the only thing the LPO'S (loss prevention officers) did that was wrong (and very wrong) was punch the subject with a closed fist in the face. there was no call for that. if he resisted arrest, yes the two of them could wrestle him to the ground sure. but LPOS are just like security. trained to use force +1. so if the subject punches you in the face, then punches him back in the face is fine only then. or of course if he has a deadly weapon..

Security can in fact use as much force as reasonably necesary in order to effect the arrest. The only thing I didn't like was the lack of communication from the security personal to the subject.

I am sure that they had asked him politely to stop and informed him that he was under arrest for shoplifting (theft under $5000). When someone starts resisting you don't know if they will pull out a weapon or if they will use that bottle against you.

i just got caught stealing from the lcbo they handcuffed me the first time but i got the cuffs off and made a run for it... unluckily a customer grabbed my backpack and i got tackled by the guards anyways after that ordeal the security guards caught me and kicked my ass right there in the checkout and dragged me into the back room while throwing me into random objects and saying how lucky i was he didnt break my leg.. lol.... i have to go to court in a couple weeks

If the guards work for the LCBO, which is a Crown Corporation, then they have special powers beyond those of security guards working for private businesses. In fact, they have "peace officer" status. See Public Works Protection Act, RSO 1990, ch.P55

It is poorly trained loss prevention officers like these ones who give the whole security industry a bad name. there are many officers out there like myself who have proper traing on how to use hand cuffs. there were two of these guys and they could not get one person under control. they did not properly identify themselfs nor give proper commands to the indevedual they were arresting.

And I agree from seeing this video that the guards and the civilian or whatever that got involved 1 minute into the video were not acting as they should've. It's unfortunate what kind of trouble this individual has got himself into, and I know him. We went to the same high school and actually used to be friends in the ninth grade. The story checks out, before the start of the video he denied stealing anything so the guards took him down. They ARE security guards at the Eaton's centre.
You don't know what security have to deal with everyday. If you ever worked security in your life, you would know that more than half of these fools are lucky that most of us are working professionals. Off the uniforms, I would've have made human sand bags out of some of these fools I deal with. They take advantage of the fact that I'm a security and I have a uniform on and they mouth off to me.

Final point, a high percentage subjects arrest for theft, either have warrants out for their arrest or have been convicted of theft in the past. When a subject is on any kind of drug it is very hard to control the subject, it would make sense that it was so hard to take control of the situation and not to mention the by standards yelling and approaching the gaurds.
What you don't see in the video is the subject throwing punches at the security guards in side the store. The guards are allowed to use reasonable force to subdue the subject.. The punches thrown at the subject were in the rib area to release the guys arms so they can put the cuffs on. These guards are certified to use handcuffs and are allowed to arrest anyone that is suspected of theft, fraud, or they feel are a threat to staff and customers
if the accused threw punches at the under covers inside the store, that indicates the LP's stopped the accused BEFORE he exited the store, not giving him a chance to pay for the concealed merch and making this a false arrest and a big lawsuit, as an LP, we dont arrest suspected shoplifters, well not my agency, we arrest SHOPLIFTERS jokes on them, have a nice day
you have a cell phone for a reason, you have a phone in every store for a reason, they have "911" for a reason, and for the investigators not to call 911 when this happened, but to only ask bystanders, only points to one thing < lack of critical thinking, a MUST and a REQUIREMENT for this job, if you ask me, they were out of line and amateurs at what they do..
Im sure when the clerk got her nose broke someone in the store called 911 the Officers still did their Job, As an investigating P.C. showing up to the call, there would be no issue with the arrest, after all said and done I would probably recommend an award to my divisional Unit commander afterwards for these Officers considering the injuries the suspect caused and apprehension of the suspect. In canada, you MUST turn ANY arrest over to the police. Security officers have no choice but call the police in EVERY matter wether it is a $2 or $5000 item. The punch at the start is the biggest legal problem. This is NOT reasonable force as defined by the criminal code. You MUST keep the situation in control. These jokers did no such thing and should go back to uniform deterrents.
You are correct. Anytime ANYONE (security, citizen, etc) arrests anyone else that person must be forthwith turned over to a peace officer (most cases a cop). The punch does appear to be excessive force, however, the subject proved to be violent when he broke the cashier's nose. A punch could be legally justifiable based on the subject's previous history of violence. The criminal code is designed to protect officers as well (some sections).
I think you mean failure to leave when directed ;) In a mall situation "engaged in a prohibited activity" has to be posted on the mall code of conduct or its not arrestable. You have to hook them up for cause disturbance :p
mall code is implied though. Would the reasonable person act in an abnormal manner? No. Their is alot of authority under the trespass to property act. Prohibited activity is grounds for removal. Failure to do so results in failure to leave when directed.

I think the loss prevention officers should where uniforms so that bystanders can identify who they are. If I was walking by while this was occurring, I would think that the shoplifter was being beaten for no reason.
No LPO's should never have to wear uniforms. Now what would be a good idea is if the store, or even the mall itself, had a uniformed officer present. The thing is whenever their is an arrest like this, uniformed or not, people will always be critical of the outcome.

Robeatti. Tact comm with the crowd is NOT an option until after the fact. The LPO's should have just ignored the crowd. The LPO's could have used loud verbal commands. When it comes to a crowd like that you have to gain control of them. Unfortunately their was no back up to assist those LPO's

Yes sir, my source is a good friend who does loss prevention for Group 4. I'm not in any way knocking Group 4, just the two that were in the arrest. I mean while your making an arrest your adrenaline is going and there are countless situational variables, but how they handled it is typically what give security guards in addition to LPO's bad names.
Fair enough bigdanson but something of this nature would have made headlines in the newspaper somewhere, especially if the officer's were to be charged. The only way they could nail the officer's is for the alleged "punch to the face".
When I am effecting an arrest my biggest concern is not the person i am arresting but the other people around me.
One thing that really annoys me is all the arm chair quarterback bystanders who claim to "know the law" and are doing nothing to assist in the arrest. While that is their right to do so they should not be making comments about the arrest in question until after the fact. Also, loud verbal commands should have been used by the officers making the arrest.
The length of time that it took to complete this arrest looks pretty bad. Of course though, you only see what is going on during the arrest. Not what led up to the arrest. PPCT should have been used. It would have been more effective.

the only thing the LPO'S (loss prevention officers) did that was wrong (and very wrong) was punch the subject with a closed fist in the face. there was no call for that. if he resisted arrest, yes the two of them could wrestle him to the ground sure. but LPOS are just like security. trained to use force +1. so if the subject punches you in the face, then punches him back in the face is fine only then. or of course if he has a deadly weapon..

I am sure that they had asked him politely to stop and informed him that he was under arrest for shoplifting (theft under $5000). When someone starts resisting you don't know if they will pull out a weapon or if they will use that bottle against you.

i just got caught stealing from the lcbo they handcuffed me the first time but i got the cuffs off and made a run for it... unluckily a customer grabbed my backpack and i got tackled by the guards anyways after that ordeal the security guards caught me and kicked my ass right there in the checkout and dragged me into the back room while throwing me into random objects and saying how lucky i was he didnt break my leg.. lol.... i have to go to court in a couple weeks

You don't know what security have to deal with everyday. If you ever worked security in your life, you would know that more than half of these fools are lucky that most of us are working professionals. Final point, a high percentage subjects arrest for theft, either have warrants out for their arrest or have been convicted of theft in the past. When a subject is on any kind of drug it is very hard to control the subject, it would make sense that it was so hard to take control of the situation and not to mention the by standards yelling and approaching the gaurds.

What you don't see in the video is the subject throwing punches at the security guards in side the store. The guards are allowed to use reasonable force to subdue the subject.. The punches thrown at the subject were in the rib area to release the guys arms so they can put the cuffs on. These guards are certified to use handcuffs and are allowed to arrest anyone that is suspected of theft, fraud, or they feel are a threat to staff and customers

Im sure when the clerk got her nose broke someone in the store called 911 the Officers still did their Job, As an investigating P.C. showing up to the call, there would be no issue with the arrest, after all said and done I would probably recommend an award to my divisional Unit commander afterwards for these Officers considering the injuries the suspect caused and apprehension of the suspect. In canada, you MUST turn ANY arrest over to the police. Security officers have no choice but call the police in EVERY matter wether it is a $2 or $5000 item. The punch at the start is the biggest legal problem. This is NOT reasonable force as defined by the criminal code. You MUST keep the situation in control. These jokers did no such thing and should go back to uniform deterrents.

You are correct. Anytime ANYONE (security, citizen, etc) arrests anyone else that person must be forthwith turned over to a peace officer (most cases a cop). The punch does appear to be excessive force, however, the subject proved to be violent when he broke the cashier's nose. A punch could be legally justifiable based on the subject's previous history of violence. The criminal code is designed to protect officers as well (some sections).

For the people who are agaist what this/these officers did all i have to say is that...you have no idea what it's like to be a Loss Prevention Officer and to go out to get a shoplifter and have him/her resist you or try to fight you.
We put ourselves at risk everytime we appraoch someone...so until you know what it's like SHUT UP
I've never had anyone question my use of force when arresting someone who is fighting me after they just stole something.

Robeatti? So your an expect in this field? Not every arrest is clear cut and dry. Not every arrest is easy. I do believe the LPO's did lack training. Knee strikes and pressure points would have helped complete the arrest in a lesser timeframe.

Ur right lordpalmer about every arrest not being clear cut and dry. i just had one this evening, where the guy pushed me and took off as everyone just stood around. Someone cut him off with a grocery cart, where he went flying, and still got away. and all anyone had to say was..."ummm what was that about?"
This job requires some skill...but sometimes u can have all the skill and man power u might need...but they can still resist and get away.

I know all to well what you are talking about. People simply do not want to get involved. Also people are reluctant to assist in an arrest, let alone even make the arrest, for fear of reprisals from the "criminal" and the public itself.

If the dipshit who committed assault and theft did not resist arrest there would be no issue here, but unfortunately for him he did and the security officer's were using force to gain control of the subject.

The more I see this video makes me wonder why pieces of shit like this are not locked up for a long time. Our justice system is so flawed that a thief like this probably been in and out of jail like going through a revolving door. His behaviour indicates to me that he is a not a first time criminal but will surely go to jail and receive FREE Legal Aid paid for by you and I. What a sick country. Try getting a free lawyer for use in our everyday lives. Impossible. Commit crime = free lawyer?

Yes sir, my source is a good friend who does loss prevention for Group 4. I'm not in any way knocking Group 4, just the two that were in the arrest. I mean while your making an arrest your adrenaline is going and there are countless situational variables, but how they handled it is typically what give security guards in addition to LPO's bad names.

Fair enough bigdanson but something of this nature would have made headlines in the newspaper somewhere, especially if the officer's were to be charged. The only way they could nail the officer's is for the alleged "punch to the face".
When I am effecting an arrest my biggest concern is not the person i am arresting but the other people around me.

One thing that really annoys me is all the arm chair quarterback bystanders who claim to "know the law" and are doing nothing to assist in the arrest. While that is their right to do so they should not be making comments about the arrest in question until after the fact. Also, loud verbal commands should have been used by the officers making the arrest.

The length of time that it took to complete this arrest looks pretty bad. Of course though, you only see what is going on during the arrest. Not what led up to the arrest. PPCT should have been used. It would have been more effective.

oh yea and the security in volved had plenty of experience behind them. one officer has 16 years exp, i have 6 years and training all six years, and the other has some military background. so you cant say that we could cuff the guy cause we have no exp or we are retards.lol

Well first of all I agree with you and I know that people are fucked up. I do the same job you do, in fact, i am a commanding officer. I loathe people that open their traps on arrest situations yet know nothing about what is going on. I find those people are the first one's to talk shit but the last one's arriving on scene. I would have told her to leave the property.

While the subject is resisting (but not throwing strikes [just in a state of active resistance]) you arn't allowed to 1. Throw strikes 2. Put them in a state of Asphxia (choking) all LPO's under Group4 at the moment cannot make arrests (company policy). Congrats to the two LPO's for a terrible, messy arrest that took way to long. Good job boys.

The Loss Prevention Officers that you just saw work for Group 4, the largest security company in the world. For the people thinking this is a good arrest enjoy the below. They both got charged with excessive force, under Section 26 of the Criminal Code of Canada.
