Your comment is highly rated, but completely false. Grant WAS resisting arrest. That did not cause Mehserle to "accidentally fire", it caused him to decide to tase Grant. He pulled the wrong weapon as has happened to no less than 8 other officers, which is why most departments have a policy to place it in a position to have to cross-draw the taser. BART had no such policy, Mehserle had it on the same side as his firearm. Most officers get 40 hours or so of taser training, Mehserle had 8.

So there were not 2 officers restraining Grant. Pirone was partially restraining him, and Mehserle was trying to cuff him.

Apparently they may have cuffed him afterwards until he was seacrhed, there is conflicting info on that.

To many posters: No state I am aware of has made it a crime to video tape cops. SOME states have a wiretap law that prevents an audio recording without consent of the person being recorded, but this was never intended to include public officials or anyone in a public place where they would have no reasonable expectation of privacy. Most competent judges have struck down any attempt to use wiretap laws against those filming police, since Police use dashcam video with audio regardless of consent.

He had not been searched yet, so they had no way to know he was unarmed. As far as the other officers, Pirone was helping with Grant while also restraining the friend to Grant's left, the remainder of the cops were trying to prevent the 10-12 people encroaching on the scene from interfering.

Your comment is highly rated, but completely false. Grant WAS resisting arrest. That did not cause Mehserle to "accidentally fire", it caused him to decide to tase Grant. He pulled the wrong weapon as has happened to no less than 8 other officers, which is why most departments have a policy to place it in a position to have to cross-draw the taser. BART had no such policy, Mehserle had it on the same side as his firearm. Most officers get 40 hours or so of taser training, Mehserle had 8.

2) There were not 2 officers "restraining" Grant. Mehserle was trying to cuff him and Pirone was kneeling on him while ALSO restraining one of Grant's friends (who was hostile from the start)
3) Grant assaulted 2 cops & had not been searched. Since Grant managed to hold them off from cuffing for 30 seconds, obviously he could put up ENOUGH of a fight to resist arrest!

He was not handcuffed, and that is a fact. As I stated, Mehserle was trying to cuff him (since he was NOT cuffed) and Pirone was kneeling on his neck while also containing Grant's friend. So there were not 2 officers restraining Grant. Pirone was partially restraining him, and Mehserle was trying to cuff him.

The reason Pirone apprached him (and got kneed in the groin) was because Grant violently grabbed officer Domenici by the arm, which he could not do if cuffed. About half way through "Oscar Grant knees BART officer Tony Pirone in the groin" you see far back enough to see him grab the officer by the arm. Apparently they may have cuffed him afterwards until he was seacrhed, there is conflicting info on that.

SOME states have a wiretap law that prevents an audio recording without consent of the person being recorded, but this was never intended to include public officials or anyone in a public place where they would have no reasonable expectation of privacy. Most competent judges have struck down any attempt to use wiretap laws against those filming police, since Police use dashcam video with audio regardless of consent.

@atouchofmagic1988 I can see your point. my problem is not with the police. It's with the system. There is nothing in place to keep the cops in check. Now I've heard the law makers are trying to make it illegal to film cops. with nothing in place make them accountable and the fact that power corrupts, what's to stop things like this happening all the time?

@atouchofmagic1988 I still think it is criminal negligence, and absolutely he deserves prison time. Lots of times people think I am trying to defend the cop. I absolutely am not defending the cops actions. What happened is still a crime and he deserves to be punished for it, but it was not a deliberate act, an execution, a murder, or racially motivated. It was a dumbass cop who accidentally shot a dumbass career criminal. Now two families are destroyed. It sucks all around.

this guy is pathetic. he wasnt shot in the back, it was in the side, the autopsy revealed that.And he wasnt hancuffed. he only had one hand cuffed, and the other was on his front side and HE was resisting arrest so the officer meant to taze him

@abeedelaa Actually, he was shot in the back. He was shot in a completely non-vital area of the back (where one would fire a taser). The bullet ricocheted off of the floor and exited through Grant's lung. This is further indication he had no intention to draw his gun, ricochet could have easily killed himself, other officers of people on the train. Absolutely he meant to tase him. Still, criminally negligent and worthy of prison time in my opinion.

I really wish these lying bastards, The Young Turkeys, would come forward and make some retraction since Grant WAS NOT HANDCUFFED. This was proven to be an accidental shooting, yet these morons let this video stand as is? You should be ashamed of yourselves. And yes, everyone knew why he was in Nevada, his family lived there. He informed the police of his whereabouts, they knew right where to pick him up.

@ssn708: The video sure made it look like he was hancuffed. But, either way, the cop showed criminal negligence that cost a life. He deserved more than two years. Hell, I did longer than that for $40 worth of grass. Not to mention the SWAT team, concussion grenades, semi-automatic weapons, and 30 guys milling about in my living room for 6 hours. Later, I asked one of the cops (we'd gone to high school together) why they used such a big hammer on such a small fly. "Overtime", he said.

@louiswu2 I agree that Mehserle deserves prison time for his criminal negligence, that has been my position all along. But I do not think he deserves any more time than the average drunk driver who kills someone, less even because choosing to drink and drive is far more intentional than accidentally drawing the wrong weapon. There are serious abuses in the police department, that is undeniable. But those making this something it is not only detracts from the real problems.

@ssn708: There's still some question in my own mind as to how he could have possibly mistaken a firearm for a taser. You and I may disagree on the magnitude and consequences of taking a human life, even in error. Those in law enforcement have a lot of power and discretion, and so the sanctions for ineptitude or malice should be severe.
