So your saying that everyone at Gitmo is a terrorist? What of the people who aren't and weren't terroists? They get no say? Or are they just terrorists because you say so.
There is no need for terrorist's to attack America after 9/11. Their goal was to have us attack ourselves and they have succeeded! They are watching us use the constitution as a peice of toilet paper with Gitmo, Abu Grab, The Patriot Act, Wire Tapping and they have concluded that there is no need for now to attack America because the NeoCon republican base has already ATTACKED AMERICA! The prospect of lower level administration officials being held accountable in civil court or even criminal courts is more likely. Obama will not carry the political baggage of prosecuting Bush, until the public becomes outraged by revelations of significant misdeeds.
Let's not forget CLINTON said the same thing about BUSH SR. And all those men who were involved in criminal activity followed Bush Jr. to the White House and you see where that got us. SOMETHING needs to be done, they are CRIMINALS!

Obama made a deal with the R leadership: I won't investigate/prosecute torture, Iraq war intelligence manipulation, etc., if you give minimal resistance to my new New Deal legislation, let my nominees through, and make sure I have a solid and successful first 100 days. The Dems are implicated in every failure of the Bush Admin, so they don't want to bring to light how their own political interests were served at the expense of our security and Constitution.
Pardon my asking but how is Truth and Reconciliation Commission a benign thing? I mean there would no prosecutions but they would unequivocally name Bush and Cheney as war criminals. That is worth something, no?
The Democrats (and many of these corporate lapdog pundits fear ENFORCING THE LAW will make them look bad! Remember, that Gerald Ford lost in '76 because he PARDONED Nixon. The Democrats better pull their head out of their ass OR they will see a repeat of 1994's "Gingrich Revolution", where the triangulating Dems lost vital support of their base. What Obama won can be lost again without the grassroots behind him and the Dems and America cannot afford to go back into the hands of the Republicans!
The Constitution and the law is core to our future success as a country. Not just torture, but a politically motivated Justice Department, lying us into the Iraq War, and illegal wiretaps -- we are systemically screwed regarding future Executive overriding of the Constitution if the law does not step in now. Why do these pundits never talk of this? This is the main and best reason to investigate & prosecute not political revenge, but TV pundits ignore this core argument.

It states that we are required to prosecute those that torture in the USA. If we will not it stated we must send them where they will be prosecuted.
