  • Idk if any of you have ever had to deal with Vacaville police, but they suck. They try to be parents to the people of Vacaville and talk down to all of us, as for this officer my dad and i had a run in with him. Yea when a high school student cut my dad off in front of vhs a long time ago, my dad had to swerve to dodge it, officer love poped up and said he was going to write my dad a 200 dollar ticket for being 2inches over the yellow line. Police are good, vacaville police aren't.

  • @thebeast, Have you ever heard of any cop writing a ticket because the seatbelt you're wearing isn't the right color, or made of the right material? Of course not. That's one of the main differences in those 2 laws. Another is that you can't get an exemption from the helmet law, while the law allows medical exemptions from seatbelts (CVC 27315 (g)). But thanks for your uneducated try. Woot woot.

  • Ok, so this was uploaded almost two years ago. What was the outcome? What happened when it went to court?

  • @screamineagle88 , Not every question of law is answered as fast as most traffic tickets. The trial took 2 days; it happened in October 2009 - the Judge made about 4 seperate serious errors; the appeal was in summer of 2010. The appeal was denied. There are 2 more "actions" that are pending in this case, even though 999 of 1000 people would have said it's over. I have been to Vacaville many times and cops don't seem to want to write a ticket on any of the helmets in question.

    We are aware of the Civil Rights violations by many police departments, and the reason the CHP changed its policy in 2009 is they finally got tired of being sued by BOLT. The next suit is planned, we are just picking the target - or shall I say the target is playing Prairie Dog. Vacaville has already showed it wants or needs to be on the list of PDs that will go to court. PDs can choose to avoid violating rider's Rights by policy - or get sued.

Why does suing cops work? Real Judges (not traffic court) tell cops to obey the law, too.

    So far there are no riders crying. The citing officer (Aaron Love) was taken off the most coveted job in a police force; the motorcycle. He was off the bike for several months.

    He may have cried over that, but I don't know for sure.

  • The importance of knowing and preserving our Rights is paramount. Most of the people posting here understand that a citizen's Rights are more important than a cop's authority. Legally, for the officer to do it the right way, he would have noticed the manufacturer's certification of compliance (DOT symbol) on the product, then allowed the riders to go without a ticket. The DOT symbol is not approval by a government agency, but put there by the manufacturer, and is "the presumption of compliance."

The helmets in the video whether a DOT sticker was put on them or not, they are not DOT certified. The summonses issued are legit. You might as well wear no helmet at all, or just wear your favorite baseball hat with a DOT sticker slapped on it. When you go to court, you can just say it came with the sticker, you thought it was legal. That's an invalid defense.

  • I'm so glad I found this video, I live in Vacaville am 24 years old and as a Teenager I rode my bike around town every day, officer love gave me over 20-30 helmet tickets all which I had to go to court for, I always wore a helmet and he would ticket me for not having it buckled correctly. I really appreciate what you guys are doing, real patriotic and I applaud your team for this. Thank you.

It is evidence of your Rights being violated, the cop violating the Injunction, & the cop and VPD violating restrictions placed on them by case law ( published court rulings).   • @BOLTofCalifornia @BOLTofCalifornia @BOLTofCalifornia The cop has the right to ask more questions and to "intrude" further with his common law right of inquiry as the courts call it, because of the founded suspicion of a violation commited (unapproved helmet). You may get away with refusing, but the cop may also articulate that as not complying in recieving the summons. Same as if you refuse to give your license over, or any other form of non-compliance. You can be arrested 4 just a VTLviolation

He also was violating restrictions placed on him in case law. Police do not get to choose which court rulings they follow or ignore. Court rulings can have as much authority as statutes. We actually "allowed" the cop to say things because we were conversing with him. Have you written any helmet tickets?

  • I ride a Harley, I live in a state where there is a helmet law, and I wear a helmet. I think that it shouldn't be the law, but it is. If I were so motivated to fight against it, I would contact my local state congressman with my view and go from there. I wouldn't expect to get anywhere by provoking the police and trying to call them out for doing their job.     The Dept of Transportation says that Dept of Transportation approved helmets don't exist. The federal government doesn't approve helmets (neither does the state). Go to boltofca.com/LegalDetails.html for links to 16 letters written by the federal government. All (written by the DOT) state that the Certification (DOT symbol) is not approval, but the manufacturer's statement that, if their product were tested, they believe it would pass the tests.     If violating citizen's Rights is the cop's jub, then the officer just did his job. There's written appellate court rulings that changes what cops are allowed to do. These cops were ignorant and unfamiliar with the case law. A federal Judge in 1995 spelled out that this type of enforcement is a Civil Rights violation. Forget the cop's attitude. It never bothered me. We see Rights violations as disgusting.

  • On October 26, 2010, the conviction was upheld on appeal. The appellate court agreed with the trial judge that the helmet did not comply with the helmet law.

    Case law in California says the statute is "constituional," IF the law is enforced right. The video is a stark example of unconstitutional enforcement. Why else has the CHP all but stopped writing tickets for "illegal helmet"? CHP policy is (as of 2009) helmet tickets are fix-it tickets unless there is nothing on your head at all. If he had the authority to begin the legal process he started, he would not have changed from the upbeat, chipper smart-a_ _ at the beginning of the video to the quiet, worried cop sweating whether he made a mistake on camera, near the end of the tape. It's amazing how many cops know so little about law.

  • FYI, the verdict in traffic court can be meaningless - either guilty or not guilty.

    A "not guilty" verdict does not prevent the cop from making the same mistake again. A "guilty" verdict can open a door, in a legal sense.

  • What a couple of 100% idiots. Whatever happens to them they deserve it. I am a biker and have rode all makes and styles for almost 50 years now. When required I wear a DOT helmet. When it is not, I sometimes don't . But at all times I don't attempt to stir up trouble for no reason. These two knowingly rode in with an unapproved helmet, and received what they expected.

    If you need a hand learning how procedural rules work, or how cops must change their behavior after a court ruling says they are violating a citizen's Rights, there are ways to educate yourself.

    3. Cops aren't paid to enforce their imagination, they're paid to enforce the law. (read CVC 27803 yourself, if you can. It may be tricky, there are capital letters and punctuation in there, so ask for help if you need it.)

    3. The total is $172.00 but does it matter to you? You seem to like paying fines you don't have to pay. Pay as much and as often as you like.

  • In my opinion, Vacaville Police is one of the most overpaid, overcompensated police departments in the US.

    If you ask around in this city, you will find good standing citizens who have been abused and bullied by VPD -just because they have the power to do so.

    Personally I have never seen any benefit coming from the large funding wasted by hiring bullies who become very unprofessional cops.

    Sadly, many of these cops would not last a month in real cop jobs, facing real criminals.

  • So whats the point of BOLT? Seems this helmet issue is all about how to cheat or short cut the law. If it was just the biker (w/lame helmet)alone in an accident that suffers head/spinal injuires without others involved, then run yourself into your own wall. Dont assume the law revolves around just you. Im pretty tired of health bills trying to be passed due to high medical/property insurance. I do my VERY best when I'm on the road and dont think its fair when one knowingly wears crap for a hat.

But I'm glad you addressed and cleared up everything about everyone else on the road having to pay extra attention, taxes and premiums. My brother had a mishap on I-101, I'm glad his helmet had sides. You do well with the name calling too. That should really fix everything. I did read previous posts, thus my opinion.

  • If it is his job to violate my 4th Amendment Right and my 14th Amendment Right, and his job to conduct a False Arrest for writing a Notice To Appear without first having Probable Cause, then he has done his job. It doesn't mean the WW2 soldeirs who heaped personal atrocities on human beings are blameless, just because they were doing what they were told. His job, it seems, is to collect $172.00 from riders based on imaginary unwritten standards. That violates Case Law.
