    The University of Texas receives funding from the state of Texas. Texas gets the money from the people, therefore it is PUBLIC property. What you say would be true for a PRIVATE institution. U.T. is NOT a private institution. Also, at this event, the Regents created "Color of Law" by stating that students had permission to be there but not the general public.

  • @rjj296 A federal law states any University that receives federal funding is public property and falls under federal laws. If UT receives federal funding they fall under that law and therefore broke federal laws.

If you know which one it is please let me know, I am interested to read it. On another note, as UT is a state institution, the rules set byt the Regents of the System are de facto State Law. Thus any rules concerning permission on campus is law. Additionally I have seen Current UT students receive Criminal Trespass Warnings and depart - like Mr. Bush should have.

  • @member5738 What I am saying is that anyone is free to say anything they want (granted it isn't inciting a riot or endangers public safety ie: yelling "Bomb!") on public property such as a sidewalk. The discussion here is if the University of Texas is considered such public property. The current interpretation of federal and state laws as well as the Rules set forth by The Board of Regents by the Courts of Travis County uphold the idea that the University is considered private property.

  • As UT is a public university, it is bound to the United States constitution and the first amendment. The state of Texas may not super cede the constitutional laws of the federal government. If UT was a private institution, than things would be different, because that would involve freedom of association laws.

  • Hmm, I think it depends on exactly what the grounds of the school are on and who owns those grounds, if the state owns these grounds than he has an argument but if it is a private university whose owners dont approve of his protest they could have him arrested because by definition it is private property.

  • @travelsonic Oh yeah, I agree. He was asked to leave several times and did not. This campus is considered private property, therefore they had the right to charge him with trespassing. I saw a recent interview with him. He now knows they were in the right and although he disagrees, he just wants to see if he can get his charges dropped. It's one of those "two sides to every story" things. He's a smart guy, he'll be okay.

  • As a news photographer myself, I have been arrested more than a couple times in violation of my 1st. amendment rights as well.

    This is nothing new, & unless you have a major news network behind you, your ass is grass.Even then it's no grantee that you will get support, as the major news outlets must as I had been told must protect themselves by keeping good relations with the police. "We don't have rights, we have privileges"

  • Lets get this straight, he was "arrested" for peacefully protesting in a public place, denying basis human rights assured to him in the 1st amendment. Oh wait they never seem to have read him his miranda rights so he was just detained. Why did this happen? Oh yeah, thats right Obama was in the area that day, I guess that makes it alright then.....

  • While I'm for free speech and the right to assemble peacefully the guy was told to leave campus grounds by a rep. of college to which he attends and while he did have a pres pass to be their. He being a student and being told to leave by a college rep superseded him being part of the press. But he could of easily avoided being arrested by taking his protest onto public property after being told to leave. As a student when he enrolled he agreed to follow school policies.
