I believe France make allowances for crimes of passion. Coming home from work and finding your wife in bed with your best friend and killing him is considered to be a lesser crime than killing him because he was taking the piss out of you.
Which is think is fair. People in that position have had the balance of their mind's temporarily disturbed, might only be for the first 10 minutes that someone is really irrational...

But there's more to murder as a necessary component than what is on offer in your comment, and it's entirely possible to commit murder but be legally excused from the crime.
