the human eye can only see up to 40 FPS and unless you have some type of amazing monitor in which i doubt you do.your monitor can only display 60 frames per second, which matches the refresh rate of your monitor.so 250 FPS? I think not... other then that,when you say average fps is 40-50 without fraps running? is this just standing in a city? raiding? dungeons? because even someone with a really bad chipset can decent fps,the trick is will it maintain those fps? or will it fall down to nothing?
there is a tweek you can use to raise your fps. I did the same because no matter what i used, i would only get 100FPS on Battlefield 2. I found a tweak and it ended up that i was really getting over 250 fps. lol.
