Legally and in many people's opinions, molestation only involves unwanted contact with someones "privates", but no penetration. It jumps the fence and becomes rape when penetration is involved. Regardless of age, unwanted penetration = rape. I was molested by a female class mate when I was around ten. I never told any of the teachers, but I made every effort to stay away from her after that. My own mother didn't even find out until I was sixteen.
Well, I take this as a good sign, not only your case but in the legislation itself. The expansion of the definition to include unwanted acts from either gender shows that the law is recognizing non consensual acts regardless of past and present assumptions and double standards. We are not at the plateau of reasonable justice just yet, but we are most certainly getting there.
Also props to LJonYT for making this video, may your maturity in handing this inspire others.
To everyone else ... I know that abuse (in all its forms) can be frustrating (especially rape) and can bring up powerful feelings but hating someone, no matter how justified that hate is, is bad for your health. What we need is less focus on hatred and more focus on the love we can show the men, women and children that endure the abuse and live on. Don't forget some *people* kill themselves afterwards, so let's try to prevent that. Let's show the survivors that there is something to live for.
@LJonYT I just wanted to say that Im proud of you for telling your story about surviving your rape while also being an atheist. When I was in a center for the mentally ill and trauma survivors, I was the only one that doubted god's existence yet everyone except the workers respected my views on religion. I believed it wasnt necessary to believe in a deity to survive in life after being abused and still do. So you're doing a great thing by showing that atheists experience pain too but survive. :)
Hmm...molestation always sounded more serious to me than rape, but then again i never really took a good look at the technical definitions of those words. Either way, rape/molestation is to me a crime of a seriousness that is only comparable to murder, although comparing the two is pointless. Rape is murder without death. It is hard to conceive of any justification to let convicted child-rapists ever walk the streets again.

@darckjo Technically, there is no worse crime between rape, molestation or murder. However, murder would be considered the worse by most people because unlike rape and molestation, the victim is dead and never has the chance to be a survivor. To me, they are all equally bad but I understand how others can see it differently. Then again, someone once said rape was "soul murder" so some would say that being raped and having to live after it is like living a Dead Life. It's all subjective.
@darckjo And then there's molestation which specifically includes children. Some would say that's worse because children are seen as so fragile and innocent and being abused/molested at such a young age (non-adult age) leaves a lasting, damaging impression on them, scarring them for life mentally, emotionally, psychologically and so on. But regardless, whether it be rape, molestation or murder, they're all obvious crimes against humanity, first and foremost. That's just my perspective.

In my opinion, raping a child is FAR worse than raping a grown person. The child is stripped of their innocence, has no abiltiy to fight back or find justice. I can't tell you how angered and enraged I become when I hear stories like yours.

Sexual abuse should be the last crime anyone can get away with, especially when it's against children... And yet it's one of the only crimes where the victim is blamed (or just outright ignored), rather than abuser. What's wrong with our society?

I always thought that molestation meant when someone touches/fondles another without consent, and penetration against one's will no matter what age was by law considered rape.
In our agency we referred to the fondling and exposing of ones genitals to a child "child sexual abuse." Any penetration, no matter how slight, is considered rape.
There's no statue of limitation for murder. They can hunt you down forever. But rape there's a time limit. Which never made sense to me. Especially when one is raped at such a young age.

The statue of limitations can be flexible -- as I said, my ex gf is -- the district attorney wants to convict this guy, and he said he would find a way to make it happen.
Actaully most young PEOPLE (5 & under), girls & boys, that are sexaully abused, are attacked by a female caretaker. If we want to get our arms around this issue, we 1st must starting dealing with truth and reality.

Who's idea was it to put a statute of limitations on either molestation or rape. Also why the hell did they not poll the limitation on the grounds that the victim was a minor. Stupid system, Lisa your brave for telling your story to all, I do hope some justice was brought to your attacker.

Are the statutory time limits for molestation and rape different? What are the penalties for each crime? It seems like you want your viewers to assume answers to these questions without actually citing them, which is an enormous red flag suggesting that they are in fact the same and the difference is merely semantic. Your outrage seems to come from not knowing the meaning of molestation, which is a red herring.
@HConstantine I shared a personal experience. It wasn't meant to be a treatise on the entirety of the law but a reflection of my experience 20+ years ago vs. the day I heard the news just a few days ago in the story linked in the description.

Though "marriageable age" is a cultural construct, where we here in the west have set it well after puberty, at the very least let the kids be kids, and allow them to grow up first.
I have no idea where the convention that age of 18 is the "magic age" came from, but I for one think it's appropriate.

And an important subject to broach, I think many are often ignorant about the way in which the ambiguous and elastic nature of language is used to dismiss or deny the reality of MANY situations and social problems etc. Many also falling completely prey to the psychological and/or linguistic trick that was just used to create bias in their decision making processes.

I think people often forget that much in our systems of law (through most of Europe, America, Canada and Australia etc.) regarding 'children's rights' are relatively new additions to the social construct. Children until recently, and in some aspects still are, regarded as property of their parents or the state. Not autonomous individuals.
Take for instance the whole debate around 'male cirmcumcision', often the question of what the child may want is not even considered, Just parents 'feelings'!
I might have been able to understand a difference in word, if it covered the topic properly (like say, a word was invented specifically to refer to the age group, but still had the same impact) but the way it was, no.
In Canada it's all under 'sexual assault'. I actually like that way of handling the terminology; assault is a serious crime no matter what the circumstances (I guess comparable to "attempted murder") sexual assault covers what it needs to.

When a child of 13 is coerced by an adult into sex, that is "rape." I was raped when I was 12 by a neighbor. It was the result of coersion rather than force. However, it is rape all the same. An adult has power (both physically and mentally) which a child does not have. Therefore it is rape.
@Hereticbooks i think the laws should differentiate in respect to these ages (with younger ages being punished more severely). 8 (the age of reason, the ability to know to tell someone), 14 (the age at which most people have passed puberty and have sexual drives), 16 (the age at which sex should be legal for all people), and 18 (in the case that 16 is not the age of consent). raping a 5 year old is more traumatic than raping a 9 year old which is more traumatic than raping a 15 year old, etc.
I agree with you to an extent. Naturally a 5 year old (pre-pubesent) would be more traumatised for a rape situation. It's not the same thing as a 14 year old girl with an 18 year old boy. Though the second situation is illegal, still the two are near the same age. Here in Montana, the law states that the age differential can be no more than 3 years, thus, an 18 year old cannot be prosecuted for having sex with a 15 year old.

i think there should be a difference in law with what happened to you at the age of 5 and what happens to a 15 year old girl who consents but is not able to legally consent to having sex with her 18 year old boyfriend. you were obviously raped, where as the 15 year old girl here did not suffer through what we traditionally like to think of as rape. she was statutorily raped and we don't allow her to consent to something that may harm her due to a poor decision on her part.

You see, a 12 or 13 year old (ages of puberty) a young girl is easily manipulated by a handsome adult male who is willing to pay attention to her, tell her she is beautiful, and be a listening ear when she talks about her misunderstandings with her parents. We call this grooming. He knows what he intends to do. She doesn't.
@Hereticbooks i think there is a big maturity difference between a 12 and 16 year old girl. that is why i think that if they are 14 or under the charge should be more severe than if they are 15 or 16. and i would not call a handsome adult paying attention to a 16 year old girl grooming. i always wonder why some states choose to protect teenagers from adults, when i believe they should be protected from other teenagers even more.
In Montana, 16 is the age of consent. And I wasn't talking about a 13 year old and a 16 year old. This too is legal here. But a 12 or 13 year old girl being pursued by a 31 year old IS grooming. That's what happened to me.
@Hereticbooks what happened to you is messed up. but i don't think it would be as traumatic as being raped at the age of 5. at 12 years old you were young and naive, you didn't realize that he was putting you in a bad situation. but once you realized that you were in a bad situation you knew well enough to tell your parents and to seek help. a younger child might not know to do that and should be more rigorously protected. the laws should be more severe against people who attack them.
There is a lot of shame associated with rape. I experienced a violent stranger rape when I was 16, and the last thing I wanted to do was contact my parents about it. Fortunately the police rescued me from the attack, and even though I was emancipated by the state, they insisted on taking me to my parents house. My mothers words were "How could YOU be so stupid?" You see now why rape is not reported very often.
@Hereticbooks i have no delusions that rape is not under reported and that child sex abuse is not under reported. i do think there are many cases of false rape allegations but that by no means cancels out the much much larger number of rapes that go on unreported. it is things like your mothers reaction and false rape allegations that belittle those who were raped, and it protects the rapists. society needs to look at these type of people with sickening disdain, so they don't do that.
It was one of the reasons I poured myself into my work at the victim's assistance agency. Believe me, I don't let it bother me anymore, but it does make me more empathetic when I hear that it's happened to others. My work with the "crisis line" helped me get to where I am today.
@Hereticbooks That's terrible, I'm sorry you had to go through that. There's something seriously, morally bankrupt about our culture when a victim is shamed instead of the attacker.
That's why the agency I worked for didn't pressure women and girls into reporting their rapes and abuses. This is why we were able to get more accurate statistics than the police precincts and such. Unless it's violent, it's very difficult to prove rape, in fact, even the viiolent ones are difficult to get a conviction on. It's figured that only one in 10 rapes are ever reported, and only one in 10 of those are ever prosecuted. You get the picture. Very few convictions occur.
@Hereticbooks continued. that is why i say that we should have different age brackets (and i think most states do anyway). being groomed at the age of 12 is significantly different then being groomed at 16, and thus the age of consent laws. but being groomed under age 8 is worse than being groomed at 12. being groomed vs being forcibly raped should also be taken into account. i think forced rape is more traumatic than trickery and deceit. it harms more it should be punished more.
@Hereticbooks what i am NOT saying is that the guy who groomed you shouldn't be punished. what i am saying is that there should be a scaling of punishment with those who cause the most harm serving the most severe sentences. if we punish them the same than it might promote attacking younger and more defenseless children as there is less of a chance of being caught. we don't want to do that.

Thank you for this video. I worked for a victims assistance agency (see my profile), and for a time I worked as the statistician. I gathered the statistics in our local area and sent them to the state level. One in three women will be "raped" before the age of 18. The biggest risk group for "rape" are girls and women between the ages of 11 & 19. The SECOND biggest risk group are children under 11. People don't realise this....(cont.)...

When you're under 18, consented sex is called "statutory rape" and non-consented is swept under the umbrella of "molestation". Perhaps that's why there's a distinction. When you're over 18, there is sexual assault, sexual harassment, and rape. I didn't know there's statute of limitations for criminal acts.

I always thought That if it is an adult that is considered rape. If with a underage child that is statutory rape. Molestation is just when your touched inappropriately, But rape is when someone has sex with you against your will. At least that is how I understood it.

@darckjo Technically, there is no worse crime between rape, molestation or murder. However, murder would be considered the worse by most people because unlike rape and molestation, the victim is dead and never has the chance to be a survivor. To me, they are all equally bad but I understand how others can see it differently. Then again, someone once said rape was "soul murder" so some would say that being raped and having to live after it is like living a Dead Life. It's all subjective.

Some would say that's worse because children are seen as so fragile and innocent and being abused/molested at such a young age (non-adult age) leaves a lasting, damaging impression on them, scarring them for life mentally, emotionally, psychologically and so on. But regardless, whether it be rape, molestation or murder, they're all obvious crimes against humanity, first and foremost. That's just my perspective.

In my opinion, raping a child is FAR worse than raping a grown person. The child is stripped of their innocence, has no abiltiy to fight back or find justice. I can't tell you how angered and enraged I become when I hear stories like yours.

I always thought that molesting a child was the lowest act a human could do. There was nothing more foul or horrifying because I always though that molestations was by definition the "rape" of a child. There's no statue of limitation for murder. They can hunt you down forever. But rape there's a time limit. Which never made sense to me. Especially when one is raped at such a young age.

I think people often forget that much in our systems of law (through most of Europe, America, Canada and Australia etc.) regarding 'children's rights' are relatively new additions to the social construct. Children until recently, and in some aspects still are, regarded as property of their parents or the state. Not autonomous individuals.
Take for instance the whole debate around 'male cirmcumcision', often the question of what the child may want is not even considered, Just parents 'feelings'!

In Canada it's all under 'sexual assault'. I actually like that way of handling the terminology; assault is a serious crime no matter what the circumstances (I guess comparable to "attempted murder") sexual assault covers what it needs to.

When a child of 13 is coerced by an adult into sex, that is "rape." I was raped when I was 12 by a neighbor. It was the result of coersion rather than force. However, it is rape all the same. An adult has power (both physically and mentally) which a child does not have. Therefore it is rape.

@Hereticbooks i think the laws should differentiate in respect to these ages (with younger ages being punished more severely). 8 (the age of reason, the ability to know to tell someone), 14 (the age at which most people have passed puberty and have sexual drives), 16 (the age at which sex should be legal for all people), and 18 (in the case that 16 is not the age of consent). raping a 5 year old is more traumatic than raping a 9 year old which is more traumatic than raping a 15 year old, etc.

I agree with you to an extent. Naturally a 5 year old (pre-pubesent) would be more traumatised for a rape situation. It's not the same thing as a 14 year old girl with an 18 year old boy. Though the second situation is illegal, still the two are near the same age. Here in Montana, the law states that the age differential can be no more than 3 years, thus, an 18 year old cannot be prosecuted for having sex with a 15 year old.

i think there should be a difference in law with what happened to you at the age of 5 and what happens to a 15 year old girl who consents but is not able to legally consent to having sex with her 18 year old boyfriend. you were obviously raped, where as the 15 year old girl here did not suffer through what we traditionally like to think of as rape. she was statutorily raped and we don't allow her to consent to something that may harm her due to a poor decision on her part.

There is a lot of shame associated with rape. I experienced a violent stranger rape when I was 16, and the last thing I wanted to do was contact my parents about it. Fortunately the police rescued me from the attack, and even though I was emancipated by the state, they insisted on taking me to my parents house. My mothers words were "How could YOU be so stupid?" You see now why rape is not reported very often.

@Hereticbooks i have no delusions that rape is not under reported and that child sex abuse is not under reported. i do think there are many cases of false rape allegations but that by no means cancels out the much much larger number of rapes that go on unreported. it is things like your mothers reaction and false rape allegations that belittle those who were raped, and it protects the rapists. society needs to look at these type of people with sickening disdain, so they don't do that.

That's why the agency I worked for didn't pressure women and girls into reporting their rapes and abuses. This is why we were able to get more accurate statistics than the police precincts and such. Unless it's violent, it's very difficult to prove rape, in fact, even the viiolent ones are difficult to get a conviction on. It's figured that only one in 10 rapes are ever reported, and only one in 10 of those are ever prosecuted. You get the picture. Very few convictions occur.

@Hereticbooks continued. that is why i say that we should have different age brackets (and i think most states do anyway). being groomed at the age of 12 is significantly different then being groomed at 16, and thus the age of consent laws. but being groomed under age 8 is worse than being groomed at 12. being groomed vs being forcibly raped should also be taken into account. i think forced rape is more traumatic than trickery and deceit. it harms more it should be punished more.

One needs only look up the word molest in the dictionary to see how outrageously inadequate it is to describe the rape of a child. Your overcoming of this horror is inspirational.

Thank you for this video. I worked for a victims assistance agency (see my profile), and for a time I worked as the statistician. I gathered the statistics in our local area and sent them to the state level. One in three women will be "raped" before the age of 18. The biggest risk group for "rape" are girls and women between the ages of 11 & 19. The SECOND biggest risk group are children under 11. People don't realise this....(cont.)...

Now that you point it out, it dose seem odd. However I wasn't aware that "child molestation" was considerd a lesser crime than rape. I actually thought it was considerd worse.

When you're under 18, consented sex is called "statutory rape" and non-consented is swept under the umbrella of "molestation". Perhaps that's why there's a distinction. When you're over 18, there is sexual assault, sexual harassment, and rape. I didn't know there's statute of limitations for criminal acts.

Wow. This sucks bad. I particularly understand how INFURIATING it must have been to be "corrected" in describing what was done. I can imagine that being, in a way, WORSE than the actual act.
Have you ever considered a civil suit against the rapist? SOME sort of retribution is only FAIR and RIGHT. That person needs to be punished by YOU--although I would never fault you for just letting it go it if that's what you truly want.

@GetMeThere1 the person correcting her wasn't denying what happened, just saying that that's how the term is used either legally or culturally. As she said, "molest" in many languages, and even in English, literally means disturb, annoy, rather than assault or rape. Calling something something else never changes the facts.

Maybe your problem is a lack of imagination, in failing to comprehend how being told you were not "raped" would be, at least, frustrating.

I'm not going to pretend to understand something I don't, but I don't doubt it can bother people. Being bothered by words is not the same as accusing a person of correcting how something is described, which is essentially saying they were denying facts or denying your credibility.

In any case, LJonYT is ABSOLUTELY CORRECT that rape is rape, that there is no sensible REASON in "correcting" someone who says they were raped, and that likely, there IS some bullshit reason in withholding the term "rape" in such cases.

I have always wondered why people who rape children are referred to as "molesters" in the states, it's such a vague and nebulous term. Why water it down like that? Just call it like it is.

@wounduppenguin it IS vague, and it's making no distinction between people who only touch, or actually use their genitals. I'm not sure why all "molestors" get the same name when the varying degrees of crime make a big difference.
Similarly "sex offender" is vague too.

I always thought That if it is an adult that is considered rape. If with a underage child that is statutory rape. Molestation is just when your touched inappropriately, But rape is when someone has sex with you against your will. At least that is how I understood it.
