True he could vote against the democrats on several issues but if he voting to spite either party he should not be in office at all (and at next vote his career is over).

The fact is that the dems do not have 60 votes anyway and 56 votes are worth no less then 57 votes or 58 votes because its still less then 60 yet still a majority.
