  • Always know your rights. Don't give them up under "apparent pressure". In my country police, and civil servants make up rules as they see convenient, but are not in any law. Dig in, and stand up for your rights, always! Else you just as well could give up your passport, as it would not mean anything.

    You protest those agriculture checkpoints as a violation of the 4th Amendment. Driving into California isn't probable cause.

    But why don't you protest anti child pornography laws? Aren't they in violation of the 1st Amendment.

    I see a need for both "lines".

The people of the State of California decided they don't want "foreign" pests in their state and one way of making it happen is to search cars coming into the state.   • @RP4409 The history of drivers licenses is irrelevant. There's been a ton of statutes passed requiring everybody to have one, not just those engaged in commerce. Same thing applies to private vehicles being stopped as well as commercial vehicles. Doesn't the Constitution allow states to create new laws?

    By the way, Kent vs Dulles doesn't apply here. It was about passports and the right to travel to other countries.....

I am not able to rally and protest and completely submerge my life into this because I do not have the finances nor the time. (stay at home mom of 3 kids ages 6, 1 1/2 yr old, and a 3 month old.) My husband is a truck driver and he goes thru this stuff all the time. Any way out would be nice to have more people fighting this but the actual numbers of people that are dumbed down or flat out dont care .......

  • I live in WI n nobody believed me that we r part of the unconstitutional border zone until a frnd got stopped 2 mls from her home, (Hayward) after a day trip to Ashland. She refused to give ID n kept telling them she lives 2 mls away in the same little town she was born in..She sat there for 3 hours in the secondary. Finally had them call or she called a local sheriff deputy she knows n he did not know they were set up on Hwy 63! She was the only person that complained in two days!?

  • I noticed a lot of people commenting here are missing the point. It's not really bad to have these checkpoints, but only when you are dealing with inspection for bugs and such. But when you include the general public? Thats where things get sticky. Our rights are being raped right before our eyes and you people just dont see it. They have no right to search your bricks if there is no warrant. No warrant can come without probable cause. But if you dont refuse the search them it is perfectly legal

    The U.S. Supreme Court has ruled that no drivers license is required outside of commerce period. And I'll go further, in no state are you required to title your newly bought car, or get it registered, or get plates on it. It's ALL voluntary. Just make sure it's insured, that's a whole different beast to fight.

  • What the checkpoints do a good job of is keeping the dirty Mexican produce out. Grocers try to buy the cheap dirty Mexican produce and ship it to another state like Texas then relabel it and try to sell it in California as "Texas" produce where retail prices are high. I've seen a lot of relabeling fraud and blind shipments in the grocery industry.

    as far as the farmers paying off the cops to keep Florida fruit out? not economically feasible. I can buy a whole case of Tangelos or oranges for $2-$3 from the grower. Bell Peppers that sell for $2 apiece in the grocery store go for $5 a bushel. California produce is dirt cheap it isn't worth the fuel cost for a grower to send produce cross country and sell where it's grown

They will stop hundreds of vehicles without 'probable cause', issue tickets / fines, impound or seize vehicles, and make arrests at their discretion, in addition to chasing down anyone trying to avoid a checkpoint. - "Have a nice day!" =)

I don't believe the younger generations fully recognize how much our rights are being violated and encroached upon on a daily basis.

  • The states actually have NO authority to restrict interstate commerce. It's specifically reserved to the congress, in Sec. 1, Art. 8 (the "Interstate commerce clause").

    If "foreign" produce is to be banned from California to control pests and protect crops, it's within the purvue of Congress, not California, to do so.

    Congress is too busy abusing the commerce clause, claiming absolute authority over all intrastate commerce in the country, on the claim that it might affect interstate commerce.

  • i was traveling from washington state and was coming thru the north cali mtns delivering furniture privately in a 24' truck going down steep hills and the entire highway was diverted, starting with " SLOW,SLOW," then "PREPARE TO STOP CHECKPOINT AHEAD" i was lead off the highway with cones and sandbag signs to two officers i could see armed with automatic weapons. they asked did i have an inspection paper to enter cali. i produced what i had and my dude had put one in my things.

    In a common law country ALL supreme court decisions have some sort of weight in another court, it is a federal court and the state cannot take away a right protected by the federal government period. Common law = common sense. America is (although good luck applying it) a common law country. I see common law in the constitution "the supreme law of the land" I do not see statute or ordinance in there. THOMPSON v. SMITH is just one example of the right to travel, I can quote all day.

It has been held a right must be enumerated by the 14th Amendment to be inalienable. (Amendments 1-8, 10th) have been enumerated. The 9th Amendment has yet to be enumerated (where the right to travel freely falls under) there has not been a case close to possible enumeration of the 9th amendment in almost 80 years.   • @rdhayes06 The 14th amendment was not properly ratified. There a three 13th amendments. The constitution doesn't grant rights it protects some that are especially important. The right to travel doesn't have to be in the constitution. You can't be free if you can't travel. The state cannot turn a right into a privilege and charge a fee for it Murdock v. Pennsylvania. Right to travel falls more so under the 4th and 5th amendment. This was protected up until Erie Railroad Co. v. Tompkins

  • @teckniec2 You are right, you do have a right to travel freely. But not to operate a vehicle registered to a state without a license. When you get a license you give your consent for a state representative (usually the secretary of transportation or public safety depends on the state) to act as your agent. Now that you have an agent in the state, the state has jurisdiction over you. With this jurisdiction we are no longer in the realm of common law.

  • @rdhayes06 Well yes and no In my opinion. You can get a license under duress because what happens when you don't get one? They take your car and lock you up. Also a DL is not a valid contract as it does not give full disclosure to the agreement. There are ways of enforcing your right to travel and still have a DL because of this. I still have one but I get tickets thrown out, I eventually plan on getting rid of it but I don't have time to play in corporate court right now.
