They would be required to tell people that it's a free-fall ride for legal and liability reasons. In addition, it would be quite expensive to manufacture such a ride. The construction costs for the Tower of Terror, whose elevators exceed free-fall acceleration, were over $140 million! In addition, the Tower of Terror's elevators are technically not elevators, rather vertical conveyance devices. The Sears Tower's elevators could never reach free-fall speed due to air pressure/wind resistance.
In addition, those would be recategorized as amusement rides and thus would have to be inspected daily. Interestingly enough, the elevators at the CN Tower are already classified as such even though they travel 2 m/s (4.44 mph) slower. Meanwhile, the admission price for both places is about the same.
GREAT video! and you were definately lucky to catch the one with the glass floor!! i have driven by there many times in my job, but i was never actually able to go there. is that the highest possible to go in the CN tower? or is there another higher deck??

The speed of this elevator according to the OTIS Website, it goes 1200FPM.
