Posse Comitatus does not apply to National Guard troops as they are not active military. They are state troops that have to be militarized to be used in combat overseas. Also the US military can be used to fight foreign and domestic enemies on it's home soil.

Active Duty Military was prohibited from policing functions within the borders of the US. Only civilian police and National Guard can perform police functions. The National Guard can only do it during a state of emergency. The Posse Act was enacted because of the abuses of the Union Army in South after the Civil War.
