Hate crimes need to be looked at as effecting more than the individual crime victim.
You tell by evidence. Did the killer yell out "fag" or "tranny" while harming a victim? Does the person have a blog that talks about wanting to harm "fags" or "trannies"?
If a white person is being beaten up specifically b/c he's white, then of course you prosecute it as a hate crime as well.
As for choice, there are hate crime laws that include veteran status, religious creed, and pregnancy in the protected classes. All of these are choice-based too -- hate is in the eye of the beholder.
