I understand the points John makes, but what would make a person adhere to common law rather than statute law?
There will always be those who would rebel against common law as an individual, so if they are not in a contract, how could they be stopped from commiting what common law would deem a crime, such as theft, rape or Murder?
I am not setting out to be contentious, I just would like to know how an alternatve framework would differ from the existing one.
It is is reasonable to suggest that people adhere to common law not because of the threat of punishment, but because some actions are obviously wrong. There is a vast amount of empirical evidence to show that e.g. murder is bad for soceity. I do not refrain from killing people because it is against the law, nor because it is written in some religious text bible, rather i refrain from killing people because murder is so obviously wrong.
Also, most statutes do indeed go above and beyond common law. Whilst i benefit greatly from living in this society (through education, infrastrucutre etc) I also suffer unecessary infringement upon my personal liberty. I accept that a trade-off has to be made between civil liberty and co-operation or equality. However, the way things stand at the moment, the elite of our society wield extreme coercive power in order to subjugate us to their will, this voids any contract made with such people.
Think of the repurcussions for not having a birth certificate, though i am still the same natural human being, capable of perfoming all of the functions within society i currently perform (and adhereing to common law). I would be unable to travel to any other country, to drive on public roads, to open a bank account etc. If I am still the same person, who adheres to common law, despite not having a birth certificate would it not be possible for society to still function?
So a big hand of applause for the bankrupt political parties giving all our money to bent bankers whom stored it away, and now we entrust our politions to fix it.pay the corproates and pursue the citizens. whooo haaaa for statism, where's our democracey ???
