Joe is claiming the melody only ( you can't sue for chord progressions with modern music as most are text book) Here is the melody only it was recorded 3 years before joe realeased his song. Major ,minor ,key makes no difference ,they sound virtually identical. If it exists some where else you cannot sue for it. This is why Joe can't win.
