Actually watch the tackle, O'Driscoll actually jumps up and over the guy, the guy doesn't lift at all until he well over his shoulder and in the air, the only reason the guy does lift is so he can try put O'Driscoll down safely. I would say this was more O'Driscoll trying for a penalty than any wrong doing by the defender
