Outcome - a traffic stop on February 24, 2009, where the dashboard video showed two police officers using their tasers on Cadillac Derrick shortly after not answering a question about stepping out of the vehicle. Police Internal Affairs found the officers acted appropriately, but the lawsuit which was subsequently filed on Mr. Derrick's behalf was settled for $50,000. Mr. Derrick was initially charged with resisting arrest, but this charge was dropped shortly after the lawsuit.
As I understand it, the original stop was for no front license plate, correct? So perhaps when the cop said he had "no license", he wasn't referring to the driver's license but the license PLATE? Then, by refusing to get out of the car, the driver immediately makes the cops suspicious...as they try to extricate him from the car, he starts to resist. Certainly seems like a justifiable tasering to me....cops have been killed before for NOT acting fast enough.
That cop opened his door and jerked his ass out of the car. He was also tasered INSIDE the car. These cops broke the law plain as day. If you think these police did the right thing, you need to get the fuck out of my country.

The cop probably went to his taser too soon but they could have used their fists to break his nose or bones. I guess that would have been less excessive than using a non-lethal, 5 second dose of pain somehow. People complaining about tasers should consider the other options before crying police brutality. So 1) Getting tased is not that bad; 2) Just do what the cops tell you, even if they're wrong.

98 is correct. Metalhead, it's spelled manner. It depends on what state you're in but in most states, during a traffic stop, if you're asked to produce a license, you have to. That's the law. When you sign your name on your license, this is what you consent to. It is only then as a courtesy that the Officer give you the reason for the stop. Some agencies recommend an introduction from the Officer as to his name , agency then reason for stop before asking, but this is not mandatory.
Yes they can ask, but judging by the officers behavior it was not a lawful order but an attempt to extract the driver in an aggressive manor. If you feel you are under any type of threat even from a police officer you can refuse an order. People don't understand, you have the right not to be assaulted by anyone including cops. The guy won 50g's, so the cops were wrong. Innocent until proven guilty, cops know they can't be overly aggressive, and they learned that terrible lesson in 2011.
It appears to me that these cops were looking for an excuse to light him up. The first pull over it appears they tell him to pull off the road. Then they come up to the car, but unless he had produced a weapon, why did they violently go after him?

I had a cop pull me over once for not dimming my head lights, when I argued with him he told me to get out. I am a law abiding citizen and felt that the only reason he told me to get out was to intimidate me. He yelled at me and when my elderly mother objected he yelled at her. I had had enough and told him to just write the damn ticket because I knew I was right(he was parked on side of road on other side of 4 lane highway when I passed him). He dropped the ticket.
The sheriff where I live is a good guy and would never do anything like this, the odd thing is that he let's his deputies get away with it. My thought is you should treat people like you would want them to treat your kids. I bet if some cop did this to this officers son he would be outraged. It sounds like he refused to get out of the car, and wasn't cooperating, asking for his id back. Then he tried to run and complains when he's tackled...really? It's impossible to know what's going on in the car when the policeman tried to pull him out, but this seems like more of a case of a jackass driver than police brutality.

The officer had Probable cause to search the vehicle bc of the smell of Marijuana, Which allows the officer to ask the suspect out of the vehicle to search. the Suspect refuses and he went hands of first and there was a brief struggle in the vehicle which according to the use of force continuum he deployed the taser. The offender evaded and continued to resisted arrest. The first arrest If he had a warrant out and the court didnt take it out of the system thats there fault not the police.

I don't remember what I was all pumped up about when responding to this, but, what usually gets me fired up is seeing someone taking a non-reasonable approach to get a jolt of adrenalin and feel like a bad-ass for a few seconds. What if the driver only handed the officer an ID and not a license? He certainly doesn't help his case by first refusing to obey the officers, and then fleeing and evading. Should the officers have waited until the driver decided he was going to use his car to try to flee, thereby putting the officers lives in danger? You seem to forget that while we have the right to question, they have the right not to answer.

All the charges against the guy were dropped, and he got a warning on the license plate. Nothing of an incriminating nature was found in his car, and he'd just been wrongfully arrested 3 weeks before by the same cops. Therefore, I can understand his reluctance to step out of the car. There was also a 3 year old child in the car who wasn't restrained in a child seat (only ticket given), he was on the mothers lap, which means the officer fired the taser very close to the child. He will get paid.

Always lock your car doors and only roll down your windows about 2 inches, just enough to talk to them, also tell them that you need to see their supervisor. Also never pull up to a building where you do not have an out. Also have a audio recorder or video recorder on you at all times.

What you just described just adds to an officers suspicions. You should not have to fear the police, nor should they have to fear you. The actions taken by these two officers is sure wrong, and they deserved to be sued. But the behavior you have described does not help out. Imagine you are a cop and you are always concerned about your safety and come in contact with a car where the driver seems to have something to hide? What would you do?
Well friend, you some arguments, would they work IDK. do you know the the outcome of this case? Was he convicted, what about a civil suit. Heres an interesting case on failre to exit a car upon a lawful order but its DUI related, People v Synnottt (Illinois). The police then forced him out. If the police smelled cannabis then that warrants further investigation even DUI related. Lastly if he was suspended then he could be arrested in some states. No DL is usually a ticket.

Their is no way in 23 seconds the situation escalated far enough to warrant the usage of the taser. If you read any departments procedures for use of force you will rread that their is step by step usage of force of escalation. I'm a Criminal Justice student soon to graduate and this video was shown shown and discussed in length in class. We all agree the officer did not follow the procedure of giving fair warning of force going to be used if the offender did not cooperate. Mace could have just as easily been used. Yes the offender did not cooperate but that does not give the officer the immediate right to use a higher level of force without fair warning. Plain and simple.
Do you know the departments procedure and policy on the use of taser and mace? Did you read the officer's report? I haven't seen mace used in over twenty years on a police department, most use pepper spray. So why are you talking about a use of force that is outdated with the use of mace in class? Again, assuming you've done your research you know these officers had already arrested him with no justification just weeks prior. Plus the fact your in front of a business in daylight with a passenger, it would never fly. Officer safety over rides as stated in court "at most, a mere inconvenience, cannot prevail when balanced against legitimate concerns for the officer's safety." Also he was stopped for a traffic offense therefore legally detained.
@RANDY64612 well, that may be true you're mentioning of general mistrust (which is admittedly no excuse), but considering the previous unlawful arrest combined with the officers simultaneous "request" while opening the car door prior to the drivers supposed "failure to comply" it looks less than an order and more like an assault. And that's the issue. An officer cannot order a person into harm. mimms is also based on an evidence surpression request by the defendant.

As I understand it, the original stop was for no front license plate, correct? So perhaps when the cop said he had "no license", he wasn't referring to the driver's license but the license PLATE? Then, by refusing to get out of the car, the driver immediately makes the cops suspicious...as they try to extricate him from the car, he starts to resist. Certainly seems like a justifiable tasering to me....cops have been killed before for NOT acting fast enough.

The cop probably went to his taser too soon but they could have used their fists to break his nose or bones. I guess that would have been less excessive than using a non-lethal, 5 second dose of pain somehow. People complaining about tasers should consider the other options before crying police brutality. 98 is correct. Metalhead, it's spelled manner. It depends on what state you're in but in most states, during a traffic stop, if you're asked to produce a license, you have to. That's the law. When you sign your name on your license, this is what you consent to. It is only then as a courtesy that the Officer give you the reason for the stop. Some agencies recommend an introduction from the Officer as to his name , agency then reason for stop before asking, but this is not mandatory.

Yes they can ask, but judging by the officers behavior it was not a lawful order but an attempt to extract the driver in an aggressive manor. If you feel you are under any type of threat even from a police officer you can refuse an order. People don't understand, you have the right not to be assaulted by anyone including cops. The guy won 50g's, so the cops were wrong. Innocent until proven guilty, cops know they can't be overly aggressive, and they learned that terrible lesson in 2011.

SO, maybe you think he should have gotten out of the car when told, but failing to do so obviously doesn't mean he was resisting arrest OR deserved to have a Taser used on him.

I had a cop pull me over once for not dimming my head lights, when I argued with him he told me to get out. I am a law abiding citizen and felt that the only reason he told me to get out was to intimidate me. He yelled at me and when my elderly mother objected he yelled at her. I had had enough and told him to just write the damn ticket because I knew I was right(he was parked on side of road on other side of 4 lane highway when I passed him). He dropped the ticket.

The officer had Probable cause to search the vehicle bc of the smell of Marijuana, Which allows the officer to ask the suspect out of the vehicle to search. the Suspect refuses and he went hands of first and there was a brief struggle in the vehicle which according to the use of force continuum he deployed the taser. The offender evaded and continued to resisted arrest. The first arrest If he had a warrant out and the court didnt take it out of the system thats there fault not the police.

@RalphyDee I've only been tasered in training to utilize the system. I don't remember what I was all pumped up about when responding to this, but, what usually gets me fired up is seeing someone taking a non-reasonable approach to get a jolt of adrenalin and feel like a bad-ass for a few seconds. Read the comments, you'll see many people that should not be in or around LE, as it appears they are in it for the wrong reasons. I would hurt your feelings but I don't think you'd get it.

@NekkiDo1 Your right he can say that but.The officer had Probable cause to take him out of the vehicle to be searched bc he smelled an odor of marijuana. The officer DOES NOT have to tell him he going to tase him. the reason police yell taser 3 times is to warn other officers not to pull a gun.The way i saw it the officer tried to use his hands there was a brief struggle in the car which allows the police according to the use of force continuum to deploy the taser. All he had to do was comply.

What if the driver only handed the officer an ID and not a license? He certainly doesn't help his case by first refusing to obey the officers, and then fleeing and evading. Should the officers have waited until the driver decided he was going to use his car to try to flee, thereby putting the officers lives in danger? You seem to forget that while we have the right to question, they have the right not to answer.

All the charges against the guy were dropped, and he got a warning on the license plate. Nothing of an incriminating nature was found in his car, and he'd just been wrongfully arrested 3 weeks before by the same cops. Therefore, I can understand his reluctance to step out of the car. There was also a 3 year old child in the car who wasn't restrained in a child seat (only ticket given), he was on the mothers lap, which means the officer fired the taser very close to the child. He will get paid.

Always lock your car doors and only roll down your windows about 2 inches, just enough to talk to them, also tell them that you need to see their supervisor. Also never pull up to a building where you do not have an out. Also have a audio recorder or video recorder on you at all times.

What you just described just adds to an officers suspicions. You should not have to fear the police, nor should they have to fear you. The actions taken by these two officers is sure wrong, and they deserved to be sued. But the behavior you have described does not help out. Imagine you are a cop and you are always concerned about your safety and come in contact with a car where the driver seems to have something to hide? What would you do?

Well friend, you some arguments, would they work IDK. do you know the the outcome of this case? Was he convicted, what about a civil suit. Heres an interesting case on failre to exit a car upon a lawful order but its DUI related, People v Synnottt (Illinois). The police then forced him out. If the police smelled cannabis then that warrants further investigation even DUI related. Lastly if he was suspended then he could be arrested in some states. No DL is usually a ticket.

Their is no way in 23 seconds the situation escalated far enough to warrant the usage of the taser. If you read any departments procedures for use of force you will rread that their is step by step usage of force of escalation. Officers still carry mace / pepper spray because it is still a viable use of nonlethal force. I have filed a FOIA to obtain the report and records concerning this incident for further review in class.

I'm a Criminal Justice student soon to graduate and this video was shown shown and discussed in length in class. We all agree the officer did not follow the procedure of giving fair warning of force going to be used if the offender did not cooperate. Mace could have just as easily been used. Yes the offender did not cooperate but that does not give the officer the immediate right to use a higher level of force without fair warning. Plain and simple.

Do you know the departments procedure and policy on the use of taser and mace? Did you read the officer's report? I haven't seen mace used in over twenty years on a police department, most use pepper spray. So why are you talking about a use of force that is outdated with the use of mace in class? In some circumstances warnings of use of force are not used due to the situation. Judging without the above information by inexperienced students is an improper way to learn with no benefit

We can't order people out of cars with no cause and we sure as hell can't open the door before they have a chance to comply, that's assault. We're armed and they aren't. In this case it's agg assault b/c on top off the flimsy " cause", they put their hands on him and backed up the threat he was worried about, an unannounced tazing and battery.

Again, assuming you've done your research you know these officers had already arrested him with no justification just weeks prior. It seems to me you'll go to any length to justify the actions in this video, particularly excluding the driver's clear compliance just minutes prior. Mimms requires that officers are acting lawfully.

Plus the fact your in front of a business in daylight with a passenger, it would never fly. Officer safety over rides as stated in court "at most, a mere inconvenience, cannot prevail when balanced against legitimate concerns for the officer's safety." Also he was stopped for a traffic offense therefore legally detained.

@RANDY64612 well, that may be true you're mentioning of general mistrust (which is admittedly no excuse), but considering the previous unlawful arrest combined with the officers simultaneous "request" while opening the car door prior to the drivers supposed "failure to comply" it looks less than an order and more like an assault. And that's the issue. An officer cannot order a person into harm. mimms is also based on an evidence surpression request by the defendant.

Police cannot give this order while trying to enter the car. this video shows him opening the door simultaneous with the order, it;s aggressive and unwarranted, and frankly, it's not even safe-for anyone and expecting someone to get out of a car in that situation is unreasonable. he has to be given time to comply, he wasn;t. mimms upholds the order to exit, not officer entry.

Why is this even an issue. If I ask you to get out of the car do it. Does everyone fail to see the communication between the officers before asking the driver to exit? Who knows what that was? Anyone? Was he a know drug dealer to the officers? Known by the officers to carry firearms? Just being too nervous and made the officers think something?
