  • an employer may require you to "burn" through certain time on the books, like vacation and sick leave, during the weeks you are using FMLA. the full answer, as with all matters legal, requires talking to a lawyer about your particular factual situation, and you can find out more about this at the USDOL's website, but the general answer is that this kind of "burn" can be an aspect of taking FMLA.

  • are you required to use all or any of your vacation or sick time to exercise your FMLA rights?

  • From the few facts you have listed here, it sounds to me like you may be right = you may need a lawyer. You should call your county bar association to get the names of lawyers who specialize in FMLA claims. Good luck. Sounds like a raw deal.

  • I am currently under fire at work because shortly after being approvdd for fmla and receiving paperwork, all the time I would call in for fmla explicitly on our sickline, it has been reported as absences and no call no shows. I might need to lawyer up to make sure I get the rights that I am assured with fmla. I have gout and they are basically saying that i am lucky not to get fired.
