There's a middle ground in that example. Leave a note with a fake name, number, etc. Torch the guys' car so there's no evidence. Kill yourself (no, not really). You need to think outside the box man ;-)
not so sure about the example you chose...there really is only two outcomes..and no middle ground with that one. BUT I do agree with you about the polarization of issues.
This may be the cynic in me talking, but the general expectation would be for someone to walk away from the accident, because he/she is a jerk. It is expected for someone to act like a jerk, by default.
