  • This is BS, but I do not care much about the people in Government housing though I do not think they should be able to be searched at the whim of Government.

These legal aid people are well-meaning but typically use extreme example of how a good law CAN be used to hurt innocent people in extreme, not-likely-to-happen circumstances. I patrol the projects. Most people who live there are law abiding and just can't afford anything better. The One Strike Law protects THEIR right to live in peace, to be able to walk to and from their cars without having to wade through a gaggle of dope-dealing thugs.

  • Hearing the government housing put that way, it is simply guilty by association. Guilty without a trial. Our political system is so far off its foundation, gov should be required to present a warrant even if they have consent. This way the individual knows what the police are looking for. No warrant, no search.

    What I want to see is USA citizens as independent as possible, while also able to function in groups to help others when needed.

You want the govt to intrude even further into people's lives than it already does, and then you go on to claim you want to see citizens act independently. Which one is it? They are opposing views. Pick one and go with it.

  • I was commenting on YOUR statement that "gov should be required to present a warrant even if they have consent." In other words, govt should be trusted with that decision over the adult who resides at the property? I applaud efforts to educate citizens as to their right to refuse warrantless searches but that's as far as it should go. We don't need the govt to intrude in the process any further than they already do. And perhaps you should explain your distinction between "cop" and "officer"?

  • Growing up, a Police Officer was one who enforced the law. A cop, though both wore the same uniform, usually (miss)interpreted the laws to provide for entrapment and to coerce the subject.

    Police, with or without a warrant, ARE the government. For the gov/police to search, there MUST be a warrant stating the object and the place of the search. Thus protecting citizen privacy. Neighbor complaints are not cause enough for a warrant-less search.

    Often, consenting to search reduces protection.

  • Simply put, a crime is any violation of a criminal code. You don't have to like the fact that possession of a controlled substance is a crime, you can even lobby to change the law, but no individual has the right to make up his own laws. Is possession of a controlled substance as SERIOUS of a crime as robbery or murder? Of course not. But it is still a violation of the criminal code and therefore a CRIME. To deny that is foolish.

  • Yes, presently adult resident can grant warrant-less police searches, often to their detriment.

    Warrant-less searches allow open-ended searches by the Police to search more areas then might be granted had a warrant been issued. Such searches subject the residents to possible criminal charges they are not aware of. With a warrant, the scope of the search is restricted and the items and people to be searched or seized are restricted by law; Not so in warrant-less searches.

Need I remind you that the original text of the 4th amendment to the U.S. Constitution did not discriminate by consent, but required a court warrant for all searches and seizures?

  • This will likely fall on deaf ears given your obvious hatred of law enforcement, but read the 4th Ammendment and cite, specifically (quote it for me if you will) the part that requires a warrant for all searches. The 4th Ammenment provides protection against UNREASONABLE search/seizure. If an adult who is responsible for the area to be searched gives consent, no warrant is required. My only point is that the govt taking away an adult's RIGHT to grant consent is intrusion into that adult's life.

So to answer your question: yes, you DO need to remind me where it says a warrant is required for ALL searches and seizures.

  • Hm? Look at your own quotation. "... and no warrants shall issue, but upon probable cause" Probable cause is a requirement for the issue of the warrant, not a warrantless search. It goes on to require a specific place to be named (not a full search of a person or vehicle) and what is to be seized. Never is consent mentioned. Supreme Court rulings by conservative justices with an authoritarian lean and unconstitutional laws passed by congress made things he way they are today.

    You are a law enforcement officer; you enforce just and unjust laws alike. In fact, cops prefer to enforce easier laws, such as drug laws. It's easier to bust a kid with a baggie or ticket a speeder than it is to bring a murderer to justice. When called on this, you say "the law is the law" because that's all you care about.

  • I had worried about my comments falling on deaf ears and it turns out my concern was justified. You say the 4th ammendment REQUIRES warrants for all searches and then fail to show evidence of that. All you have shown is that for searches that DO require warrants, police need probable cause. You have not addressed the topic at all, that of searches that do NOT require warrants. If you feel better thinking you have "defeated" me, so be it. I'm not one to stand in the way of someone feeling good.

  • Lets say they search and granny has a pill from a friend and don't have a prescription they can charge her with a crime and she is gone.

    If you are in public housing save some money get a piece of land where you can build your own home you can build a house for very little money and some hard work. Look in my favorites there are many examples of homes you can build that are near disaster proof. Who needs the housing authority if you provide your own.
