Interesting how Rep. Smith talks about electing "presidents who will appoint Federal judges who do not legislate from the bench and who do not engage in judicial activism." You know he knows that Judge Walker was appointed by Ronald Reagan and then again by George H.W. Bush. But, you won't hear those who disagree with the Judge's (excellent) opinion in this case ever mention that fact!

IMPEACHMENT?? My god, Bryan. Is there no limit to your insanity? You wanna throw out a judge just because he overturned a discriminatory ballot initiative? Oh yeah, real "Christian." The sad thing is that many people actually agree with this guy. If he had said the same shit about the judges who decided Loving v. Virginia, people would be OUTRAGED, even most of his fellow conservatives.

But because it's gay people, conservatives think "Well, they've got nothing to bitch about."

@whoo689 You know, I am so fucking SICK of hearing that term "legislate from the bench." HELLO...? Judges have ALWAYS been activist to some extent. Sometimes it is bad and takes away liberty, but when it keeps people's liberties, I'm all for it. Besides, Republican judges can just as activist! Judges who thought Bush's war powers expansions from 2001-2009 I would refer to as pretty fucking activist. The Constitution never intended to make the president a dictator, esp. on war.

It's the great American tradition to use the federal court system for redress of grievances when the other 2 branches are fucking things up. It's called checks and balances. This "Let's be originalist all the time" nonsense is UNAMERICAN. Sometimes originalism works, and other times it's bad. This is NOT 1789! Or the 1820s.

judicial activism is a phrase used for a decision a judge makes when one does not agree a with it . this phrase was coined by right wing nuts when decisions, based on the constitution did not support the ignorance, intolerance and bigotry of those right wing nuts.

i really don't give a shit that one does not agree with that statement, it is the truth. problem is right wingers rarely like truth. they only like what they want regardless if it is constitutional nor not!

@wntoply6 I would argue that the term "judicial activism" is used to describe a judge who upholds the constitution while handing down progressive and helpful decisions.

And 2 things are hilarious here. 1. Walker is a "Conservative" judge. 2. Both Ronald Reagan AND George H. W. Bush appointed him.

At the core of this entire ordeal... at the backbone of it all... is religion. Spreading its divisive and hateful message via donations and political power.

It's sickening.

@Krumbz2003 thank you for that addition. it's heartening to see that most people of good will see through the veil so called "christians" use to hide their hate for the equality provided for in the united states constitution.

it's also heartening to see most americans don't buy the southern brand of "christianity" that still has it's roots in ignorance bigotry and intolerance.

hopefully even southerners will tire of this type of ignorance because of the alienation it labels them with.
