In order to claim a DMCA violation, the use must clearly not be fair use. If it is fair use and a DMCA violation is filed, the other party can file a counter-notice - in which case the first party then has to sue to stop it - and additionally the party that filed the counter-notice can sue for damages as a result of a false DMCA complaint.

Suppose I stumbled taped a show off TV by some preacher quack claiming that God would rid you of cancer and AIDS if you prayed and sent him a donation of $100.
Suppose a partner wanted to talk about his quackery, and the only way he could present the evidence was to upload a small segment of the show. It's a damn shame that Youtube's rules protect scoundrels.

HOWEVER check out Zackmovies. He used another YTbers clip to show that meowmeowmitchell had stolen a line from him. MMM filed a dmca-like protest. Zack countered. YT ruled in Z's favor. BUT this was not REAL dmca stuff, because they live in 2 different countries.
But it does imply that YT will let partners use clips if it is indeed warranted.
Again it seems that that case was not be a legal process at all.
