  • Long term checkpoints are COUNTERPRODUCTIVE to their "intended purpose" of catching illegals, and this checkpoint, with the hardcovered roof is definitely a long term thing.

    Any illegal is going to know where these checkpoints are and avoid them like the plague.

  • You should have just told them you were running AK47's to Mexico for the Sinaloa Drug Cartel. They would have rushed you right through and probably escorted you anywhere you wanted to go. VIVA LA GUNRUNNER!!! You have to love their policies: punish those who abide by the laws, and set the criminals free (or in the Feds cases, help them commit the crimes, and then send them on their merry way).

  • @plprz Actually, the U.S. military does allow non-citizens to serve in times of war. They use their service as means to show their dedication to this country, and to help expedite the process of getting their citizenship, but they are still technically not U.S. citizens. Also, there are some states that will issue drivers licenses and state I.D. cards to non-citizens, so, having an I.D. doesn't mean you're legal either. However, this man has given no reason to suspect that he is not a US citizen

  • The BP is allowed by law to stop everyone at an interior checkpoint, for the sole purpose of a BRIEF interview to determine whether the driver and passengers are lawfully in the country.

    The BP cannot legally detain someone (i.e., send them to secondary) after that brief interview unless it has reasonable suspicion of criminal activity.

    The BP cannot search a vehicle unless it has PROBABLE CAUSE to believe a crime is being committed or unless the person CONSENTS to a search.

    I hope you looked up some similiar videos here to see your options in this kind of situations. My advice don't talk to the police, BP, DHS, CIA etc. etc.

  • Well you see, if he would just do anything and everything they demanded of him without question there wouldn't have been any disagreement. Clearly this guy is a jerk for believing our society is based on reason and laws. Every citizen should be detained at least once a week just so the state and verify who they are and where they are going. -Many of you are too stupid to see I am being sarcastic.

  • Border Patrol should be required to record (audio and video) of all checkpoint contacts with the public in order to protect all parties involved. Texas Peace Officers record their activity, and communication during traffic stops, why isn't border patrol required to do the same? I would think that it would make dealing with complaints much easier.

  • Border Patrol has a JOB to do, I have gone thru many border crossing and NEVER encountered a problem,( I will roll down my window and am always polite) HOWEVER this guy is being a TOTAL JERK and then wants to act innocent, People like this need to be locked up for a few days

  • @brookster999brook you're missing the point about this whole situation. its not about giving the agent a hard time. its about not allowing them to give you a hard time. Ben Franklin stated something along these lines, Those who trade liberty for security deserve neither and lose both. where does one draw a line and stand up for it? do you allow the person to cross that line, then draw another and say "well, dont cross this one" ? no stand and stand firm, its our right to be left alone.

  • Troublemakers like this are usually a decoy to draw agents attention from the actual illegal vehicle crossing a few moments later at the same checkpoint. The only way to defend against this is the make an example of the decoy with the use of a blowtorch and a pair of pliers. The other decoys will see his scars later and will not volunteer anymore to be a decoy. Simple as pie.

  • To search you vehicle at a check point they need 1 of 3 things, Probable Cause, Consent or a Warrant. United States v Ortiz 4222 US 891, 95 S. Ct.285 (1975). You should file a formal complaint, as the purpose is to determine your citizenship and you were held too long and without cause. Your rights were violated. The FBI does investigate civil rights violation and if you reasearch the case law BP was wrong.

  • How unfortunate that this is happening. Thanks all of you who are bravely fighting this. I want to join the fight, but I'd probably just end up doing something stupid or giving up at the first sign of them preparing to whoop my ass. I have a question: Would it still be ok to get out of the car, but locking your car where they can't search it and if they ask to do a search, tell them no unless they have a warrant?
