15 yrs ago we used to hear stories about how officers "never once had to pull out my service revolver in 30 years of duty". That does not exist any more. I am not a cop but I have been on about 10 ride alongs and officers pull their gun all the time. I don't blame them at all. It's a different time now. Unfortunate. Yeah it is. But it is the reality.

I will say IF QUESTIONED, it is BEST to inform an officer you are armed. HOWEVER, there is NO law stating that you MUST disclose this information prior to being asked. The officer is 100% wrong in his statement "it's your job to tell this officer your armed." Don't ever be confrontational, BUT NEVER feel afraid to inform an officer his misinformed understanding of gun laws are incorrect. Be smart, carry carefully.
I hate to say it but the guy in the vehicle should have communicated to the officer that he had a firearm. It's common sense, cops have dangerous jobs, they don't like to see guns. That doesn't mean it is wrong to carry ( I do it all the time). We (carriers) just need to realize that cops are just people, concerned about their safety just like you and I. However the officer was way over the line threatening to blow the mans head off. That is disgusting and I hope he loses his job for it.

not all states require you to let the officer know that you have a legally concealed handgun unless they ask. Some states like Alaska that don't have permits meaning anyone can legally conceal a gun as long as your not a felon, but the law their requires one to let an officer know right away if you are concealing a legal firearm. I can understand it being night time so the cop is naturally on the defense but, saying he will blow his fucking head off is rediculous.
Brunswick is a small town in southeast Georgia, near the coast. It is incredibly poor. I think the town is about 80% black during the day and 95% black at night. Virtually every house is a shack, worth under $20,000. Drive down any street in the daytime and on every block dozens of blacks sit on the front porch and hang out in the street. Unemployment rate is about 60%. It is a good place to avoid. My guess is bottom of the barrel type cops work there. Avoid the town if you can.

We have rights. Our system is set up so INNOCENT people like this guy dont get harassed or possibly killed. That guy was in EVERY LEGAL RIGHT to have his gun the way he did. He also was receiving different commands from TWO officers. He was told not to reach or touch the gun to unbuckle. Hell, the officer on the passenger side was in a bad position if the aggressive officer did fire. He could have very easily been hit himself.

You do need to inform the officer that you have a weapon on you. When someone doesn't comply, the officer has discretion to handle the situation as it proceeds. The individual was complying, but was complying very slowly which in my belief made the officer uneasy. I live in Georgia where a man, 1 month ago just killed a police officer with a AK-47 and shot the officer 20 times, so if you think that the officer is out to get this guy, your very mistaken, I would have said and did the same!

Ill give you an example of how it should work. I was stopped at a DUI check point. One cop talks to you while the other walks around your car. He shined his light at me from passenger door and saw my gun open on my hip. He called over another cop who finished the walk around while cop two kept a close watch on me. Never spoke a word to me about the gun or asked me for my permit.
You need to read the law. COPS have the right to search you if they think you have a weapon for their protection. Not only but have the right to seize it at least temporarily.
Now if you are carrying a gun in plain site even if your state has the right to carry in plain site. The cops still have the same rights to be safe. Not give it back until they are done with the stop. At which time they can render the gun safe so you can not shoot them as they leave.

I live in Glynn Co and the SAME thing happened to me. The mistake I made was telling the officers about my gun. They never even heard of a carry permit through Probate court. They wasted an hour of my time and tossed my vehicle only to begrudgingly have to let me go. I knew the Chief of Police at the time. He advised that I speak to the Watch Commander. well here in GA you are NOT required to inform the officer you are a GFL holder or you have a weapon in the car. and its a violation of your 4th amendment right for them to take your weapon and run the serial number without your consent. next time just say no you dont consent to that.
Every time I've been stopped I've handed the officer my permit with my license, registration, and insurance. Sometimes they just say alright, slowly hand me your weapon butt first, other times they've asked me to step out of the vehicle while the retrieved it.
I knew a guy who got pulled out of the window of a jeep cherokee when the officer asked him if he had any weapons. He didn;t explain that he was legally carrying, he just said i have a gun.

Having a gun drawn on you will sober you up wont it. Everyone I know who carry (open or concealed) hand the officer their carry permits (or declare that they have a weapon) with their drivers licenses. None have had any problems and most LEOs say thank you.

It's not all beside the point: the citizen had a right to have a weapon, was not legally required to inform the police, and got a gun in the face for not giving up his rights.
Cops may have a difficult job at times, but that doesn't excuse them from using the threat of deadly force against someone who is breaking no law or offering no aggression.

The officer proceeded to threaten the citizen unlawfully with deadly force. In such situations the citizen becomes empowered by the law to defend himself with lethal force if necessary. The officer placed himself in harms way by his actions and gave himself no defense by violating the US Constitution.
Police officers are permited discretion in most states in relation to conducting traffic stops. If a police officer observes a weapon in a vehicle, regardless if it is easily accessible, he is completely justified and within legal limits in taking necessary precautions. To include drawing his sidearm. Traffic stops are the number one killer of police officers today. Once the driver has provided his license to carry a firearm, then the overall outcome will change. I would've done the same thing.

It is hard to believe that you posted this video. That Officer did what was right by pulling his weapon in response to a weapon being in the truck. If he had not and the driver had intensions of using his gun against the police then the officer's response time would have been too slow to react and defend himself. @secuervo If you pay attention to any concealed weapon class the first thing they tell you is to advise a law enforcement officer that you are carrying a weapon in the event of a situation like this. Enough officers have been shot (or shot at, like myself) to not take things like this lightly. The PC was this man had a firearm in his vehicle and did not tell the officer about it. Its not a criminal offense, but its a good way to get a glock in your ear.

@secuervo and as far as the 14th amendment goes, it protects against illegal search and seizures. They were not told about a weapon in the vehicle, or even a concealed carry permit. You sound like a smartass lawyer, that should know about two things: 1) The plain View law. Anything that is illegal in nature seen in plain view by an officer allows the officer(s) to search without consent and without a warrant.
@secuervo 2) Read the 4th amendment too, its got some information you apparently missed in class. For a search to be illegal there has to be some idea of privacy. The seats of a vehicle are not thought of as to be a private place, by any states law. So you need to brush up on your books a little there before a law officer schools you in court. It might help you get a little business when possible clients think they are getting a man that KNOWS HIS STUFF to represent them in court.

@gotgank When armed and having an interaction with an officer there are always risks. I dont like the risk of them taking my firearm away from me. Not all of them are very familiar with anything besides there service pistol. Ive seen cops try to disarm people and cant even figure out how to get the gun out of the holster, or how to open the cylinder on a revolver. I will try to avoid them possibly fumbling around with an unfamiliar gun.

For all you idiots: there is NO requirement to inform in the state of Georgia! I don't care what your cop buddies told you, they DON'T know the law! In fact, there is less requirement for the police to know the laws they enforce than there is for citizens who might break them.
You MUST tell an officer you have a firearm IF they ask you about it. You are NOT required to allow them to disarm you, or to "run the serial" unless they have PC or RAS to believe there is a crime involved.

I will say IF QUESTIONED, it is BEST to inform an officer you are armed. HOWEVER, there is NO law stating that you MUST disclose this information prior to being asked. The officer is 100% wrong in his statement "it's your job to tell this officer your armed." I hate to say it but the guy in the vehicle should have communicated to the officer that he had a firearm. It's common sense, cops have dangerous jobs, they don't like to see guns. not all states require you to let the officer know that you have a legally concealed handgun unless they ask. Some states like Alaska that don't have permits meaning anyone can legally conceal a gun as long as your not a felon, but the law their requires one to let an officer know right away if you are concealing a legal firearm. I can understand it being night time so the cop is naturally on the defense but, saying he will blow his fucking head off is rediculous.

Brunswick is a small town in southeast Georgia, near the coast. It is incredibly poor. I think the town is about 80% black during the day and 95% black at night. Virtually every house is a shack, worth under $20,000. Drive down any street in the daytime and on every block dozens of blacks sit on the front porch and hang out in the street. Unemployment rate is about 60%. It is a good place to avoid. My guess is bottom of the barrel type cops work there. Avoid the town if you can.

He also was receiving different commands from TWO officers. He was told not to reach or touch the gun to unbuckle. Hell, the officer on the passenger side was in a bad position if the aggressive officer did fire. He could have very easily been hit himself.

You do need to inform the officer that you have a weapon on you. When someone doesn't comply, the officer has discretion to handle the situation as it proceeds. The individual was complying, but was complying very slowly which in my belief made the officer uneasy. I live in Georgia where a man, 1 month ago just killed a police officer with a AK-47 and shot the officer 20 times, so if you think that the officer is out to get this guy, your very mistaken, I would have said and did the same!

Ill give you an example of how it should work. I was stopped at a DUI check point. One cop talks to you while the other walks around your car. He shined his light at me from passenger door and saw my gun open on my hip. He called over another cop who finished the walk around while cop two kept a close watch on me. You need to read the law. COPS have the right to search you if they think you have a weapon for their protection. Not only but have the right to seize it at least temporarily.
Now if you are carrying a gun in plain site even if your state has the right to carry in plain site. The cops still have the same rights to be safe. Not give it back until they are done with the stop. At which time they can render the gun safe so you can not shoot them as they leave.

Glynn County and Brunswick police are very much over zealous and I think it's because of the Federal Law Enforcement Training Center being in the same town so they have to prove themselves. Anyone that lives in Brunswick will tell you how corrupt the law system is in this town. I live in Glynn Co and the SAME thing happened to me. The mistake I made was telling the officers about my gun. They never even heard of a carry permit through Probate court. They wasted an hour of my time and tossed my vehicle only to begrudgingly have to let me go. I knew the Chief of Police at the time. He advised that I speak to the Watch Commander. I did so and the man PURPOSELY misquoted the law to me and another witness. I just left it alone. If they only knew how many NFA guns are here!!

In some jurisdictions it is required that you inform an officer that you are armed.
You must also follow the orders of the officer during a traffic stop so that no mistakes are made.
Officer safety requires that potential threats be handled with force if neccessary.
This dumb ass failed to do any of those things.
I hold a carry permit in Minnesota. And I always behave well when required.

Every time I've been stopped I've handed the officer my permit with my license, registration, and insurance. Sometimes they just say alright, slowly hand me your weapon butt first, other times they've asked me to step out of the vehicle while the retrieved it.
I knew a guy who got pulled out of the window of a jeep cherokee when the officer asked him if he had any weapons. He didn;t explain that he was legally carrying, he just said i have a gun.

My state is the same, and I would never inform either.
Take your stance further: All people have to do is inform everything to cops at all times, and submit to violations of rights, and the cops will be nicer to you.

It's not all beside the point: the citizen had a right to have a weapon, was not legally required to inform the police, and got a gun in the face for not giving up his rights.
Cops may have a difficult job at times, but that doesn't excuse them from using the threat of deadly force against someone who is breaking no law or offering no aggression.

@jgraz42 Actually, he has no reason to inform the officer, nor legal compulsion to do so. He told the officer about the gun and let him know he was licensed to carry. The officer proceeded to threaten the citizen unlawfully with deadly force. In such situations the citizen becomes empowered by the law to defend himself with lethal force if necessary. The officer placed himself in harms way by his actions and gave himself no defense by violating the US Constitution.

Police officers are permited discretion in most states in relation to conducting traffic stops. If a police officer observes a weapon in a vehicle, regardless if it is easily accessible, he is completely justified and within legal limits in taking necessary precautions. To include drawing his sidearm. Traffic stops are the number one killer of police officers today. Once the driver has provided his license to carry a firearm, then the overall outcome will change. I would've done the same thing.

It is hard to believe that you posted this video. That Officer did what was right by pulling his weapon in response to a weapon being in the truck. If he had not and the driver had intensions of using his gun against the police then the officer's response time would have been too slow to react and defend himself. It is all about going home to your family when you're out there patrolling. Better safe than sorry. And as far as the law suit is concerned, bring it!!! Holla!!!!!!!

@JHENSLEY551 Because he was not legally required to do so. The officers violated the 2nd and 14th amendments and the laws of Georgia. They did not have probable cause, nor was the citizen acting in a manner which was threatening. The officer did however give the citizen the necessary components to defend himself with deadly force when he threatened him with deadly force without probable cause. Learn the law, I spend many a day schooling officers like you who don't know the laws they should.

@secuervo If you pay attention to any concealed weapon class the first thing they tell you is to advise a law enforcement officer that you are carrying a weapon in the event of a situation like this. Enough officers have been shot (or shot at, like myself) to not take things like this lightly. The PC was this man had a firearm in his vehicle and did not tell the officer about it. Its not a criminal offense, but its a good way to get a glock in your ear.

@secuervo If he would have tried to "Defend" himself as you put it against the officer of the law, then he runs the risk of getting his face blown off. More importantly you need to learn the law yourself, because apparently you do not understand anything about the 2nd and 14th amendments and how it pertains to an officer of the law. He was not denied the ability to carry the weapon, after clearing the weapon and after the stop was completed it was given back.

@secuervo and as far as the 14th amendment goes, it protects against illegal search and seizures. They were not told about a weapon in the vehicle, or even a concealed carry permit. You sound like a smartass lawyer, that should know about two things: 1) The plain View law. Anything that is illegal in nature seen in plain view by an officer allows the officer(s) to search without consent and without a warrant.

@secuervo 2) Read the 4th amendment too, its got some information you apparently missed in class. For a search to be illegal there has to be some idea of privacy. The seats of a vehicle are not thought of as to be a private place, by any states law. So you need to brush up on your books a little there before a law officer schools you in court. It might help you get a little business when possible clients think they are getting a man that KNOWS HIS STUFF to represent them in court.

@hievery1policehateme And he would be right. All the States I know of that have CCW permits/open carry, state that u MUST notifiy any Officer u come in contact with that u are armed. This guy (you?) didnt, and could be charged with unlawful CCW. Follow the rules or pay the price.

@YllwFvrPB Dont get me wrong, I firmly support the right to bear arms and open carry. But, I also believe in common sense. To a working Police Officer, an unknown with a weapon is considered a threat until he feels ur NOT a threat. A big step towards that is to let him know ur carrying. Too many dangerous animals in this world with guns. A traffic stop is an incredibly dangerous activity for Cop. Why add risk of a tragic mistake, just "Cause you can".

@gotgank When armed and having an interaction with an officer there are always risks. I dont like the risk of them taking my firearm away from me. Not all of them are very familiar with anything besides there service pistol. Ive seen cops try to disarm people and cant even figure out how to get the gun out of the holster, or how to open the cylinder on a revolver. I will try to avoid them possibly fumbling around with an unfamiliar gun.
