Rick I agree. No music is free from any web site is legal. When a purchase music get handed out to other that is use on video is a infringement on copyright law. The only way to avoid copy right law is to create your own music to be viewed on the uploaded videos. There are no other way to get around copyright law.

These are ASCAP's rules, not Freeplay's rules. Basically NOBODY can broadcast music unless you BUY a license. Even a bar owner with a jukebox has to pay thousands of dollars a year to ASCAP for a license to have that jukebox, even if he owns the CDs that are inside it. Being a composer myself, I would be happy to have my music broadcasting on the net. But ASCAP would go after you not me.
It's FREEplayMusic. I'm not gonna paying ANYTHING for using their music. Why else would they have all this music to download? It's not the kind of music anyone would listen to by itself, sheesh.
Well that sucks, I just got notified about that because one of my videos has a song from that site, I credited them in the description of my video but apparently that's not good enough. I think I'm probably just going to delete the video that I used it in.

Wtf... in my understanding, FREEplaymusic means that the music is free to use, and they have every singile title open for a download. If they have such small prints somewhere that no normal person can read and understand that you have to pay for them, then thats just a big scam and false advertisement. I use their music and credit them but if they come after me, i just have to delete them and sue them for false advertisement.

If one can offer free music, I will support them buy buying their work, however, if one will force you like how and what you mentioned, I would never even listen to their music. But in a way, it's both their loss and mine. Brad Sucks is a guy that offers royalty free music OR you can purchase it, and use it on YT. He gives you the option to buy his songs or not.

IT is not free to use "FreePlayMusic" unless you pay for it and get a license which dictates what it may be used for. I email there customer support and they basically said no you can use it unless you pay.

This makes no sense... so basically, what I'm getting from this video is this... inspite of the fact that this is FREEplay music, their music is NOT royalty free? It's BROADCAST music... broadcast music IS royalty free, that's why it's compsoed, for biradcasting... they even say so on their wesbite, that it's music for broadcasting.
@GroverKent It's royalty free once you've purchased the rights to use it. - Buy it once, then you don't need to pay any further royalty fees to use it in subsequent broadcasts - hence "royalty free" NOT "completely free"

Does anybody know how this affects a video in the Adsense program, where you get paid for views? Because Adsense definitely doesn't bring in enough to justify a $150 license.
@lowcostvideos Unfortunately the low numbers don't mean anything in the eyes of the law - if you are "generating revenue" from a video containing a soundtrack you are not licenced to use, then you are throwing yourself open to a compensation claim from the copyright owner.
Whether the copyright owner chooses to persue a claim is a different matter, but they will probably have the right to claim their legal expense from you too, should they choose to come after you.
@rickvanman I know, I'm just curious if the price is more for Adsense vs a regular youtube video. I emailed them about this but the response didn't really address it, except saying that they will negotiate rates if you use a lot of their music.

But it does mean if your video is discovered by them and you have not paid for the music use, they then have the right to come after you for back-payments and claim their lawyer fees as well.

Few modifications to their site and they would be within their rights.
The music on this site is better than some other sites I have heard from. It would take some serious talent to duplicate some of this stuff yourself. It would be like hiring a band to do a soundtrack. Good luck trying to do that yourself for $25 dollars. Talent like this needs to be rewarded. And if you can do it yourself this would be a great place to get paid for what you do best.
according to the terms of use, the music is free for personal use. I would consider using the music on youtube to be personal use. according to law, as long as you DO NOT make a profit off of music that is not yours, it is legal to use.
Personal use means using it at home for your own amusement. As soon as it goes up on youtube, you are then "broadcasting" and that's a whole new can of worms :o)
Your probably right, but when you broadcast the music you are promoting the website at the same time, so why would they not approve of that? They want more people to listen to their music, so why not let us use it as an advertisement for their site?
I see your logic, but they want actual physical money for the music they sell, not publicity. That is the nature of their business.
People use the same argument with mainstream music, but the music companies do not appear to be interested either, and the video's still get pulled down.
In the end it's down to the music owners to dictate what can and what can't be done with their music.
If you believe that your personal views will vindicate you from their rules, then good luck with that!
@rickvanman The thing is that there's people in youtube and I assume other places too who say that it's free to use them. When you make a comment to their videos or channel saying that it's not the case they mark it as spam or remove it. Almost as if they own the site and wan't to get people to use them so they can sue. :-)
i think the worst that would happen is that the audio would be muted in video-rather like when someone uses a record label track without consent (a lot of the time now though the audio IS allowed but advertisement may appear beside the video)

My friend was having trouble with getting ads put on a video because of freeplaymusic. If I used it in one video thats 2:40 and it's 25 bucks per 4 minutes. Does this mean I owe them 15 bucks?
Then I'm guessing he owes them some cash - I wouldn't like to estimate how much though - I don't think they allow for time consessions. I'd imagine its 25 bucks for "up to" 4 minutes - so he'd probably owe the full amount for each year the video is live.
I'm just guessing though - you'd need to clarify with them.

Ive used it. No problem yet, but the worse yourube have done with me was remove the sound of a rihanna track but the video was intact.

according to the terms of use, the music is free for personal use. I would consider using the music on youtube to be personal use. according to law, as long as you DO NOT make a profit off of music that is not yours, it is legal to use.

Personal use means using it at home for your own amusement. As soon as it goes up on youtube, you are then "broadcasting" and that's a whole new can of worms :o)

Your probably right, but when you broadcast the music you are promoting the website at the same time, so why would they not approve of that? They want more people to listen to their music, so why not let us use it as an advertisement for their site?

I see your logic, but they want actual physical money for the music they sell, not publicity. That is the nature of their business.
People use the same argument with mainstream music, but the music companies do not appear to be interested either, and the video's still get pulled down.
In the end it's down to the music owners to dictate what can and what can't be done with their music.
If you believe that your personal views will vindicate you from their rules, then good luck with that!

@rickvanman The thing is that there's people in youtube and I assume other places too who say that it's free to use them. When you make a comment to their videos or channel saying that it's not the case they mark it as spam or remove it. Almost as if they own the site and wan't to get people to use them so they can sue. :-)

i think the worst that would happen is that the audio would be muted in video-rather like when someone uses a record label track without consent (a lot of the time now though the audio IS allowed but advertisement may appear beside the video)
no one reads terms and conditions (like when you install software,you just check a box saying you have).
if the worst did come to the worst,you say regardless that the website name implied that it was free.

You can use the music I have provided as long as you credit it in the game.

My friend was having trouble with getting ads put on a video because of freeplaymusic. If I used it in one video thats 2:40 and it's 25 bucks per 4 minutes. Does this mean I owe them 15 bucks?

Then I'm guessing he owes them some cash - I wouldn't like to estimate how much though - I don't think they allow for time consessions. I'd imagine its 25 bucks for "up to" 4 minutes - so he'd probably owe the full amount for each year the video is live.
I'm just guessing though - you'd need to clarify with them.

I have not yet seen the site but I bet the bit about putting their name to the credits is in BIG print whole the fees bit is hidden in the confusing small print?
