sadistic. Eliminating this buffer would increase government liability and would therefore increase government regulations for the military medical personnel.

I went to the ER last april because I could harldy breath. When I got there my heart rate was 170 resting. I sat in the waiting room 3hrs before they saw me. they couldnt figure out what was wrong and I over heard a nurse outside my door saying she was worried to have me as a patient because she thought I wouldnt make it. they gave me morphine which I found out increases heart rate. They discarged me 11hrs later with the flu w/o and flu symptoms and they never got my heart reate down past 130

Another thing the public needs to know is the gulf war sickness is due to the depleted uranium shells used on the battle fields. It puts out the worst type of radiation, and is very hard to treat and get out. It can be spread through contact since it is a very fine dust particle. I always worry of my family when I get sick for all the stuff they put in me, like small pox II, and anthrax. I feel sad for his family since I too am a Marine, hard to see him go out like that. Thanks for sharing this.

This is how the military is. Right now I am going through a high risk pregnancy and the damn military doctors wont do anything for me and they refuse to let me see a civilian. Its really sad to see somthing like this. I think if we could sue or they could get into trouble they would care more. They dont care about us and they dont want to do more work then they have to. I just pray there is a change. I know I am fighting it so I can bring a healthy baby into the world...just keep fighting

I do want to make one note....outside of medical system and the political games. Serving in the military was the best dicision I ever made. I do believe that the doctors should be held accountable and there should be more 'quality of life' focused here but I still would serve again and I would tell anyone else to serve.... I would also tell them to makesure that if your gut is telling you something is wrong...do your research and don't stop with the first closed door. Theres MEO & other avenues.

You should look around a little and discover the real world, there are multitudes of horror stories about doctors removing the wrong leg, or removing a leg from the wrong patient for example. Unnecessary apendectomies, breast removals, cancer treatments are very common in the private practice of medicine in the US, and all around the world.
The real key to your agenda is summed up in your question---"Why do people keep enlisting?"

I do feel that the doctors should be held accountable for the lack of doing their job...our Crew Chiefs or anyone else whom have to maintain a certain level of competency and certification to do their job are held to that standard if they fail to meet the standards they are most likely punished but most certainly are DECERTIFIED.

He was scheduled for surgery after he his body had already started to poison itself to death. He was backing up with fecal matter that was causing the poisoning which was literally killing him. Had the doctors taken a more interest in his condition rather than to discard it as IBS then maybe my husband would not have the residual effects that he does now almost 6 yrs later.

Post #3.... My husband was having severe abdominal cramping to the point of passing out, diahria and was quickly losing weight. They did MRI's of is abdominal area multiple times, they ruled out his appendix since it had been removed years earlier. But this continued for almost a year.

I have met some really great doctors through my 10yrs and at the same time I have met some really sh!tty doctors that only made me feel as if they were there because they were protected by the Feres Doctrine and have many times felt unheard and rushed like a cattle call. The problem is that the Military docs know they can get away with this kinda treatment. They are under pressure from their supervisors not to diagnose sickness that can effect any Airman or Soldier from deploying. The doc who finally diagnosed me said that he was catching hell from his commander for finding my cancer. They were pissed that I couldnt work or deploy. Not that I was misdiagnosed.

When govts want to place their youth in the path of danger they have a responsibility to protect the family of those soldiers. That includes ensuring that the soldiers return home. When that is ot possible or when the soldier returns home with dissabilities.. the govt on behalf of all its citizens must make every effort to ease the transition into the soldier's new reality.

There are so many horror stories concerning military health care. I rememeber being told "tough it out.... dont go to the hospital, we need you to deploy to the Persian Gulf". I had known a fellow Airman that also died from Cancer after seeing an AF doctor. They gave him losengers and sent him on his way. He later complained about a nagging sore neck while deployed to Saudi Arabia while there several months later they discovered he had throat cancer. Should have been caught sooner.

Terrible! At first I think, "Of course they should be able to sue! That is their right; and a job that is to be provided by the federal gov't is that they uphold contracts with a judicial branch. And what else is going to secure that the gov't knows they're held responsible for what they do." Then I think, in the end he is suing the American people- it's our tax dollars. So, should he instead sue the doctor? Then doc MUST make sure the patient is followed up on or he gets sued. Just thinking....

I believe it trust me. They misdiagnosed my non-hodgsking lymphoma in 1998. I almost died. They said I had a small cough. I was seen by the same doctor 3 times after comming home from the Persian Gulf. They never took an ex-ray until it was almost to late. Then they let me go with no retirement!!!!! So I am living proof now I have a heart condition from the chemo treatments.

I can't believe this story doesn't have more views. Congress should've fixed this flaw a looong time ago. I feel terrible for the Rodriguez family--and am appalled at U.S. government.
