  • This is sad, and for those who hate "illegals" many people are detained when they have papers to. The usual reponse is well if they have papers what are they crying about. Answer: They went through a traumatizing ordeal, detained for HOURS, and were treated like dogs. I should let them take me in,and give them heck, for detaining yet another US Citizen! Drive the point home! God bless everyone! :)

  • Could be a tough sell. Boarder patrol agents often set up check points within US borders. If you've ever traveled in southern New Mexico or Arizona you may have run across checkpoints run by the Boarder Patrol - well within US boarders. The obvious question is: Why shouldn't the Boarder Patrol check the status of people in the US?

  • Some people miss the point completely. ICE (Immigration and Customs Enforcement) has nationwide jurisdiction. And there has been like these for ages. If a legal immigrant needs to, say, update his visa status, there are dozens of ICE offices all over US.

    Comparisons to "Nazi German" are also unfounded. All European countries have had, since the late 19th Century, legal requirements for everyone to carry some ID. No really big deal. Moreover, they are only taking out illegal immigrants...

  • @howardkevinm It would seem Border Patrol only has jurisdiction over the border and surrounding areas but the border patrol has nation wide jurisdiction including pulling cars over and detaining/ investigating illegals on local, state and federal highways. See them here in Florida all the time with vehicles pulled over.

  • This is disgusting. If they didn't allow the boarder to have more holes then Swiss cheese or leaks then a colander, there would be no excuse or reason for this going on. This, along with the state of the boarders is all done intentional. One reason is so they can have agents of the government stop citizens on the street or on a train and say show me your papers and have us get used to it.   • Actuallly i disagree with the description..... Border Patrol is a Goverment Agency.... Amtrak is a Goverment Company.... Border Patrol can get on the train. Along with Amtrak Police. And Buffalo is the last stop before going into Canada. Which gives they right to search the train

The only time in history the US Border patrol searched within the USA was before the beginning of the Civil War and why because the south declared independence and the Border patrol was deployed close to the CSA. I do happen to believe the Feds should introduce legislation that would make it recognised to ask for immigration status on all levels. Especially the border states with Mexico.

  • As a former Border Patrol agent, I find the ignorance of not only the original poster, but of those responding to this video as amusing, yet an appalling display of lack of knowledge about what my former agency does. Profiling? You admit in your description that the agent asked everyone, so profiling it cannot be. Your train may not have crossed a border, but was an avenue of travel away from a nearby border, which is why it was checked.

  • Fake Id's to collect welfare and housing? Really? You do know that not only are they suppose to match the person in the ID, they also have to provide a SSN, a valid BC and an established residence. The SSN is sent to SSA for verification. Very, very few have been able to cheat the welfare system. As to who pays the unpaid ER bills by Americans and illegals alike, well, that's anyone who pays taxes, including illegals. Name the states that allow illegals to apply for such programs.

It does say PUBLIC schools, but I agree that the majority of them are specialty schools. It still does not rule out that they have a high minority population with a high economically disadvantage enrollment, many student's possibly undocumented.

  • @charmedvip Sorry, but all my statements are supported by facts. I live 3 miles away from the border in a high immigrant population, a large number of them, no doubt, undocumented. I've lived here for over 30 years and I've NEVER once experienced this so called devastation you mention. I have no idea why you bring up Latin America if I haven't mentioned them in any of my posts, although I do believe the MAJORITY of them are decent and a very minute portion cheat the system.

  • In addition, my fiance used to work on a dairy farm which trucked illegal aliens in to milk their cows. These people ADMITTED they were illegal, given fake names like George and Robert ( I mean come on really?!). They were PAID UNDER the table and ALL had New York State medicaid cards....I have SEEN THEM! My fiance would always mess with them and tell them the Border Patrol was coming and they would run and hide. They are guilty and know it .

For one, undoc immigrants don't qualify for medicaid, so how could they have them? & even if they were paid under the table, it still doesn't mean they weren't paying taxes. I mean, why would they need fake names if they were paid under the table? But still, they must have paid rent, sales taxes, property taxes, etc. Your fiance is just as guilty of committing a wrong by not calling the BP and reporting them.

  • @iammetx In my area, the illegals live in housing provided for them by the farm, therefore, no rent or property tax. They are paid in cash......no income tax. Their purchases are minimal......... not much sales tax. Much of their money is sent south. As a group they operate a vehicle, generally with no reg or ins. As for the fiance informing BP, I'm sure he had an interest in protecting his job, and by your standards, since this was not a checkpoint, BP shouldn't have any jurisdiction.

  • @specopspr How can they pay taxes at the end of the year if most don't make that much. Normally, a low income family will receive an income tax reimbursement, but since undocumented immigrants can't claim their reimbursement it goes back into the coffers.

  • @iammetx Not all illegals get paid low wages. That's a misconception. I seen situations were they use a SS# for one job and another SS# for the other job to split the income to make it seem low. I know the tricks so don't come to me with that.

  • consider THESE numbers: It costs my district $36,000 to hire a NEW teacher...that is assuming that these specialty teachers are first year hires which most are not. These illegal aliens are ABSOLUTELY not paying that much in state and federal aid picking cabbage on the roadside for $8.00/hour thus, they are SUCKING MORE THAN GIVING (crude way to put it maxzig but the figures DONT lie).

  • I absolutely agree that illegal aliens are "sucking more than giving" as well. I am a teacher and work in a school district with very few minorities. Everytime another illegal moves into the area--and we know they're illegal because they refuse to disclose their citizenship--their children come to my school and are able to speak only Spanish in which we are LEGALLY bound to hire interpreters, English as a Second Language (ESL) teachers to SPECIALLY service these children.

You don't know if they were illegally in the country and from the video and the descriptions and the user's admittance that the people provided documentation, it is clear they were adjusting status, and the officer was wrong about them not having equal rights.

  • @iammetx It is legal for BP agents to conduct immigration inspections base on reasonable suspicion or probable cause depending on the situation. Now, how do they get to develop that RS or PC is how the game is played. They are numerous things they can do for that. I could explain them but I'm not going to talk about applied authorities. You mention equal right, what equal rights?? Equal rights compare to US citizens in immigration? They DON'T.

  • @iammetx We go back to the illegal question. Are they illegally in the country YES, are they adjusting their status?, who knows. Until it is confirmed. But since their visa, assuming they have one, is not readily available, which every immigrant has to carry on them at all times by law; then they are illegally in the country and they are detain and transport to a processing facility.

  • @iammetx I'll tell you what. Tell all your illegal immigrant friends, assuming you have them, to file a I-485, and then go through a POE or a BP checkpoint ;). Because according to you they are parole and they are not deportable. And then we'll see who's right ;)

  • @specopspr Wow, and you say I don't know what I'm talking about. Not everyone can file for an I-485. In order to file for I-485 a person MUST BE IN STATUS all the time (i.e. not in the country illegally), OR, has stayed illegally for less then 180 days (i.e. overstayed their visa), OR qualifies for the LIFE act. It's not as easy as just telling my undoc friends to do that. If they qualified, they would just to prove you wrong, but only a BP checkpoint. For a POE, they'd need adv parole. ;)

  • @iammetx I know, but according to what you said before they get parole because they are illegal so they can finish their residency requirement. Also, not all non-immigrants can adjust status. You talk with the "I wish this and that" idea. And most people here are talking to you with the way things are.

Yes, the concept of "give me your tired, your poor, your huddled masses...." is still alive. Unfortunately, too many people take advantage of the generosity of this country and its tax payers by entering and/or staying illegally making checkpoints like this necessary. Frankly, I'm happy to know that this guy is looking out for my country, my safety...and my wallet.

The one fact we agree on is that this agent was doing his job. Few of us are happy with the overall inefficiency of the government, but your suggestion that we stop enforcing immigration law just because it is difficult to do so is ludicrous...and dangerous.

For the most part, if they are living here undocumented, they would be working AND paying taxes, thus, whatever social service benefits they get, if any, their American born child is entitled to it. As an American, I don't care about my tax dollars going to assist those in need. It's not weighing on my pockets. What's weighing on my pocket are high gas prices, high food costs, and high utility prices.

  • @iammetx Then YOU send a few bucks extra in with your tax return next year stipulating what it is to be used for. Taxes very much contribute to the high prices of all the items you mentioned, and so much more. This country simply cannot afford the burden. Check the financial status of the hospitals along the southern border, and the social service costs of the south western states. If what you say is true then none of these problems would exist.

The financial status of the hospitals here on the border are due to lawsuits for malpractice & medicaid/medicare fraud, high tech equip maint, doctor/patient ratio, etc. Over 80% of social service users in the south are Am citizens or legal residents. Our problem here is jobs being shipped out of country.

As it is, they've helped the tax payers in Texas alone with over $424.7 million in profit from the $1.58 billion in tax revenues they pay into the system through sales, property, and payroll taxes to name a few. Over all, it is estimated they pay over 9 BILLION in SS taxes alone in 1 yr

If your not a U.S. citizen you have to carry your paperwork with you, are we asking to much? And there is that nasty word the libs love again, "profiling".   • @iammetx We are talking about one specific crime of illegal entry into the U.S. Perhaps we should ask what is the ratio of white anglo-saxons to latinos or asians caught crossing the border illegally. I've got a feeling it is extremely low. So shouldn't we be checking documentation comensurate with that ratio. Local police profile constantly, if a tall thin blond white guy comitted the crime, they don't question the short bald man.

  • @maxzig71 Naturally, if they know who committed the crime, then they know what to look for. Not only that, but they also get clues from witnesses. They don't go around stopping every single white guy they see unless they fit the description and are roaming around the area where the criminal was last seen. So technically, it's not profiling, but filtering. What you are requesting and supporting is what you would call racial profiling and that is unconstitutional.

Look up the right to travel while in the process of adjusting status. It clearly states you cannot leave the country w/o advanced parole, but you CAN travel freely within the states.   • @iammetx you really believe I am incorrect, LOL. Once again, not too bright. You do realize when you adjust your status you still have to carry the paper work and your visa with you. You can also be issue a fine for not having your documents on you at all times. This is explain to immigrants when they receive their visas. I do have a lot of experience. I'm sure you are a good source of reliable information, LOL

  • @specopspr Not only can you be issued a fine, you could be arrested, charged, and sentenced up to 30 days in jail! It is a criminal offense for non-immigrants and immigrants to not have their immigration documents on their person at all times. Title 8 United States Code Section 1304(e)

  • @porkerm7 No one is arguing that. Where in the video do you see the officer requesting to see any documentation? True, applying for a green card does not mean they have equal rights to stay in the country, but if they filed to adjust status, then they more than likely have another type of visa that affords them those rights. Like I said, no where in the video did I see the officer request to another form of proof for legal status.

  • @iammetx Have you even considered the possibility that the requesting of documentation occurred BEFORE the camera started filming and that was probably what prompted the interest in the situation by other passengers in the first place? I know I've gone out on a limb and used logic here, which doesn't seem to be the norm in your comments, but seeing as how the first line in the video is "Just because...", one could assume a decent portion of the conversation had already taken place.

  • @dtpvegas And I'll be going out on a limb here, considering reading doesn't seem to be the norm in your comments, but if you actually click on the little arrow up there ^^^ and read the description, it states the officer ASKED everyone what their immigration status was and then chatted with the couple for a while before escorting them off. It does not state that ID's or Visa's were requested. Obviously, your logic fails you.

  • @iammetx Yes - I'm the moron. It's obvious that the depiction of the chain of events provided by the completely unbiased poster that you accept as Gospel is 100% accurate. I'm sure that absolutely no additional conversation took place in between the agent asking for immigration status and the start of the video. Sometimes I forget that the use of common sense and reason has no place in our society. I should probably adopt your philosophy of not using either and get my news from You Tube...

  • @iammetx I'm interested to know what you would like to see the Gov't do in relation to border security. Would you like totally open borders with no restrictions. Maybe we should further hobble our agents and limit their powers to within a100 yds of the border. The U.S. has one of the most relaxed border system in the world now, just exactly what do you want?

  • @iammetx Stop talking about advance parole. That only allows someone to re-enter the country after they have left. But, if they're stopped in the country and they're not in status....guess what? You got it, they can be arrested and sent before a judge.

  • @porkerm7 It still applies to those who are here. Certain immigration benefits and time spent in the U.S. while certain applications are still pending may place you in a period of authorized stay, e.g., a properly filed application for adjustment of status, etc.

  • @iammetx This video is less than one minute long. Trust me, it takes a lot longer than that to determine a person's status in the country. Maybe the person didn't have any documentation or maybe he'd already given it to the officer and the video didn't catch that part of it. There's also this little thing called performing records checks. When you apply for and receive visas, green cards, etc., that all goes into computerized databases. Border Patrol just doesn't arrest people on a whim!

  • @porkerm7 These people were not being arrested. They were being detained. @ any internal checkpoint, the officer usually only asks 4 immig status & not verification of it. It's not to say they don't request it, but when they do, they need to have a valid reasonable suspicion, i.e. they refused to show legal docs. Assuming he asked for doc, if they didn't provide it then he'd be within his right, but the descriptions state otherwise. Many pple don't fight this b/c they don't know their rights.

  • @specopspr What visa? When you are in the adjustment of status, you do not have a visa. Just a receipt from INS that looks like a cashiers receipt, and if you have a lawyer, it is advised you have the letter from your lawyer explaining your situation. Like I said before, each BP agent is allowed to exercise their decision at their discretion, and you can still be deported, but it does not mean you are illegally in the country when you are adjusting status and you still have rights.

  • @iammetx I'm glad everything worked out for your husband. You are correct that every BP agent has discretion...within the law. Rest assured that during any adjustment of status you must maintain the status of the visa on which you entered this country. If not, you can be arrested and sent before an immigration judge. That is the law and that is why the person in this video was taken off of the train.

  • @iammetx Really? You STILL have a visa when you are adjusting your status. How the hell you think they get in the country to start with??!! Unless they have a visa waiver. Now you are talking out of the blue. I'm done trying to teach you a thing or two. I'm not even going to go into the deportation process. Of course they still have rights; they have the right to an immigration hearing!!! And it all depends what type of visa they have to adjust their status. Good luck to you!!

  • @specopspr LOL, no you don't nec STILL have a visa when adj your status. If the visa was lost or stolen b4 adj. status, or if you entered the country illglly & then applied 4 adjustment of status, then u DON'T have a visa. Seriously, YOU are talking out of the blue. Advance parole is most commonly used when someone has Form I-485, App to Reg Perm Res or to Adj Status, pending. Note, this couple is applying 4 a green card, but they were not asked 4 proof of any other doc 2 prove legal status.

  • @iammetx Listen....any alien can apply to adjust status at anytime regardless of status. Just because you fill out an I-485 it doesn't give you the right to remain in the country illegally. If your visa is up, then you must return to your country and wait for the application to be approved. ICE and CBP arrest thousands of aliens for this and I don't see any lawsuits to get them to stop. Why?....because they can.  Maybe you just happened to get a lazy BP agent who didn't want to do paperwork

  • @porkerm7 It does if you've already been assigned an alien #. Being assigned an alien # doesn't mean your application is approved, but usually you are given an A # when you pay your fine & submit your application at an INS office. You can still be deported @ the discretion of any BP agent, which is why it is advised you do not travel past these checkpoints during the application process. Many ppl who get deported during these times are then barred for a # of yrs b/c they don't know their rights.

  • I live in this area, take this train to Albany and NYC on a regular basis.

    Perhaps this is detroitjones' first time on the train, it stops at an international border crossing in Buffalo. And when the officers board at stations they always ask each person the same few questions. There is no "profiling". Indeed, we can see these people admit they are here ilegally.

    The main point this video makes is how professionally the officer handled these two illegal aliens.

  • @charmedvip Which terrorists? The legal ones, the American ones, or the undocumented ones, because none have been caught at these checkpoints that I am aware of.

  • @iammetx It is not the BP's job to determine a good illegal from a bad illegal, just the fact that they are illegal. You are not privy to the information and inner workings of INS, I don't doubt that you were not informed of the thwarting of a potentially violent incursion. You're probably not at the top of their list.

  • @maxzig71 Of course it is not their job, but there are ways to go about instead of trampling on people's rights. Don't get me wrong, I admire the BP for their service & I do not blame them for the work they have to do. Living on the border, I've seen them do many great deeds, from buying food w/ their own money to feed the people they've caught, but I think they are focusing too much on minor stuff like illegal immig & it is why we need immig reform to reduce the need for these check points

  • @iammetx I'm done talking to you. The law is the law and people who can be arrested and set up for removal proceedings will continue to be whether you think they have legal status or not. If you would like I can give you the number to some head ICE and CBP attorneys who will attempt to explain it to you just as I have done. Ignorance of the law is no excuse....which is the case with the person in the video. You can continue living in your fairytale world and I will keep doing my job.

  • @porkerm7 You cannot tell if the people in the video were ignorant about the law. The user has already stated they provided documentation and they explained to the officer that they were adjusting status.. The officer's issue was not with their documentation but with their adjusting status in which he wrongfully tells them they do not have equal rights BECAUSE of the adjustment of status, not because of the docs they produced.
