  • Outcome - a traffic stop on February 24, 2009, where the dashboard video showed two police officers using their tasers on Cadillac Derrick shortly after not answering a question about stepping out of the vehicle. Police Internal Affairs found the officers acted appropriately, but the lawsuit which was subsequently filed on Mr. Derrick's behalf was settled for $50,000. Mr. Derrick was initially charged with resisting arrest, but this charge was dropped shortly after the lawsuit.

  • let's just say that I know a lot about laws... and based on what I just watched, a police department is about to pay a heavy fine... ^_^

  • They tased him because he had that white girl in the car. Fuckin pigs.

  • As I understand it, the original stop was for no front license plate, correct? So perhaps when the cop said he had "no license", he wasn't referring to the driver's license but the license PLATE? Then, by refusing to get out of the car, the driver immediately makes the cops suspicious...as they try to extricate him from the car, he starts to resist. Certainly seems like a justifiable tasering to me....cops have been killed before for NOT acting fast enough.

  • That cop opened his door and jerked his ass out of the car. He was also tasered INSIDE the car. These cops broke the law plain as day. If you think these police did the right thing, you need to get the fuck out of my country.

  • People, do NOT take advice from MetalHeadKLR650. This guy was given a lawful order and resisted. The cop probably went to his taser too soon but they could have used their fists to break his nose or bones. I guess that would have been less excessive than using a non-lethal, 5 second dose of pain somehow. People complaining about tasers should consider the other options before crying police brutality. So 1) Getting tased is not that bad; 2) Just do what the cops tell you, even if they're wrong.

  • @Liquid827 You are obviously a cop. The idea that you should do what someone else tells you even when they are wrong is straight up evil. See: Milgram Experiment

According to you tasers aren't bad, because the alternative could be death.... it's beyond stupid.

  • @Liquid827 1) Getting tased is not that bad; 2) Just do what the cops tell you, even if they're wrong.

congrats, this is the dumbest thing I have ever read on YouTube, and thats saying a lot. You actually have a social obligation to disobey unconstitutional orders and not be a coward. The cop in this video is a bully and a coward, he has no place in LE.

  • Why a 5 minute video for 23 seconds? I'm a busy man.

  • 98 is correct. Metalhead, it's spelled manner. It depends on what state you're in but in most states, during a traffic stop, if you're asked to produce a license, you have to. That's the law. When you sign your name on your license, this is what you consent to. It is only then as a courtesy that the Officer give you the reason for the stop. Some agencies recommend an introduction from the Officer as to his name , agency then reason for stop before asking, but this is not mandatory.

  • fucking scumbags

  • I.D. is not a drivers lic dumb fuck and yes you will strp out of the car and get fucked up nigger

  • Screaming like a 6 year old girl with a bug in her hair.

  • Yes they can ask, but judging by the officers behavior it was not a lawful order but an attempt to extract the driver in an aggressive manor. If you feel you are under any type of threat even from a police officer you can refuse an order. People don't understand, you have the right not to be assaulted by anyone including cops. The guy won 50g's, so the cops were wrong. Innocent until proven guilty, cops know they can't be overly aggressive, and they learned that terrible lesson in 2011.

  • wtf and you say to us german people we're violent?

  • It appears to me that these cops were looking for an excuse to light him up. The first pull over it appears they tell him to pull off the road. Then they come up to the car, but unless he had produced a weapon, why did they violently go after him?

If as you say they had his license and asked why he didn't have one, that is a plain effort to falsify evidence.

My gut feeling - he was jacked up for having a white girl in the car with him.

  • He got 50k for this shit stltoday(dot)com

  • Prolly the same thugs that were involved in shooting the dog in front of the wife and child in a raid that yielded a half-smoked bowl of weed.

  • Post from Kansas City Star on Monday 1/16

Columbia man wins $50,000 in police Taser lawsuit

  • I live in columbiia and this is how most black people are treated when we are pulled over. You wouldnt know this if you dont live here. we are targeted and harrased on a daily basis. Welcome to Columbia,MO. LOL

  • fuck the police I only hope these pigs are treated the same way in the future. guilty until proven innocent and I hope they suffer on their death bed for years to come.

  • And just because we have a black president does NOT mean there aren't racist pricks in America. Racist, narrow-minded, judgmental people are everywhere. I'm a white female who lives in Columbia, Missouri, and I'm ashamed to say I encounter them frequently.

  • @justthefacts0711 .. this comment is coming from Ga. Krakka..

as soon as I saw the white girl jump out of the car, I knew what this was about.. there are 4 possibilities..

    1-they didn't like black guy/white girl

    2-cop-1 liked white girl

    3-cop-2 liked white girl

4-both cops knew some one who knew white girl, & wanted that relationship to stop..

theres no other reason to pull him out of the car that quickly & the treatment of him thereafter..

And I'll bet ya they broke up..

  • He was awarded $50,000 in court. Excerpt from today's Columbia Daily Tribune article: "the officers appeared disappointed when no weapon or marijuana was found in the vehicle." & "Criminal charges filed against Derrick for resisting arrest were dismissed just before Trapp (the attorney) filed the lawsuit in July 2010." SO, maybe you think he should have gotten out of the car when told, but failing to do so obviously doesn't mean he was resisting arrest OR deserved to have a Taser used on him.

  • @gnossticc We HAD problems with racism. It isn't something that keeps people back now. We have a black president. I mean he sucks, but we still have a black president. I never claimed the US didn't have problems. My comment was that you have no room to comment on American police. Police everywhere suck. The fact is that this guy was an idiot for not listening to the cop.

  • @gnossticc I haven't read much about the Guatemalan Civil War, but I can tell you that if the CIA was involved it was probably about anti-communism. If you want to have a discussion on mistaken involvements about the CIA then why don't we discuss all of Latin America? Hell why don't we just go back to Theodore Roosevelt and the Roosevelt Corrolary? Or maybe back to the Monroe Doctrine?

  • Good Cop - Dead Cop

  • @SweetJaneofGoth THE BEST KIND

  • @gnossticc I picked up on a strong anti-American vibe from you so I went with it. And if you are saying you are from Guatemala then you have no buisness talking about American education. Does any Latin American nation? I have actually hand drawn maps of Latin America (rough estimations were fine because it wasn't an art class) and then label the nations. I will say that I don't have a problem with those places, but that you better know your damn place when you bitch about OUR police.

  • @gnossticc I can, but I think my name should speak for itself(given that I said University and gave you an easily researched statistic). I merely observed the irony of a statement of lack of education, and the typo(I hope that is what it was) of a common easily spelled word.

    que quieres que yo diga?

My spanish isn't great. I plan on learning more. I was simply trying to draw out if you were English as a second learner. Are you from Venezuela then?

  • @gnossticc It is classic. I hear it all the time. You spelled thug wrong. Btw I have studied latin american history from University with the 6th largest latin American library in the nation. You tell me. We could have a lovely discussion if you weren't a dick.

And blah blah. I know you are only saying you hate America because you secretly love the place and want to be here. Btw what computer are you using?

  • @gnossticc Classic comment from a non-American. Is there like a book that all you retards get and parrot from? You all say the exact same things. There is ONE other part of North America that isn't a shithole and that is Canada. Every other nation sucks. And Canada pushes it anyway. You still haven't told me where you are from. Scared to admit it right? All I gotta say is you only hate the US cause you wanna be an American. It is kinda like hating the yankees. Same concept.

  • @gnossticc LMAO! So your country isn't industrialized and you are trying to treat America as lesser? That is classic. You are pathetic. Btw I know you love America, or at least the perks you get from living here as opposed to whatever hell hole you came from.

  • @gnossticc Really? At what point did I say that I had any attachment to "american cops" you pretentious douche? I said that you should do what the fuckin cop says and if you don't you are a dumbass. Rule Number 1 of confrontation is don't fuck with the police. You can get away with a lot of bullshit on a lot of people, but it doesn't work that way for the cops.

BTW with that comment I wonder what shithole you live in. I am going to look it up so I can laugh.

  • The cop told him to exit the vehicle, he said give me my id back, that becomes resisting arrest right away, was it excessively fast maybe another 20 seconds of him refusing to get out of the car, but there is nothing wrong with them tasing him at all.....cop :"can you step out of the car", guy in car condosendingly " can you give me my id back", boom taser, they were right to do so......

  • Would someone explain what happened to the cops after this obvious crime they commited?

  • These cops are disgusting animals and should be imprisoned for life. They are a danger to society and should never have guns.

  • I had a cop pull me over once for not dimming my head lights, when I argued with him he told me to get out. I am a law abiding citizen and felt that the only reason he told me to get out was to intimidate me. He yelled at me and when my elderly mother objected he yelled at her. I had had enough and told him to just write the damn ticket because I knew I was right(he was parked on side of road on other side of 4 lane highway when I passed him). He dropped the ticket.

  • The sheriff where I live is a good guy and would never do anything like this, the odd thing is that he let's his deputies get away with it. My thought is you should treat people like you would want them to treat your kids. I bet if some cop did this to this officers son he would be outraged. As far as getting out of the car I probably would have since they were in a crowded place.

  • Niggers....

  • Funny

  • Mayabe he should have stepped out of the car when he was ordered to? Looks justified to me.

  • That boy got what he deserved.

  • The police were justified. I bet that you lose your suit you ambulance chaser.

  • Police brutality!

  • teach the spook a lesson.

  • that policeman has a nice butt...jus sayin.

  • electrocute his ass

  • Listen to all the sheeple, unless you are under arrest or you have given consent to search your vehicle you don't have to step out. Plus you don't get a taser out unless you are in danger or cannot physically restrain someone. This is abuse plain and simple.

  • @MetalHeadKLR650 You're completely wrong on both counts. The Supreme Court would disagree with you on when an officer can make you get out of the car, and Tasers can be brought out in more situations than that.

  • @MetalHeadKLR650 Incorrect..... Police can ask you and/or your passengers to step out of the vehicle at any time during a traffic stop... Look it up. Also, the police don't need consent to search a vehicle if they smell Marijuana. Maybe a little research would be beneficial to you before you start making posts like that.

  • Your commentary is completely false. He asked him to get out of the car, he said, "im not going to step out of the car". It's over after that. Whatever he gets is of his own choosing. Ignorance at its peak.

  • @samtrapp1 Could you provide me with the disposition from the criminal case? I'd be interested to see how that turned out? While I have your ear, could you tell me how long it takes to pull out a handgun and squeeze the trigger? I'll bet it's a lot less than 23 seconds.

  • The lady ran in there to get a job, because she saw the 'Now Hiring' sign

  • now THESE are Fucking PIGS!!! This is why the title "police officer" is being degraded to nothing but a bully due to assholes like this.

  • ALL the bitching and moaning aside I still blame the jackass in the car. When the cop says, "step out of the vehicle." What the fuck do you think you should do? Darwin dictated that he deserved to get tased because he didn't do as told. Just ASSUME the guy is a dick and be compliant. If you are within the law then take it to damn court. Being a dumbass is what gets you tased. I have dealt with cops plenty(and been thrown out of places) and never once been tased. Why? I COMPLY!

  • @gat0rbball Thank U ! Some people think they don't have 2 listen 2 officers. Let them do their job, do what they say & if didn't do a thing, they'll let U go. When U argue with them & make their job harder, U WILL pay the consequences...

  • I wanted to see him get tased! Run from the law and you get what you deserve! If you don't like that then in the words of Jim Carey, "STOP BREAKING THE LAW ASSHOLE!" You maggots need to stop blaming everyone else for your problems and bad behavior and just grow up!

  • his balls must have turned into popcorn!

  • his ball must have turned into popcorn!

  • He was asked to step out of the car, he responded: "I'm not gonna step out of the car!" What is it you stupid negative posters miss about this action? It's only obvious that the officers had enough time to learn his license was invalid. This idiot was an imbalanced loser and proved it. I'm sure this all went down not in his favor. And that makes me smile. :)

  • @Ghstwn Wrong. He is not required to step out of the car if he is not in police custody and his rights have not been read. This my friend is your typical pig encounter. He was upset that black dude is poking white girl. Could have been any number of other things also. Like maybe hes upset that his wife left for a back guy. I could go on and on guessing why but I dont know honestly. Dont get me wrong I like cops but at least 10% of them or more must be corrupt depending on the area.

  • @Travos69 Pig Encounter,... that tells me enough about you already. Please,.. Go on. Tell us all how it is. K?

We obviously need your input and perspective to see the light. Yawn,... Ok, enough humor for tonight. LOL!

  • @Ghstwn Maybe u have no idea what a pig is. Picture your mother getting pulled over. How would you expect the police officer to act towards her? Just like u see in the video? Would you think the officer was abusing power? Thats what a pig is then huh? Hope I did help u see the light. If not then u must be too hard headed and lack common since. Good luck.

  • This video shows nothing.

  • Light em up

  • You want to see the BEST Taser Video on Youtube? Check out: "Ninja Steve Get's Tased"

  • The obvious solution is for blacks to SEPARATE from whites, or rather, for whites who simply don't want to live around other races (why would we?) to be ALLOWED to separate from other races. Then all the 'racist' whites would LEAVE, would they not, and go and live in the 'white' part of the country.

What a crazy idea! Freedom of assocation? We can't have that. Not if you're a prisoner, or in a giant concentration camp.

  • The officer had Probable cause to search the vehicle bc of the smell of Marijuana, Which allows the officer to ask the suspect out of the vehicle to search. the Suspect refuses and he went hands of first and there was a brief struggle in the vehicle which according to the use of force continuum he deployed the taser. The offender evaded and continued to resisted arrest. The first arrest If he had a warrant out and the court didnt take it out of the system thats there fault not the police.

  • Comment removed

  • First of all i dont see an issue with this video. I hate lawyers putting shit in other peoples heads and make the police look like shit bc they want to make a couple bucks. All he had to do was comply. They had probable cause to pull him over bc of the no front license plate. Then when the officer gets to the vehicle he smells an odor of burnt Marijuana. It doesnt matter if the other officer can smell it maybe hes a rookie and doesnt have the experience or maybe he had a stuffy nose :P. BUT

  • once they they told him to step out and he refused they i didn't give a shit about him or whatever happened to him after, he deserved it.

  • lmaooo me & my kind. Come @ me girlfriend with some crap about what I think about what & I won't B pulling out my taser 2 put U down. U have your opinion & I have mine. U weren't there. U can't C what the officers saw. Unless I C something different that shows that the officer did it 4 no reason, I'm behind the officer 100%...

  • Whatever if the cops were wrong or not, how about not resisting arrest?

    Only guilty people run.

  • If he had marijuana i can understand the officers reaction, marijuana is a product that is untaxed. With the current debt problem in the USA this torture could be made mandatory just for about everyone earning under 250.000 dollar a year. These officers deserve a nobel peaceprice just like their big boss.

  • they didn't beat him after? wtf is wrong with this state?! lol

  • dude should've complied... officer 2 (right side) most likely deployed 'accidentally'... not to say that makes it's ok... the non-compliance of the driver hadn't gone that far yet... I dont' believe they tazed this one, so early, on purpose

all said... I hope the driver gort PAID!

  • Love it when they scream like little girls wit a bug in their hair.

  • "No I ain gonna step out of the car...you wanna gibbmee my ID back"?

Screams follow........sadly the silverback is probably too stupid to learn a lesson from this.

  • OMG I love hearing niggers scream!!!!!!! I love it even more watching that stupid white coal burner freak out. Get used to it cunt, no white man will ever want you after you've fucked that...THING.

  • I was not under arrest and I was on my own property and U say take it to court.....U funny dude cuz the judge didn't even care that I was disabled. The da said they can't believe my disabled wife because she would lie for me. Okay how about the fact that there was a DVD and the cop listened to a 11 yr old girl who should NEVER been left home alone all night long while daddy worked with the babysitter in another town. She was 15 vwhen he decided he like her. In Illinois that is a child molest

  • thing is you dont have to get out of the car, if it was because of a front license plate there is no reason he would have to get out of the car, the police had no right to make him get out, they did not warn him he was going to be tased, they did not warn him of anything and they put the female in dange because she was in the line of fire, bottom line they will get either fired or suspended withought pay and the guy they tased will get a big settlement check, police fucked up,

  • I don't care what police encounter, they are trained to enforce the law, not to break it. The police are required to call out Yasser,Taser,Taser, to avoide the use of it, to warn of deployment so the individual in question may comply through fear tactics. Then if no choice, deployment may be made. This video is complete injustice against an American citizen. These people are civil servents not Gods. If they told you to bow to them would you???

  • @disposablefreedom I'd bow if I had 50,000 volts coming my way.

  • @disposablefreedom

they announce also to let the other cops know that they are shooting a taser and not a firearm so it doesn't turn into a free-fire zone.

  • @disposablefreedom The police yell taser not to avoid using it on the offender but to avoid other officers pulling out there guns (pistols) and using them. There not "required" to. OTHER than maybe a departmental policy.

  • @cocurtis0664 The department policy is what I was reffering too... I just think it's rediculous that officers jump the gun "No pun intended"..lol.. and instantly apply guilt b4 they even know what's going on...Cops are turning into criminals these days."<-----My opinion of course..

  • What a dumbass. They will tell U Y they pulled U over when ready. Just give them your license, registration & proof of insurance. They wanna feel safe & make sure U R not a criminal whose gonna pull out a weapon or something. They asked 4 U 2 get out of the vehicle. Thats it. Did U do something wrong? No, so do what they ask, let them do their job & they will let U go. Give them a reason 2 open a can of whoop ass on U & they will. Incredible how dense people R in this world...

  • @RalphyDee Let's face it .. the cop was being a douche! Even if the guy said he's not getting out the car.. he has the right to say it. and the officer has the right to warn the man he's going to be tassered, if he doesn't comply. But wait the officer never did.... Asshole Cop: 0 Non compliant victim:1

  • @NekkiDo1 @ 2:17 The officer leaned over as if he picked up a scent in the car & motioned 2 his partner 2 lean in & take a wiff. Thats probable cause. Then, 4 the officer's safety, they asked him 2 step out of the car. He did not comply & asked 4 his license back. Once U R pulled over, the officers R in control. All they asked wa 4 him 2 step out of the car & he declined. That takes it 2 the next level where officers might have 2 use force 2 subdue the would B perpetrator. They did so...

  • @RalphyDee yeah you keep telling yourself that there is a good reason to do this...ever. when things change, and they will, you and your kind will be remembered

  • @fenianskean Hmmm, looks like some1 has been tasered in the past & is now hatin' on cops 4 his funny walk since the event. Me & my kind will B perfectly fine. Y U ask? Because its better tasing some1 than putting a bullet in their skull. Trust me Fenian. U got off easy. U might wanna have a doctor check out that funny walk U have... lol

  • @RalphyDee I've only been tasered in training to utilize the system. I don't remember what I was all pumped up about when responding to this, but, what usually gets me fired up is seeing someone taking a non-reasonable approach to get a jolt of adrenalin and feel like a bad-ass for a few seconds. Read the comments, you'll see many people that should not be in or around LE, as it appears they are in it for the wrong reasons. I would hurt your feelings but I don't think you'd get it.

  • @RalphyDee I see now. A black guy with a white girl, I see now why you approve of this type of "professionalism" Wink-Wink, we know what you are about. Your time is passing. There is a new day dawning and it won't have room for people like you, unless you commit yourself to treating people with decency, moderation and respect.. But don't worry about it, age, experience, love, and time will bring it to you, whether you want it or not. Best-o-luck Brother, and stay safe.

  • @NekkiDo1 Your right he can say that but.The officer had Probable cause to take him out of the vehicle to be searched bc he smelled an odor of marijuana. The officer DOES NOT have to tell him he going to tase him. the reason police yell taser 3 times is to warn other officers not to pull a gun.The way i saw it the officer tried to use his hands there was a brief struggle in the car which allows the police according to the use of force continuum to deploy the taser. All he had to do was comply.

  • I keep coming back. The fool shreeking is awesome. Watch this video once a day. Kinda like a morale booster. Thank you for posting.

  • DUMB NIGGER DIDN'T GET OUTA THE CAR WHEN INSTRUCTED TO!!!

  • What if the driver only handed the officer an ID and not a license? He certainly doesn't help his case by first refusing to obey the officers, and then fleeing and evading. Should the officers have waited until the driver decided he was going to use his car to try to flee, thereby putting the officers lives in danger? You seem to forget that while we have the right to question, they have the right not to answer.

  • Next time, Step out the fkn car dummy!!!!!

  • Excellent video. Made my day. Wish all of it was caught on camera. Good to see the government can still force compliance from the purposely non-compliant.

  • Its called having a suspended license that he never turned in. Some attorney you are.

  • @sbubball20 How could he have had a suspended licence if he had no prior charges???

  • @Shoeboxxxx, Good grief. Real professionals are not afraid of be recorded, Just because of a traffic stop and this guy deserved that. Give me a break with all of that what if type stuff. Read up on right to travel supreme court decisions, most traffic stops are not lawful. The police are basically way out of their jurisdiction, They do not understand the Constitution that they take an oath to uphold. So There!!!!!!

  • All the charges against the guy were dropped, and he got a warning on the license plate. Nothing of an incriminating nature was found in his car, and he'd just been wrongfully arrested 3 weeks before by the same cops. Therefore, I can understand his reluctance to step out of the car. There was also a 3 year old child in the car who wasn't restrained in a child seat (only ticket given), he was on the mothers lap, which means the officer fired the taser very close to the child. He will get paid.

  • Hummmm. A black guy with a white girl, stopped by two white cops. Any ?'s

Always lock your car doors and only roll down your windows about 2 inches, just enough to talk to them, also tell them that you need to see their supervisor. Also never pull up to a building where you do not have an out. Also have a audio recorder or video recorder on you at all times.

  • @akmrmike

What you just described just adds to an officers suspicions. You should not have to fear the police, nor should they have to fear you. The actions taken by these two officers is sure wrong, and they deserved to be sued. But the behavior you have described does not help out. Imagine you are a cop and you are always concerned about your safety and come in contact with a car where the driver seems to have something to hide? What would you do?

  • @akmrmike Ask to see their supervisor? rofl good luck with that one.

  • Well friend, you some arguments, would they work IDK. do you know the the outcome of this case? Was he convicted, what about a civil suit. Heres an interesting case on failre to exit a car upon a lawful order but its DUI related, People v Synnottt (Illinois). The police then forced him out. If the police smelled cannabis then that warrants further investigation even DUI related. Lastly if he was suspended then he could be arrested in some states. No DL is usually a ticket.

  • @RANDY64612 good night.

  • it shows what kind of lawyer you are by pleading you and your clients case on youtube. you will not win but being the type of litigater you are you probably believe every lie out of your clients mouth. your whats wrong with the system.

  • Kid should have gotten out. Police asked...he didnt comply...looked like the cop was in danger.,. necessary force was used...what an idiot.

  • his fault . when asked to step out he didnt and got what he deserved

  • Their is no way in 23 seconds the situation escalated far enough to warrant the usage of the taser. If you read any departments procedures for use of force you will rread that their is step by step usage of force of escalation. Officers still carry mace / pepper spray because it is still a viable use of nonlethal force. I have filed a FOIA to obtain the report and records concerning this incident for further review in class.

  • Pempskate, and aaronpb2004, wow your dumb. to todays date 52 officer have been killed in the line of duty just this year. car extractions alone are extremely high risk for serious injuries. Once again we have people questioning the validity of an officer's actions. How about this, display your license plate properly, do what the officer tells you, abide by his LAWFUL request, stop resisting and don't try running from the cops. MAYBE you won't get tased.

  • @newmanfied you're an idiot too.

  • Pempskate, and aaronpb2004, wow your dumb. to todays date 52 officer have been killed in the line of duty just this year. car extractions alone are extremely high risk for serious injuries. Once again we have people questioning the validity of an officer's actions. • I'm a Criminal Justice student soon to graduate and this video was shown shown and discussed in length in class. We all agree the officer did not follow the procedure of giving fair warning of force going to be used if the offender did not cooperate. Mace could have just as easily been used. Yes the offender did not cooperate but that does not give the officer the immediate right to use a higher level of force without fair warning. Plain and simple.

  • Do you know the departments procedure and policy on the use of taser and mace? Did you read the officer's report? I haven't seen mace used in over twenty years on a police department, most use pepper spray. So why are you talking about a use of force that is outdated with the use of mace in class? In some circumstances warnings of use of force are not used due to the situation. Judging without the above information by inexperienced students is an improper way to learn with no benefit

  • @RANDY64612 you're an idiot.

  • @donmc1970 Wow, please tell that to a cop sometime when orders you out. Then you can win a free trip to jail. Its called obstructing an officer and yes we can order you out and in the car. Your so stupid.

  • @RANDY64612 well Randy i have told that to the police and the supervisor backed me up. Why? there was no cause and without cause there is no obstruction. We can't order people out of cars with no cause and we sure as hell can't open the door before they have a chance to comply, that's assault. We're armed and they aren't. In this case it's agg assault b/c on top off the flimsy " cause", they put their hands on him and backed up the threat he was worried about, an unannounced tazing and battery.

  • @donmc1970 What wussy supervisor with no knowledge of the law. You can be order back in the car and out a car during investigative contact from an officer. Supreme court ruled this. You do not have the right to refuse. It's a car not a house. Now stop talking like your a douchebag then try to pass yourself off as a cop using "we". This is not assault because you can not make the judgement because you did not read the officer's report. The situation determines if you annouce before tase

  • @RANDY64612 well call him a wussy if you want, but the truth is the truth, and you've got to have reasonable suspicion/cause. And I can use we. Furthermore, fear of bodily harm is a perfectly good reason, a perfectly acceptable reason, I'm sure being the fine police officer you've alluded, to you've done your investigation and know that the same two officers the tazed man in the video are being sued for assault and had weeks previously arrested him incorrectly for a warrant on someone else?

  • @donmc1970 Pennsylvania v. Mimms, 434 U.S. 106), to has also been expanded to passengers of a vehicle due to the danger a traffic stop is to an officer, its an automatic no suspicion need.

  • @RANDY64612 mimms is an easy pick, surely, but it doesn't mean they can order you into a situation you feel is unsafe.

Again, assuming you've done your research you know these officers had already arrested him with no justification just weeks prior. It seems to me you'll go to any length to justify the actions in this video, particularly excluding the driver's clear compliance just minutes prior. Mimms requires that officers are acting lawfully.

  • @donmc1970 Really the lack of trust of police defense doesn't work. Society as a whole determines otherwise. Plus the fact your in front of a business in daylight with a passenger, it would never fly. Officer safety over rides as stated in court "at most, a mere inconvenience, cannot prevail when balanced against legitimate concerns for the officer's safety." Also he was stopped for a traffic offense therefore legally detained.

  • @RANDY64612 well, that may be true you're mentioning of general mistrust (which is admittedly no excuse), but considering the previous unlawful arrest combined with the officers simultaneous "request" while opening the car door prior to the drivers supposed "failure to comply" it looks less than an order and more like an assault. And that's the issue. An officer cannot order a person into harm. mimms is also based on an evidence surpression request by the defendant.

  • @donmc1970 Look police can order someone out simple. As for this taser incident, I want more facts before I judge these cops. You don't know where the driver was reaching for or doing. As for me defending these guys you seem the oppsite to condemn them. Either way I say let the court decide.

  • @RANDY64612 they can, provided it's lawful. in my case it was not, and in this video case it isn't either. Police cannot give this order while trying to enter the car. this video shows him opening the door simultaneous with the order, it;s aggressive and unwarranted, and frankly, it's not even safe-for anyone and expecting someone to get out of a car in that situation is unreasonable. he has to be given time to comply, he wasn;t. mimms upholds the order to exit, not officer entry.

  • @donmc1970 I don't mind discussing the law. I do my best to make sure I know what I am doing legally. I surf youtube when I am bored to study situations and prepare for difficult people on the street. I also prepare so I don't get sued for doing something stupid. But its time for me to go to sleep. Night

  • @donmc1970

Thank you, donmc1970, for trying to bring some common sense and sanity to the discussion.

Some people just can't be reasoned with.

It appears the Barney Fife's have bound and gagged the Andy's and are enjoying using their "toys".

Nothing they do is ever wrong, and there is little to no accountability for their actions.

We-- the people they are supposed to protect, are sneered at.

I fear for all of us...and our animals.

I'm hoping Andy gets loose and rescues us from Barney...

  • i would have no problem shooting most of those abusive pigs right in the godamn forhead. guy asks for his id back so he tazes him? bullshit

  • Why is this even an issue. If I ask you to get out of the car do it. Does everyone fail to see the communication between the officers before asking the driver to exit? Who knows what that was? Anyone? Was he a know drug dealer to the officers? Known by the officers to carry firearms? Just being too nervous and made the officers think something? Instead of complying he demands his ID not driver's license ID back so he can leave. Remeber this people it is mid April 2011 and there almost 50

  • And another post shows a 14 year old girl scarred for life with a tazer prong in her brain. She tried to run away from a Police officer who felt so threatened he had to taze her. I suppose pre tazer, after her Mother had called the Police to tell them her daughter was out of control, they would have just shot the child dead for refusing to comply with instructions? Land of the free? Pffft! What is scary is you guys LIKE THIS!

  • I wonder how many read the opening posters comments before commenting. He is an intelligent and educated man. The Tazer should not about getting compliance, the Police officer is not the Law and he has no right to give out summary punishment.

This is Police abuse of a tool that was meant to be an alternative to lethal force. Pre-tazer, drivers were not shot dead for not complying with an officers ego.

  • An attorney is going to use this video and our comments in his pursuit of an agenda against tasers? Looking over the comments, I'd guess his plan isn't working out too well.

  • Looks like he got what he deserved. KIDS THESE DAYS HAVE NO RESPECT OR REGARD FOR ANYTHING BUT ARE SHOCKED WHEN THEIR ACTIONS HAVE CONSEQUENCES. TIME TO GROW UP SON. BET HE STILL LIVES WITH HIS MOMMY TOO!

  • COPS SHOULD BE SHOT MORE OFTEN !!!

  • 23 seconds is plenty of time. It take only a second for things to go bad and a split second for an officer to react and make their life and death decision. Stay off alcohol. Stay off drugs. Think straight. And no one will hold you accountable for anything. Too late for some unfortunately.

  • Are we really supposed to have sympathy for this guy after he is completely uncooperative and resisting? It seems like many other youtubers would concur, judging by their comments.

  • hmmm...lessoned learned, he screams like a little girl geez.... like a sick wolverine... be a big boy

  • She ran inside to call the police!

  • No, I'm not going to step out...and you wonder why he's tazed...

  • I bet he gets out next time. ;)

  • That girl must have needed a job bad. As soon as she saw the "Now Hiring" banner she went running in to apply. I hope she got the job.

  • Not having a license = valid reason to exit the vehicle

Police telling you to get out = valid reason to exit the vehicle

    REFUSING TO LISTEN = TASER!!!

  • Here is a little more:

"Giger and Logan [the cops here] had mistakenly arrested Derrick [the driver] several weeks earlier, so Derrick stopped in a shopping center parking lot near the intersection of Park Avenue and Providence Road instead of at a "secluded area" where the officers had told him to park."

Good move, or he might be dead.

  • I have the feeling thatthe fact that a white girl was in the car with him didn't help much either.

  • @timmanntisyim Anybody that has to use the word "fuck" to get their point or opinion across has already lost the argument. Congratulations on yet again, failing in life.

  • These are the kind of cops that need to be publicly hung by the neck until dead! Oohhh! Don't forget to taser them for 45 sec straight before dropping the gallows door... Honestly we as Americans need to stand up & take charge of the criminal behavior of our police dept's nationwide! We need to screen these cops for mental illness, one parent families, physiological stability, were they bullied as children/adults, ect, ect. Something must be done immediately before it goes too far.

  • "Step out of the car" means step the fuck out of the God damned car NOW mooncricket.

  • "Cadilac has no prior record except a high school altercation with another student?"

Maybe that is the root of it.

  • When someone is actually convinced that THEIR way is right and all other logic and common sense is wrong, then THEY are the ones who are brain washed. Just because you have rights does not entitle you to have disregard for the law. Like I said, if the law isn't doing THEIR job, then TAKE IT TO COURT! Get a clue joycloud....seriously.

  • Yes, lets just give up all our
