THIS IS SO STUPID! Avril wrote her song (Sk8er Boi) in 2001! and the song came out in 2002! When the song of Fall Out Boy came out Avril was making promotion of her 2nd or 3rd album! this is so stupid, none of them stole anything.

Its just a guitar chop, and a very simplistic one at that. That in no way constitutes plagerism.

Also, and I'm a big Rubinoos fan, the only real similiarity is the Hey, You call and response bit and if you're going to use that as a basis for a lawsuit, the Rubes better start planning their defense for the Stones "Get off My Cloud." Plus, I believe Avril when she said she'd never heard the song before; its pretty obscure, epecially for anyone under the age of 40.

well heres what i say when people say musical parts are copied. there are only so many different combinations of note you can play. I think that as long as the lyrics aren't copied (which i doubt fall out boy would wanna sing a song about a guy) then it shouldnt really matter.
