Blokemall, in most cases anyone can purchase the radio. But you will need them to program in the channels for you. A reputable dealer will only program channels designated for public service (police, fire, state police, or sheriff) into the radio in a receive mode. There is nothing illegal about using one of these radios as a scanner as long as encryption decoding isn't enabled. Normal APCO25 decoding is fine, as long as it hasn't been encrypted.
question for you, have you ever programed a XTS-5000. I am currently on a music tour's security advance team and we are debating on getting the software so we can program our radios whenever and wherever. Since I am the only tech savy dude on the team I have been asked if we proceed with the purchase for to program. I have programed with Kenwoods easy software but was curious about motorola. I asked you cause you seem to know a lot : ) Thanks !

stick with Kenwood or Icom. There is a joke in the radio business: MOTOROLA!! you can always buy better but you CAN'T PAY MORE! LOL
