And paying it back is critical not just to the lender but to the whole community because no man is an island.     I live in Vancouver Canada. What I'm seeing, is our country is immigrating hundreds of thousands of people per year from asia, and these newcomers buy these outrageously priced small condos, and make payments to the bankers for 30 years for what probably only cost a couple thousand to build. I'm just not convinced it costs $500k to build a small 500sf. apartment. Canada hasn't had the "bubble burst" like the US has.

  • Just because you arent in foreclosure doesnt make you safe and so on.It doesnt mean you got the greatest deal ever or that you one upped them.I do mortgage audits or mortgage securitization audits.I help people detect fraud in their mortgages to stop foreclosure and so on.I have clients that arent in foreclosure come to me to hold banks responsible as well as people in foreclosure.So its on both sides of the fence ya know.Well I hope this lil bit of info helps guys.

  • Well if you are still in foreclosure just make them produce the note.Note being the contract you signed with the bank.You dont want a copy of your contract they need to show the original "Wet Ink Contract" Not to mention they must show the contract and the deed at the same time to show possession of ownership.And its 90% chance they cant do it because the note was sold on the market.

  • If you sign a contract, you're supposed to READ IT FIRST. If you don't understand it, have a lawyer tell you what you are signing. Why would you trust a salesman (broker, RE agent, etc.) who benefits tremendously on the sale? We don't need a nanny state where the government looks over our transactions.

    Did you expect the RE agent to tell you after you buy this house the price will drop? Did you expect the broker to tell the truth? If you feel you are right, bring them to court and fight it!

  • I firmly believe that we ALL will soon be replevined. The banksters WILL be forced to return the property they have stolen. Nutshell: The borrower signs a note. The lender receives a bond. Those are two different things. If we let them continue with this fraud you are giving houses to brokers who never put up a penny for the funding of the note. We don’t expect free houses, but we certainly don’t expect the brokers to get free houses either which under the current system is clearly the case.

  • It is really just unacceptable that this guy did not understand the terms of his mortgage. It is even worst that the mortgage broker put this family in a loan like this. I can't think of anything who would want a mortgage that increases in rate and in monthly payments. This broker did not serve these people right. Unfortunately there were so many mortgage brokers like this one.

  • Hmm. I wouldn't mind checking the facts behind this, but I know a lot of people use to get cheated when getting mortgages. It was 75% the mortgage brokers fault and 25% there own. Mortgage brokers usually don't explain mortgages very well, adjustable rates, balloon notes etc. I'm a realtor and I've pissed a lot of mortgages guys off buy stopping loans when I thought they were getting my customers on the interest rate (they USE to make money upping interest)

Dan moves awfully slow like an old dinosaur movie; he really should take better care of his health since he has a family to support.   • I feel sorry for these folks. There are many like them. However, how is it any fault of the real estate agent unless they gave them the loan. The mortgage and all it's terms are between the lender and the borrower. In most cases the real estate agent just shows homes based on what the purchaser tells them they are looking for. Another thing if the buyers would actually read the loan documents at or before the closing...a lot of these instances would be avoided.

  • You have got to read your contract. It is alllllll right there. Yes the contract is long. But it is loan that is going to last 30 years of your life..probably want to sit down and check it out. Better yet throw a lawyer a franklin and have him read it. that 100 could have saved you tens of thousands. Don't be a victim.   • i live up in canada and i'm just shocked that your realistate agent would have any say on what your mortgage payment would be up here in canada your bank and you are the only ones that negos. that rate we have a veribile rate that you don't have to lock in and the interest is low but can flex up or down riskaa and then you have a prime lending rate  that you lock in for how many years 5 to 20 but for a higher lendind rate and all the fee's that you pay are and whats with the.

  • I bought my condo 12 years ago by myself, I got a 1 bed room because that is all that I needed, I bought within my MEANS, this place is very nice, around 1300 sq ft with balcony and a storage closet off the balcony. I refinanced with a a fixed rate once again, and shaved 15 years off my original loan, I am still in this condo, now happily married and paying this sucker off, toward the principal, it will be ours in 7 years, these people who bought way too much house, & over paid for what they got

  • @0manoscar Well, I was a single gal up until 2 years ago, I was a corporate executive receptionist for around 30 of my working years, I worked for a toltal of 35 years, and like I said, I bought within my means, my condo listed at 52.9K and i got my loan at that time thru Fannie Mae first time buyer and refinanced with Wachovia when the interest rates droped, it was a "No brainer", buy what you really need, your friends and neighbors will not step up for you when things go wrong !

  • your P-note, spelled out the amount of your monthly principal and interest payment, and if escrowed the estimated yearly cost added in with the condition that if taxes and Insurance increases/decreases your monthly payment will adjust accordingly up or down. But your principal and interest amount remains the same., unless an ARM loan. This was provided to you at closing, prior to signing. They provided you with the actual amount ,if you did not take the time to read that and signed, its on you..

  • @Chess3945: i read myy statements I still remember those wolves knocking at my door. One wolf actuall called me stupid for not taking advantage of the housing market, by refinancing. I own my own home, bought it cash. Cell phone towers was a great investment. I remember how some of them were even rude to me, by attacking my mental abilities. I saw one of those idiots last week. He was telling me how he lost his house. I all I could say was"now who is the stupid one". .

  • @Chess3945: You should have seen the abuse that I had to encounter. Because I said no. They were like roaches comming out of the wood work attacking me. Telling me I could get ten of thoiusands of dollars just to refinance. But after i paid off the house, all i got is insurance and taxes. Might have to get a small loan to fix my roof. Damn a loan I got $6000 in the bank to fix it, just got to let it grow. I might have to move to Canada, if the GOP comes back into power.

  • @hiiamrick Bank reform laws were definately needed. Basing a loan on credit scores and not on income was plain stupidity. Both the borrower and the Banks took advantage of that. Greed. Gee your score qualifies you for 250,000, and they took it. Only to realize their income could support only a 150,000 home. And here we are in a foreclosure nightmare. Not to say all of it is due to that, loss of jobs are a huge factor as well.

Dude I recently visited Atlanta, where the the job loss situation is severe. I met an ex CEO, that was waiting on my table, he told me that when his company folded he had to let go of his12 employees also. People just don't understand that Bush's deregularation was a major cause of our current situation.

  • @hiiamrick aggressive mortgage brokers are also a huge part of this mess, promising low income homeowners the ability to refinance a loan, from an ARM to a fixed prior to the recast, just didnt work. WHY? because when they went to refinance, they checked income and income couldnt support payment. The ARM adjusted them right out of their homes.
