A very large fine + community service goes a long way (I should also mention that taxpayers often have to pick up the tab for jail, at $50+ per day, that's $9,000 at the end of their 6 months stint in the pokey.

@MrLogicnreason Any type of mandated treatment is bogus. People will complete the treatment and re-offend. A decent example is defensive driving. People take the course and re-offend. It's not exactly the same but similar. Harsh sentences with lasting repercussions will work. The risk of losing ones ways and means of work, getting to work and social status will be enough. Now, if it's a true substance abuse issue, then maybe treatment will be necessary.

I've been a cop for 11 yrs and have worked worked more alcohol related fatality crashes then non alcohol fatality crashes. People can complain all they want to, where I live the there are free taxi rides for those who are impaired. If they are to stupid to use them then they deserve to be arrested.
I'm not sure what state your in, but where I live .08% only means that you are presumed to be impaired, you can still be impaired and not be over .08%. That is why we have 2 separate statutes on this one is DWI and one is BAC. Its kinda funny that every person arrested always say the same thing " I'm innocent".
I have never had a problem looking anyone in the eye when I was arresting them or reading all of thier charges when they were being booked in. Never not even once. I will agree on one point, some of the laws are messed up.

I work off of a 4 clue minimun, meaning if you show at least 4 clues during fields, then you are arrested. I work overnights and wkds. I have not been wrong one time with this system
They said I smelled like alcohol... And they said I was going 35 in a 25, i'm not sure where, they didn't stop me until after I parked.
The BAC was low but it doesn't matter cause i'm not 21. Legal limit for under 21 is .02% or whatever, so it doesn't matter if I got a .04% or whatever.
I completely understand you shouldn't drive when drunk, but I wasn't... I think the 21 drinking age is kind of dumb, at least for driving..

I agree that age means nothing when it comes to actual impairment, as for the zero tolerance, it is that way because you are not allowed to drink or be in possession of alcohol period. Having said that, I do believe that if a person is curently in the military then they should be allowed to drink. Old enough to go to war then old enough to drink, but only if they are serving there country. I just got a DWI in El Paso Texas. I cannot be mad at cops since I brought this upon myself. One always thinks it never will happen to them but it happened to me. Maybe the cop that pulled me over saved me from making this DWI into something else worse. Getting in a car accident, hurting myself or worse, hurting someone innocent. This helped me get closer to God. I learned nothing good comes out of alcohol so I resign to drink again. You're on your right to judge people for being stupid.

I am not going to lie. Having a DWI is looked down upon. It's like you have "The Scarlett Letter." Mine is a misdemeanor class B. I have my last court on March 24. My recommendation are 80 hrs community service, donate $10 to MADD, and all those classes and the interlock device and probation for one year. I have a good lawyer and he is tyring his best to lower that. If he lowers it great, if he doesn't I still got lucky!

help with optimistic advice with what I can. I'm in your same situation. You feel like your life is over but it's not! You only can either "fight or flight!" It's just life brother! We all make mistakes and the ignorant people that make your life harder for judging you are in a far worse position than you are so you're ahead already! Keep your head up! I am always thinking and if you want a really good job, just be honest about your mistake and ask your probation officer to write a letter for recommendation that you follow and did not give him/her any trouble. They are there to help, so do not piss them off! They are allowed to give you a letter of recommendation and some are allowed to give a certification when you complete your probation! A lot of people do not know this and you could use it for your job!

I was in an accident and my friend had had some drinks, but we were overseas, they figured out that the person in front of us threw on the brakes for no reason. over here my friend would be in jail

DUI cost me about 6 grand. Cops are on the look out for DUI and sometimes pull people over randomly cuz they get $300 per DUI offender

We all make mistakes and the ignorant people that make your life harder for judging you are in a far worse position than you are so you're ahead already! Keep your head up! It's just going to be a rough ride for a while and stay out of trouble since this DUI/DWI is there for life!

Oh yeah, one last thing! I am always thinking and if you want a really good job, just be honest about your mistake and ask your probation officer to write a letter for recommendation that you follow and did not give him/her any trouble. They are there to help, so do not piss them off! They are allowed to give you a letter of recommendation and some are allowed to give a certification when you complete your probation! A lot of people do not know this and you could use it for your job!

if its your first time you shouldnt go to jail and most cases you dont even if you hit someone, it could be a mistake in which u learn a lesson! But second time i thnk punishment should be serious

Nope. Won't work. You have to blow into those interlockes every 10-20 minutes. And if you have been drinking, why would some one who hasn't ride with you just to help you drive drunk?

Find a " good lawyer." There is no such thing. They'll take your money just fine, getting them to return your calls is impossible. Lawyers are giant fucking scumbags.

Could not agree more , hired a lawyer for a case i had that wanted $6000 to get started , and really needed the money to get started on the case ,yea he needed it allright to go on vacation with my money, would not return phone calls after that, had to call state bar ,did not get my money back ,fuck lawyers.

Yeah funny how they can't manage to return calls. I'M not sure who to despise more, lying cops, lawyers, it's all a big racket designed to take your money. My advice to 1st time DUI folks is consider the big money it takes to probably lose vs. just either representing yourself or trying the public defender. Nearly $10K and other charges were levied 103 days later to add "probable cause" for the stop it's not all over 13 months later.

A possible alternative would to have auto makers install breath devices in all cars, therefore eliminating all chances of DUI. What do you guys think about this?

Good idea, but people who are under the influence or impaired, never like to admit that they are. And most would prefer driving their own vehicle home because they think they are fine. But it all boils down to individual responsibility. Alcohol effects people judgements, so what makes you think people are going to choose a can over driving their own car?

I would like to "start at the beginning" as well. I think if you cause an accident while DUI you shouldn't be allowed a lawyer. Lawyers who defend these people should be shot as well! There is no excuse for drinking and driving!!!

sir do you know how wide spread it is that police arrest for "dui" people with a 0.00 BAC?
good now that we on the same page, let me blow your mind by telling you that A. the private business of owning a prison is a multi billion dollar industry B. DUI laws have gotten waaay tougher and infring on civil liberties without shame. Now I ask you, is it possible there are "innocent" people being arrested for billions of dollar yearly? YOU BET YOUR BUTT THEY ARE.

@badpanda84 you know... other countries actually do police work and determine the cause of accidents. for instance out of 12 accidents they might find 12 different causes. over here we do no police work. we just throw people in jail. it is the worst excuse to not do police work. I was in an accident and my friend had had some drinks, but we were overseas, they figured out that the person in front of us threw on the brakes for no reason. over here my friend would be in jail
