Newly available DNA testing excluded Cruz and Hernandez as the child's rapists and linked Dugan to the crime. Even so, prosecutors refused to drop the case.
At trial, Cruz was represented by a team of four lawyers, including Marshall. During the trial, a police officer admitted that he had lied under oath in relation to testimony about Cruz's purported statement. After hearing all of the prosecution's evidence, the trial judge directed a verdict of not guilty.
this video was uploaded in 2007. what is the actual status on this case? did he get at least millions for being put in a place where he didn´t belong in the first place?
@ploetzlich30 i doubt it, americans are like the chinese and are known to not treat society right. in canada a law actually made anyone wrongfully arrested and spending more than a year automatically gets compensation depending on how long the person spent, in the usa a lifer will go bankrupt coming out and not be compensated, some have spent 500,000 out of their own pocket to go free, harold bright a man in louisiana spent 30 years and the result is he must pay 50 dollars for release papers.
this is so fucked up! I mean so much has to be proven in court and this or that evidence/testimony can or can't be brought in to be heard by the jury and yet someone can still be wrongfully convicted, even sentenced to death row? What the fuck is wrong with this picture!
@jokester859 3% of people are innocent, about 30,000 people receive a life sentence in the usa alone, which means nearly a thousand innocent lifers are going away a year and very few of those innocent are ever coming back out, here canada has no life without parole, it just has life which makes a sentence indefinite and over 90% of lifers are released within 17 years which means if you're innocent you'll likely still be young upon release and can get most of your old life back eventually.
@ultradumbass, sorry, but you don´t seem to understand how important EACH AND EVERY part of the human life is. you can NOT get 17 years back only because you´re "young"! if you goin with 20, you´re back with 37, you then missed almost the most important part in your life! please rethink what you wrote, and replay!
@ploetzlich30 would you rather lose your entire life to the american system? because that is what happens in most us states, ironically 50 years ago the usa was one of the more progressive countries in rehabilitating prisoners now it is one of few countries left with death sentences and mandatory life. in canada up until 1961 all murders carried mandatory death by hanging then from 1961-1962 it became discretionary before going on moratorium, now the maximum penalty allowed is 25 years to life.
@dlr1241 i agree. he is likely not telling 100 % truth. & i bet he was living in a crime ridden life to have been associated with such crime. There is always more to know. Not like he was a straight laced college boy going off to med school.
If you disagree with the death penalty that is fine. However you cannot justify releasing these people into society. Mental illness os not they are far to dangerous to co mingle with regular people.
This guy has a great case for suing the state for squillions...... Plus this should shed light on the dodgy prosecutors and cops........Good luck buddy!!
blomstersenter - I read your comment and thought about it for quite a while. I thought about the ethical, legal and economic results of having someone judged to be guilty and killed, because he was a homeless, dangerous, drug addict and deserved to die. In the end I came to one conclusion...please seek help as you are a disgrace to the human race and a dickhead for even posting such a comment. I'd love to rant as to how much your comment pissed me off, but you aren't worth it.
@blomstersenter judge not lest ye be judged God wont forget this calummny you brought against a man who wasnt guilty .You take more satisfaction from condemming an innocent man even though hes a druggie you have in effect aided and abbetted his murder God is watching be warned
@blomstersenter listen you stupid cunt ..you said you are religious why are you lying when a mans life was at stake..i hope you know you have blood on your hands now and jesus wont wash it off..who was the this person you sent to death..this person deserves to be forgiven if he was not guilty of this crime ..think long and hard please reply back to me
@TheOblivionRiver it's not like you get killed right away, there's a really long wait and you can make appeals to prolong the period. this guy just got lucky.
abolish the death penalty? why should we have to feed and house these scum bags for the rest of their lifes after they have killed someone. grow some balls and shut the fuck up.
The guilty do pay, they rot in prison an their lives are made a living hell. That saves the innocents so they can be proved to be innocent before they are killed..
Thank god they found out he was innocent or he wouldve been executed for nothing. Unfortunatley to get an apology from the Crown Prosecuter is like telling a donkey to giddy up but im very glad this young man was found not guily. I hope he is doing well now!!
Same as war. Sometimes the innocent do die. But because one innocent dies.....to save him and abolish the death penalty, means that the other guilty hundreds dont pay? This world will never be fixed, wheither its prison , gangs, police brutality, racsism, taxes whatever.Theres only one way. Jesus.
All I was really saying is that we live in an imperfect world and mistakes are made. Just because thoiusands have died in wars, do we stop wars?no......that kinda thing.
@flesch317 So you think a few innocent victims of this sick system doesn´t count? Did I get that right? I´m in correspondence with a death row inmate who´s clearly innocent since a long time. Year by year in this hell is going by and doesn´t know if he will have enough time to prove he didn´t commit the murder, his date (thank god) isn´t set yet. What do you think this man is going through? I agree with Cleo - wait until YOU end up innocent at death row, then you won´t give a shit anymore!
I guess, this case didn't take place in Texas. As far as I know EVERY death sentence will be carried out there - regardless of guilt of the condemmned. To avoid legal issues, there is a law, that innocence has to be proven within a particular amount from death sentence. Failing to do that will result in execution for formal reasons. This way, they save a lot of taxpayer's money.
fuck taxpayers money...taxpayers on an individual level dont pay shit..thsi country is a corporate colony full of investors..where do you think the debt comes from? we cant spend what we dont have but other nations (mainly China pay for our expenses in turn for ownership hence we "owe" them)..INNOCENT TIL PROVEN GUILTY...not the other way around
It makes me sick that these people can sentence innocent people to death. They couldn't have had the evidence or he would be guilty. Thank God he wasn't executed before being proven innocent.
@csdk44444 he can be considered lucky he got out as fast as he did, very few innocent people including lifers are ever released even if they are innocent and the few that do i read spend 37 years until proven innocent, an average lifer is 28 upon sentencing which means they are going to be over 65 before most come out, by then your life is ruined and there is nothing to look forward too so at that point you may as well have been killed than go through a 37 year long ordeal.
Police coerce confessions to avoid doing real police work. Many individuals will break in these interviews, particularly if they have low IQ's, are juveniles or have mental health issues. The fact that you support the executioin of someone because he gave a false confessions not only shows your ignorance but it also shows a complete lack of compassion or a moral compass.
JimbobdwayneSanchez, law today is no longer bound to moral. It's simply a business. It's nothing new, since torture has been used since ancient times to obtain confessions from people. That's the human nature.
that is true, but if people don't join together and fight against it, then it will always be that way. Criminals stick together when they are doing wrong! Why can't we stick together and do right?
injusticexposed, remember US is a republic - and not a democracy. So the (s)elected government decide about laws in place of the populace - and not the people themselves. So it's an open secret, Texas has redefiend the term Capital punishment into poverty-control. As long as people elect governors, who support this practice, nothing can and will be changed.
as long as Texas closes high schools down in major cities like Housaton and Dallas hads its insane illiteracy rate and lack of education the wicked will thriiiiive there.
@JimbobdwayneSanchez, I agree with you. I know someone who got coerced into a confession. He basically freaked out and worded things in a way that made him seem guilty.
@JimbobdwayneSanchez that is why judges exist, They act as a hedge against shoddy or incomplete police investigations. Yes most of these guys have mental illness, but what do we do with them?
I read about crime experts in false convition , highly educated in universitys, they said that many people want to help the police, and know they are innocent, so they refuse the help of an attourney or lawyear, and this often ends with them getting accused and convicted

I voted guilty when I was in a jury.
The man was definetly not guilty, but he was a homeless, dangerous, drug addict and deserved to die.
It gave me a hell of a power rush. He has no more appeals left and I wish I can come and see the execution.
