In the next Elder Scrolls game, they should import multiple versions of what each NPC says. For example a Bartender will say "Drink for the Thirsty, Food for Hungry" however when he says it again, he says it in a different pitch or tone. This can make the game more realistic.

I think that they should be downed, and when you attack them and they're downed, a warning should pop up. If you choose kill it will fail the quest but kill the target.

I'm not that fussed about killing children in particular, but I wish Skyrim would let you just kill anyone instead of making so many side quest characters invincible.

The game could let us kill the characters, but just give us a message like "x quest failed" or "y quest no longer accessible". Or at least put them in a coma and revive them in a day or two, rather than have them keep getting up and attacking you.
