This Amtrak train operates exteremely close to the U.S, / Mexican border where much illegal activity happens. Does this foolish man want to risk the dangers of what this areas bring just to have some mythical freedom which compromises protection against such illegal activity?

What I get from the video is a person educating train goers that it is perfectly legal to refuse search requests from DEA agents, which is a fact. After traveling from Albuquerque to Kansas City, the plain-clothes officers were using search dogs on passengers exiting the train. Not invasive unless you knew what they were doing - illegal searches.
One should never consent to a search without a warrant. When too many people give consent, then it makes any refusal that does happen appear to be an admission of guilt, and thus renders the Fourth Amendment moot.
By the way, I pay for everything with cash. It's easier. It has nothing to do with any crime.

You do NOT have to consent to a warrantless search without being arrested and an officer has to have probable cause to do that. WASHINGTON - A civil liberties group filed a lawsuit Friday seeking an injunction against the District of Columbia police department's vehicle checkpoint program, calling the "military-style" initiative unconstitutional and ineffective.
The gentlemen that got the present tore open and searched technically has every right to sue those responsible. And he should have gotten their names and taken them to court. And he would have won.

When I left the gate, heading towards immigration, there was a woman who told me to drop my backpack, and let a dirty dog smell my backpack. I had to open it because of osme imported cheese. What the heck ? Is that allowed ? I mean, yeah, I could bring the cheese into the country, but I refer can they just let a dirty dog smell my property, and search my bag ?

When you enter an airport, you are under a secure area, you can be searched without a warrant. You were searched in customs, not immigration and when you go through customs you may be searched. Try to videotape police officers who pull someone over. Most cops will tell you to turn it off, if you don't, even if you are standing out of the way, they say you're interfering with police business. "Wiretap" refers to just that, taping a phone and is regulated under Federal wiretap laws such as the Omni Bus Crime Act, Title 3 . This situation didn't occur in PA which recently enacted a State no-record the cops law (which hasn't been tested through the courts yet ). PA law is of no consequence where this ytube tape was shot. Just because someone was arrested doesn't mean the will be convicted.

One should never consent to a search without a warrant. When too many people give consent, then it makes any refusal that does happen appear to be an admission of guilt, and thus renders the Fourth Amendment moot.
By the way, I pay for everything with cash. It's easier. It has nothing to do with any crime.

I'm a 50+ white male Protestant. I wear my hair as short as I did when I was active duty in the Marine Corps. Married, 3 kids. Church member. I don't use drugs: hell, I don't even drink alcohol. I ride Amtrak regularly.
And I'd never-EVER-consent to a warrentless search by ANY cop. By denying permission to these DEA clowns to search my property, I'm upholding the greatest of conservative values: the right to be left alone and protection from arbitrary government intrusion.

The Founding Fathers were concerned about precedents set by authority.

It does not matter what good they may or may not do, law enforcement CAN NOT violate the Constitution. You do NOT have to consent to a warrantless search without being arrested and an officer has to have probable cause to do that. I determine from this most recent response that you are either a child, or you are working with limited mental faculties, I therefore end this tiff. How does it work at an airport ? I arrived back into the US after spending a week in amsterdam. When I left the gate, heading towards immigration, there was a woman who told me to drop my backpack, and let a dirty dog smell my backpack. I had to open it because of osme imported cheese. What the heck ? Is that allowed ? I mean, yeah, I could bring the cheese into the country, but I refer can they just let a dirty dog smell my property, and search my bag ?

but they couldn't find any weed, I did smoke weed in Amsterdam, but I also smoke here in SF. It's my Constitutional right. I don't want a dirty dog sniffing my bags.

I am terribly sorry sweetcheecks, but of all the wonderful freedoms provided by our Constitution the possession and use of illegal drugs is not a member. When you enter an airport, you are under a secure area, you can be searched without a warrant. You were searched in customs, not immigration and when you go through customs you may be searched. Especially coming from where marijuana is legal. It's also highly possible the dog was cleaner than you were. I find people like you very disturbing.

Try to videotape police officers who pull someone over. Most cops will tell you to turn it off, if you don't, even if you are standing out of the way, they say you're interfering with police business. Or arrest you for wiretapping laws that forbids audio recordings of any second party without their permission.

Personally I don't believe police officers have any right to privacy while they're performing a public duty. I agree you shouldn't go stand by them and get in the way but if we're videotaped by their dashboard cams they should be videotaped by citizens.

MA Attorney General Tom Reilly threatened Internet activist Mary T. Jean with arrest and felony prosecution for posting a video of state police swarming a home and arresting a man without a warrant.
Michael Gannon of New Hampshire was also arrested on felony wiretapping charges in 2006 after recording a police officer who was being verbally abusive on his doorstep.
Photojournalist Carlos Miller was arrested in February of 2007 after taking pictures of on-duty police officers in Miami.

You are calling recording a in person conversation Wiretap, that is and never was covered under Federal wiretap laws. Officials and police threaten all sorts of stuff. Recently I was told by 4 officers that I would be arrested if I "failed to comply" I laughed and walked away. Don't be bullied out of your rights. An arrest is nothing I have been arrested for exercising my constitutionally protected rights twice. No convictions, two small cash settlements. Police are totally ignorant of law.

I'm not sure you know what you're talking about. Just look up Brian Kelly of Carlisle, Pa. Kelly was charged with a felony, spent 26 hours in jail, and faces up to 10 years in prison. All for merely recording a police officer, a public servant, while he was on the job.

"Wiretap" refers to just that, taping a phone and is regulated under Federal wiretap laws such as the Omni Bus Crime Act, Title 3 . This situation didn't occur in PA which recently enacted a State no-record the cops law (which hasn't been tested through the courts yet ). PA law is of no consequence where this ytube tape was shot. Just because someone was arrested doesn't mean the will be convicted.
