Robert Spencer is a Catholic of the Melkite Rite. Their church is in communion with Rome and therefore is part of the Catholic Church. Even in times of war, the teachings of the Qur'an prohibit killing civilians, women, children, elderly people and those who are not armed who have nothing to do with war.
