If the the hypothetical father were not the sperm donor and some other guy was, then the father would have no genetic ties to the kid and the mother could very well have legal recourse of custody since the child would not have as familial a bond with the hubby, except if he was the biological father. In other words, in vitro is invitro, no matter how you slice it. Whether gay or straight, the only person who has legal rights to the child is the one who gave birth.
