Idk if any of you have ever had to deal with Vacaville police, but they suck. They try to be parents to the people of Vacaville and talk down to all of us, as for this officer my dad and i had a run in with him. Yea when a high school student cut my dad off in front of vhs a long time ago, my dad had to swerve to dodge it, officer love poped up and said he was going to write my dad a 200 dollar ticket for being 2inches over the yellow line. Police are good, vacaville police aren't.
You know, I'm all about maintaining your rights against bullying cops, but I seriously find it amusing that people would do so while wearing those ridiculous skull caps you call for a helmet.
"When they realize they can't fool you." You're obviously a fool for assuming they need a warrant for that. You're also a fool if you think you can survive a crash by wearing a thong on your head. You've obviously been to law school as well, if you know how to tell the police how to do their job, and understand their documentation more than they do. Go educate yourself, you hick.
@thebeast, Have you ever heard of any cop writing a ticket because the seatbelt you're wearing isn't the right color, or made of the right material? Of course not. That's one of the main differences in those 2 laws. Another is that you can't get an exemption from the helmet law, while the law allows medical exemptions from seatbelts (CVC 27315 (g)). But thanks for your uneducated try. Woot woot.
Your just jerks... You'll talk all this crap about them and then when you get in trouble at home or get into an accendent guess who is there...? The police!
If you do call the police, you want one that values your Constitutional Rights. Personally, I don't talk crap about them, I call out the behavior that is contrary to the job he swore an oath to do. The price of Liberty is eternal vigilance.
You sound just brilliant, but what does your comment have to do with the protection of your individual Rights, so government does not become more like the master and you the slave?
@MarkVFWS Excellent choice of words for your unfortunate nephew.

@screamineagle88 , Not every question of law is answered as fast as most traffic tickets. The trial took 2 days; it happened in October 2009 - the Judge made about 4 seperate serious errors; the appeal was in summer of 2010. The appeal was denied. There are 2 more "actions" that are pending in this case, even though 999 of 1000 people would have said it's over. I have been to Vacaville many times and cops don't seem to want to write a ticket on any of the helmets in question.
We are aware of the Civil Rights violations by many police departments, and the reason the CHP changed its policy in 2009 is they finally got tired of being sued by BOLT. The next suit is planned, we are just picking the target - or shall I say the target is playing Prairie Dog. Vacaville has already showed it wants or needs to be on the list of PDs that will go to court. PDs can choose to avoid violating rider's Rights by policy - or get sued.
@screamineagle88 Go to BOLTof CA.com to find the new CHP helmet enforcement policy that (is pretty close to proper and legal enforcement) views helmet law violations as very difficult to write because it's almost impossible to develop probable cause; it agrees with state law that helmet violations are fix-it tickets, unless the rider has nothing on his head he is claiming is a helmet. Why does suing cops work? Real Judges (not traffic court) tell cops to obey the law, too.
to me the helmet law is just another way that the government is telling us how to live, taking our "FREEDOM OF CHOICE". They think that they know what is better for us, what gives them the right to take away my choice. Im totally against all of these new laws that chip away my freedom.
@trllns - But if you learn what to do to back the unconstitutional cop off of you, you will have less to worry about. Open carry your firearm. Excercise all your Rights. If you dont, and they train you to blindly obey the unauthorized order you have surrendered your Right without a whimper. What many who commented on this page don't see is that this isn't about helmets, it is about refusing to follow "orders under color of law." Don't Tread On Me.
All corrupt cops and cops that ignore the constitutional Rights of others are Bad Cops. But when The People think their government servants suck, it is because We The People let the servant get away with it for too long. Shame on us. Thomas Jefferson said "The enemies of the People are criminals and government. So let us put the chains of the constitution on the second, so it does not become the legalized version of the first."
@crazykeith1087 you think this is bad go to Lodi! All of Lodi's police have John Wayne syndrome. As far as motorcycle cops go from what I know they all suck, over paid meter maids, with too much power! Sooner or later we will have to ride wrapped in bubble wrap!
So far there are no riders crying. The citing officer (Aaron Love) was taken off the most coveted job in a police force; the motorcycle. He was off the bike for several months.
He may have cried over that, but I don't know for sure.
The importance of knowing and preserving our Rights is paramount. Most of the people posting here understand that a citizen's Rights are more important than a cop's authority. Legally, for the officer to do it the right way, he would have noticed the manufacturer's certification of compliance (DOT symbol) on the product, then allowed the riders to go without a ticket. The DOT symbol is not approval by a government agency, but put there by the manufacturer, and is "the presumption of compliance."
@BOLTofCalifornia So you're saying that you can put a DOT sticker on anything you want, and that makes it legal? The helmets in the video whether a DOT sticker was put on them or not, they are not DOT certified. The summonses issued are legit. You might as well wear no helmet at all, or just wear your favorite baseball hat with a DOT sticker slapped on it. When you go to court, you can just say it came with the sticker, you thought it was legal. That's an invalid defense.
@yankeed1 - You have made claims, such as, "you can just say it came with the sticker, you thought it was legal. That's an invalid defense."
Cite your legal sources for this claim. Either the case law, or the statute. I can reply with case law and/or statute that will prove that statement wrong. If you read everything below you will find I already have cited this.
I'm so glad I found this video, I live in Vacaville am 24 years old and as a Teenager I rode my bike around town every day, officer love gave me over 20-30 helmet tickets all which I had to go to court for, I always wore a helmet and he would ticket me for not having it buckled correctly. I really appreciate what you guys are doing, real patriotic and I applaud your team for this. Thank you.
You are welcome. Thanks for sharing your experiences. Do you still have any of those tickets?
They are evidence that should be scanned and emailed to BOLT of California. Anybody you know that has or had a helmet ticket - we need to see those. It is evidence of your Rights being violated, the cop violating the Injunction, & the cop and VPD violating restrictions placed on them by case law ( published court rulings). Find those tickets and tell your friends, too. boltofca.com
@BOLTofCalifornia@BOLTofCalifornia@BOLTofCalifornia The cop has the right to ask more questions and to "intrude" further with his common law right of inquiry as the courts call it, because of the founded suspicion of a violation commited (unapproved helmet). You may get away with refusing, but the cop may also articulate that as not complying in recieving the summons. Same as if you refuse to give your license over, or any other form of non-compliance. You can be arrested 4 just a VTLviolation
This was not the typical way a person could react when an officer is violating the elements of an Injunction, as this Vacaville cop did, along with his "supervisor." He also was violating restrictions placed on him in case law. Police do not get to choose which court rulings they follow or ignore. Court rulings can have as much authority as statutes. We actually "allowed" the cop to say things because we were conversing with him. Have you written any helmet tickets?
It's a bit odd that this cop apparently spends so much time harrassing people for wearing so-called 'unsafe' helmets as opposed to, you know, preventing something that is going to bring harm to numerous people other than the individual who is 'at wrong'... Even hanging out on the corner of a particular bad area would probably prevent more harm to a greater number of people...
Sounds like Officer Love is a crap cop, and has been assigned these crappy jobs... then takes photos of his conquests
those guys work office jobs, drive toyota prius' to work, and keep their bikes in their garage only to come out on the weekends in warm sunny weather. mid-life crisis biker posers that think they know something. lol ahh, alright. i'm done. lol
Not one owns a foreign vehicle, and one hasn't sat in a Japanese vehicle in 12 years.
They, including the videographer, ride unless 4 wheels is necessary.
Many police recently think they are above the law instead of servants to the law and the public. This video demonstrated that. The surprise is the arresting officer didn't violate his oath further, as he has a record of doing. Your bias, yankeed, is against Rights.
i don't know why they tolerated that much from them. it's at the point watching this that i feel an anger that there are cops out there in other places in this country that tolerate that level of lack of respect and remain that courteous and professional. it makes it more annoying when those liberal fags posing as bikers go other places outside of liberal pussified suburbia california and expect that kind of tolerance from the police.
an area where there isn't much crime, and they aren't as experienced with dealing with that many people. there are a great number of things those cops could have done to those guys, and been able to ARTICULATE, but they didn't they are just banging out a couple summonses they are required to to a couple people that are in fact in violation of what they're writing them for. here, both of those faggots would have been eating pavement in under 2 minutes, with at least 3 charges and confiscatedbikes
wearing a safety helmet" means having a safety helmet meeting the requirements of Section 27802 on the person's head that is fastened with the helmet straps...
CVC 27802 pertinent part:
...the requirements imposed by Federal Motor Vehicle Safety Standard No. 218 (49 C.F.R. Sec. 571.218)....
Have you seen the requirements imposed by FMVSS 218 ?
Has nothing particular to do with helmet's looks, rather actual testing of it.
i fucking hate morons like these two.... you want to ride a bike the right way? well, follow the law and if you make a mistake admit it.... and stop fucking acting like two little fucking wimps... next time buy yourselves real helmets and you wont get into trouble like that.... fucking tards....
I ride a Harley, I live in a state where there is a helmet law, and I wear a helmet. I think that it shouldn't be the law, but it is. If I were so motivated to fight against it, I would contact my local state congressman with my view and go from there. I wouldn't expect to get anywhere by provoking the police and trying to call them out for doing their job. These guys are fucking morons, and that one dipshit's helmet doing most of the talking looks like a jew beanie. Shoulda just got locked up
Penal Code in California does not authorize the police to jail someone for an infraction.
That's why no one went to jail. You didn't know officer Love was lying (or bluffing)? The police can only do what they're authorized to do - if you are short on book-learnin' you will end up doing what you don't have to do.
I didn't give up my lunch money to the bully in grade school.
Knowledge is power. Name calling is something completely different.
@BOLTofCalifornia lol, you quote somebody else with "knowledge is power", yet you say "book learnin". you can read all the books in the world, but you can't learn common sense as is the case with the motorcycle enthusiasts in this video (they just seem too liberal to mix the word biker with them). if you had any common sense, you would realize that drawing negative attention to yourself with the police for no reason is an arrest waiting to happen. i may work in a different state, but the laws in
@BOLTofCalifornia laws in all the states are very similar, just with various terminology and wording. the police officer there was excessively tolerant, and nice. i imagine it seemed like a nice day and he didn't want to waste the next couple hours processing that liberal dumb ass. he could have been locked up. you say that you can't be locked up for a traffic infraction, that is correct, but you can and will if you fail to cooperate in the issuance of that summons.. ie. not giving license,
@BOLTofCalifornia or insurance, registration, failure to allow the police officer to inspect the helmet which is required by law. if you don't have it, you don't have it. but if you REFUSE, then you are in the arena of disorderly conduct. a violation, which can be a summons or arrestable. if your buddy chimes in with the cameras and trying to give the op a hard time in doing his job during the stop.. it is OGA a misdemeanor (obstructing governmental administration). these cops appear to work in
You are persistant, but consistantly wrong. I appreciate your tenacity.
The police can inspect anything they can see. If he wants to inspect your trunk, he needs a warrant. Are you nice if you let the cop inspect without a warrant anyway, or are you a fool?
Most lawyers say don't talk to cops or answer questions without an attorney present. You can do it anyway if you want, but at your own risk. Cops and Judges never make mistakes? hehehe Right....
@BOLTofCalifornia What am I wrong about Einstein? What does the warrant nonsense have anything to do with this? That liberal blabbering from all that non-conformist anti-order brain washing doesn't have anything to do with what my statement is about. He recieved a ticket for his helmet. He is on a public street and bound by VTL while exercising his privileges of his license. The unapproved helmet is in plain view. He was cited for it. End of story for the summons...
The rider is an idiot. He is trying to create issues instead of following the law.
When you go looking for a confrontation and you get it, you get what you deserve. I guarantee that he did not get out of the fine.
"I am not sure such an animal exists"...can that guy read? Does he live in a cave? What a freaking idiot.
This is evidence that you can keep your mouth shut and have people wonder if you are an idiot or you can open your mouth and prove that you are an idiot.
The Dept of Transportation says that Dept of Transportation approved helmets don't exist. The federal government doesn't approve helmets (neither does the state). Go to boltofca.com/LegalDetails.html for links to 16 letters written by the federal government. All (written by the DOT) state that the Certification (DOT symbol) is not approval, but the manufacturer's statement that, if their product were tested, they believe it would pass the tests. You can read, right?
yea that ass hole pulled me over a few days ago for "speeding on the highway" even though i was in danger of being killed by another crazy driver that forced me to drive fast to avoid being hurt. i tried telling him but he said he only said he saw me. he also was yelling at me saying he would take me to jail if i "lied" to him and not even letting me finish explaining myself and gave me a ticket for going 90+ he said "i gonna be somewhat nice to me, oh AND HE ALSO CALLED ME A ASSHOLE!! fuck him!

VACVILLE PIGS ARE THE WORST EVER! Think there hard & act hella tough. but aint shit. call for backup for jaywalkers & vandals! their bitch ass pussies! always searching & harrasing illegally cuz they feel like it!
Im all for getting rid of the helmet law but these guys were being dicks to an officer that was just doing his job. dont shoot the messenger assholes there are dick cops but these guys were not.
If violating citizen's Rights is the cop's jub, then the officer just did his job. There's written appellate court rulings that changes what cops are allowed to do. These cops were ignorant and unfamiliar with the case law. A federal Judge in 1995 spelled out that this type of enforcement is a Civil Rights violation. Forget the cop's attitude. It never bothered me. We see Rights violations as disgusting.
@NCKing589 They are ABSOLUTELY WORTHLESS helmets! Might as well strap an upsidedown teacup on your head! Wearing something like that is just begging to be pulled over.
@NCKing589 I actually am against helmet laws and seat belt laws, but I would use them even if there was no law, (most of the time at least). Anytime a group of 'lawmakers' passes very few laws during one of their sessions or years it is a good thing!
On October 26, 2010, the conviction was upheld on appeal. The appellate court agreed with the trial judge that the helmet did not comply with the helmet law.
As many Vacaville citizen's comments here show, there is an appearance of systemic corruption in Solano County. You are correct, the conviction was upheld, but not for the reason you state. The appellate court did not state that the helmet did not comply. The original trial court did, and the Title 49 federal regulation clearly does not authorize the cop, the traffic Judge, or an appellate court to "determine" compliance. Thanks for following this, but be more accurate, please.
Read the following language from the Appellate Court's decision, illistrating the Appellate Court's agreement with the trial court's determination that the helmet did not comply:
"(T)he headgear worn by Mr. Temple and pictured in the record strongly supports the (trial) Court's determination that it fails in the required coverage and construction required in the CFR". Decision on Appeal, p. 8, lines 7-9.
OMG, what do you do when the traffic court and his drinking buddy in the traffic appeal court both violate the case law and federal injunction by, as the federal Judge said, "acting in concert" with the officer to violate the riders Rights?
Do you think Solano County violates Rights on purpose or by accident?
calif has to many laws here in florida we dont have helmet laws. no cell phone laws and a lot more freedom. to pass a law here in florida it must pass a public poll first
vacaville pd is a joke if i ever saw one. i still am dealing with issues caused by them when i was 13 years old and they assaulted me and my friend during a false arrest. i ended up catching two felonies for making a joke. VPD just doing their so called jobs.
I'm missing something on the translation. he writes a ticket for not having a DOT approved helmet. but never inspects it? then after writing the ticket, he wants to see it.
I know what he is up to, he wants to take a picture of the inside to prove it, after the fact! I would have the ticket moved to the county court house. then if he shows up postpone it, till he doesn't. my lawyer does it all the time.
Unless the "order" does not have the force of law, or legal authority.
Google "order under color of law."
Case law in California says the statute is "constituional," IF the law is enforced right. The video is a stark example of unconstitutional enforcement. Why else has the CHP all but stopped writing tickets for "illegal helmet"? CHP policy is (as of 2009) helmet tickets are fix-it tickets unless there is nothing on your head at all. It can be found at boltofca.com
vacaville and fairfeild cops are both crooked they also do illegal speed traps. but when u go to trial and start quoting CA VC 40802. they drop it like its hot. and the case is droped. but how many folks got screwed by not knowing about 40802?? this is why i wont drive in that county. CROOKED COPS!
In all honesty though, that's not how you talk to cops when you think you're innocent. Why? Because, being a smart ass really doesn't help the situation out.
@didi0014 That's how I talk to a cop who has a reputation for giving the finger to the law he has given an oath to uphold. If he had the authority to begin the legal process he started, he would not have changed from the upbeat, chipper smart-a_ _ at the beginning of the video to the quiet, worried cop sweating whether he made a mistake on camera, near the end of the tape. It's amazing how many cops know so little about law.
Ill tell you what happened. I did some research. This fucking idiot went to court and presented evidence he was wearing an illegal helmet and told the court he did just that. The bottom line is if youre gonna fight the law, be prepared. If youre gonna act like a tool, just like you did on the street, be ready to be found GUILTY. Jackass HaHaHa.
You said he "...presented evidence he was wearing an illegal helmet and told the court he did just that"
Wrong. I have the transcript. He did the opposite. You must have done your research in the newspaper. The article was written by a guy that must have slept through half the trial and avoided an interview w/ the rider. Got alot wrong.
What a couple of 100% idiots. Whatever happens to them they deserve it. I am a biker and have rode all makes and styles for almost 50 years now. When required I wear a DOT helmet. When it is not, I sometimes don't . But at all times I don't attempt to stir up trouble for no reason. These two knowingly rode in with an unapproved helmet, and received what they expected.
The bottom line is dont be an asshole to the cops, they do not write the laws, they just enforce them. Who cares if they do it with energy and believe in what they do. If you dont like the laws, sit down and write a letter to your congressman, dont test teh patience of officers. I would hate to see this world without them.
The cop in the wasn't "enforcing the law with energy." he was enforcing what he imagined the law to read.
If you need a hand learning how procedural rules work, or how cops must change their behavior after a court ruling says they are violating a citizen's Rights, there are ways to educate yourself.
If you want a country where you are required to bend over on the whim of the cop, there are countries where you can live like that.
@kevbot why does somebody deserve a ticket for putting themselves in danger... yea its a good idea to wear a helmet but to make ppl pay for risking their own lives is fucking stupid if ppl wanna be stupid with their own lives let them its when other lives are in danger when they should pay.... i bet you would love it if they had cameras installed in all our houses too so they could fine us if we ate unhealthy food
So you are kinda saying, "Don't worry about where the line is between right and wrong. Cops get to dance on both sides of the line"?
Not in the America I know.
If you are driving 35 mph in a 40 zone, should you swallow it and pay the speeding ticket?
This is, really, a big deal. I'm only a little surprised there are so many who do not see a big deal when a police officer violates my constitutionally protected Rights.
I ride a bike. I may not like the helmet laws but don't act like a jackass if you are breaking the law. Cops have to deal with people like this all the time! You give bikers a bad name. I think the officer handled these dumbasses pretty well. Get a helmet!
Wow, what a travesty I have lived in Vacaville for over 40 years, and I remember when the VV police department was there to help the community. Im not sure if its economics and the police department needs the money or it just Office Love on another one of his vendettas. If its not tinted windows its helmets are writing up cars in the park and ride lot for front license plates missing.
This comment has received too many negative votesshow
give them a ticket for looking stupid with their small ass helmets as well. Give them a ticket for trying to bull shit their way out of a ticket thinking they know. These two guys are beyond stupid, just two geeks trying to ride bikes!
ticket is 72$ ooo ahhh. dont go to the bar for a cpl days and maybe you will afford it.
i know officer love is a dick, but its his job to be a dick thats what cops do. they ENFORCE the law,
wish these fags would get their head out of their ass' and put a fucking helmet on. you would of avoided this whole situation.
unfortunatly motorcyclists are required to wear a helmet. doesnt have to be a full one but you still have to wear one. so u where wrong. you have no chance winning that
2. Cops aren't paid to be dicks, they are paid to enforce the law.
3. Cops aren't paid to enforce their imagination, they're paid to enforce the law. (read CVC 27803 yourself, if you can. It may be tricky, there are capital letters and punctuation in there, so ask for help if you need it.)
3. The total is $172.00 but does it matter to you? You seem to like paying fines you don't have to pay. Pay as much and as often as you like.
and about reading CVC 27803 i have read it, and it seems you are mocking my punctuation here on youtube, this isnt the vacaville reporter we are typing for, its youtube.
i have taken criminal justice classes and have a pretty good understanding of the law. so i wouldnt make assumptions about people you dont know.
officer love is an asshole i know, been harrassed by him many times, he could of at least let you off with a warning, because i can tell you are not from vacaville.
God i hate him he gave me a ticket for driving people a week before i was sapposto i was taking them to school from fairfield so they wouldnt miss school
Talk about nit-picky. It's a helmet. And an ugly one at that. It's supposed to be designed to keep your mellon from smacking the Tarmac so hard if you should fall for some odd reason. I remember i used to complain about stuff that was good for me...when i was 8. Because i didnt really know better. Someone mentioned "freedom"? How free do you need to be? You're free enough to buy those bikes. As Americans, did we complain about petty shit before I left this country....or after I came back?
In my opinion, Vacaville Police is one of the most overpaid, overcompensated police departments in the US.
If you ask around in this city, you will find good standing citizens who have been abused and bullied by VPD -just because they have the power to do so.
Personally I have never seen any benefit coming from the large funding wasted by hiring bullies who become very unprofessional cops.
Sadly, many of these cops would not last a month in real cop jobs, facing real criminals.
So whats the point of BOLT? Seems this helmet issue is all about how to cheat or short cut the law. If it was just the biker (w/lame helmet)alone in an accident that suffers head/spinal injuires without others involved, then run yourself into your own wall. Dont assume the law revolves around just you. Im pretty tired of health bills trying to be passed due to high medical/property insurance. I do my VERY best when I'm on the road and dont think its fair when one knowingly wears crap for a hat.
The "hat" as you call it is not illegal. Some research on your part would prove that to you. If you had read some of the previous posts, you'd know how uneducated you sound. Ignorance really is bliss, huh?
Does it say anywhere in my comment its illegal? I'm totally bliss in ignorance so you'll have to show me. Maybe hat fit better than helmet in the 500 spaces allowed. I used 499. But I'm glad you addressed and cleared up everything about everyone else on the road having to pay extra attention, taxes and premiums. My brother had a mishap on I-101, I'm glad his helmet had sides. You do well with the name calling too. That should really fix everything. I did read previous posts, thus my opinion.
Really, the only one who looks ignorant to me is the person arguing with Ofc. Love. He didn't make the law, though he may have voted for it and it's his job to enforce it.
You want the law changed take it back to the ballot. Otherwise keep that crap out of Vacaville, we don't want it here.
Our cops may be ball busters and expect the citizens to live within a reasonable means of the law and the majority likes it that way.
Oh, how'd that turn out for ya? I hear the "bikers" lost the case! lmao
true this maybe a gay citation but vacaville PD are way better about some rules than FFPD SFPD so even if he is doing his job and it sucks for the person hes still doing his job
If it is his job to violate my 4th Amendment Right and my 14th Amendment Right, and his job to conduct a False Arrest for writing a Notice To Appear without first having Probable Cause, then he has done his job. It doesn't mean the WW2 soldeirs who heaped personal atrocities on human beings are blameless, just because they were doing what they were told. His job, it seems, is to collect $172.00 from riders based on imaginary unwritten standards. That violates Case Law.
He's just doing his job. I don't know if he really cares about your safety...even though he is right, if you do get in an accident, your chances of survival are very low with that skull yarmulke.
Officer love is a douche bag. I remember he lost his bike for three months because he dropped the shit in the road.. he also has his belly button pierced I heard and changed his name from something else Love lol
You obviously never heard of the 5 California Court cases that restricted what police are allowed to do for enforcing the helmet law.
You saw complete BS in the video, if by BS you mean Bold Stuff.
Why would anybody pay a Stupid Tax when the cop says you are breaking the law and you can prove you're not, and you can prove the cop knows nothing about the rules he's supposed to follow?
lmao. Train the cop. He looked pretty well trained to me. Doesn't appear you proved anything now does it?
Again, you don't like our cops, stay the hell out of our community!
There's quite a few riders who know darn well the helmet law has saved lives! But then if we aren't drugged out rebellious drunks, we aren't really bikers!
I watched expecting to be on the Bikers side but the bikers are wrong and are wasting police time
They are just pig headed idiots.
Just wear the correct helmet and you will not get harassed- or get the law changed- as they did in Boston - personally I think that you need to be forced to wear the proper helmets
One dollar helmet are for one dollar heads ( or brains in this case)
If you didn't think the cops "look bad" you should read the settled case law on this. At least one cop in the video could lose his job and possibly his savings account.
Didn't look bad? Well, his hair was recently cut.....
But his looks aren't the reason we say, "Bad cop; no donut."
You couldn't be more wrong about every point you tried to make. Not only has officer Love said he will quit writing tickets based on the outcome of the trial, but there are mounds of evidence proving that cops see the "CASE LAW" as evidence in a trial, and STOP writing BS helmet tickets. Are you implying cops are as stupid as they are antagonistic?
It is EXTREMELY rare that a cop will continue that which will get him fired and sued.
Im a Biker. But those bikers were antagonizingly assholes fishing for an equally antagonizing result. All that will comeofthis is that that asswipe cop will continue to be an asshole and thosetwo 'bikers' just made it worse for all bikers.
back in the 70's the helmet lobby said that wearing a helmet would save lives and reduce injuries, thereby reducing insurance priemiums, 30 years later we have'nt seen any reductions in what we pay for insurance.
If I so choose as a FREE American to be unsafe. Then by GOD let me do so! I don't need big BROTHER to protect me from ME!

Woot woot.

Ok, so this was uploaded almost two years ago. What was the outcome? What happened when it went to court?
screamineagle88 11 months ago
@screamineagle88 , Not every question of law is answered as fast as most traffic tickets. The trial took 2 days; it happened in October 2009 - the Judge made about 4 seperate serious errors; the appeal was in summer of 2010. The appeal was denied. There are 2 more "actions" that are pending in this case, even though 999 of 1000 people would have said it's over. I have been to Vacaville many times and cops don't seem to want to write a ticket on any of the helmets in question.
BOLTofCalifornia 11 months ago
@screamineagle88, (part 2)
BOLTofCalifornia 11 months ago
@screamineagle88 Go to BOLTof CA.com to find the new CHP helmet enforcement policy that (is pretty close to proper and legal enforcement) views helmet law violations as very difficult to write because it's almost impossible to develop probable cause; it agrees with state law that helmet violations are fix-it tickets, unless the rider has nothing on his head he is claiming is a helmet. Why does suing cops work? Real Judges (not traffic court) tell cops to obey the law, too.

But when The People think their government servants suck, it is because We The People let the servant get away with it for too long. Shame on us. BOLTofCalifornia 1 year ago
BOLTofCalifornia 1 year ago
@BOLTofCalifornia So you're saying that you can put a DOT sticker on anything you want, and that makes it legal? The helmets in the video whether a DOT sticker was put on them or not, they are not DOT certified. The summonses issued are legit. You might as well wear no helmet at all, or just wear your favorite baseball hat with a DOT sticker slapped on it. When you go to court, you can just say it came with the sticker, you thought it was legal. That's an invalid defense.
yankeed1 1 year ago
@yankeed1 - You have made claims, such as, "you can just say it came with the sticker, you thought it was legal. That's an invalid defense."
Cite your legal sources for this claim. Either the case law, or the statute. I can reply with case law and/or statute that will prove that statement wrong. If you read everything below you will find I already have cited this.

BOLTofCalifornia 1 year ago
@BOLTofCalifornia @BOLTofCalifornia @BOLTofCalifornia The cop has the right to ask more questions and to "intrude" further with his common law right of inquiry as the courts call it, because of the founded suspicion of a violation commited (unapproved helmet). You may get away with refusing, but the cop may also articulate that as not complying in recieving the summons. Same as if you refuse to give your license over, or any other form of non-compliance. You can be arrested 4 just a VTLviolation
yankeed1 1 year ago
@yankeed1:

@DavisCalif:

@didi0014 That's how I talk to a cop who has a reputation for giving the finger to the law he has given an oath to uphold. If he had the authority to begin the legal process he started, he would not have changed from the upbeat, chipper smart-a_ _ at the beginning of the video to the quiet, worried cop sweating whether he made a mistake on camera, near the end of the tape. It's amazing how many cops know so little about law.

FYI, the verdict in traffic court can be meaningless - either guilty or not guilty.
A "not guilty" verdict does not prevent the cop from making the same mistake again. A "guilty" verdict can open a door, in a legal sense.

What a bunch of punks, glad they got tickets. Yes, its law I don't like either but I'm not an AH about it.

ticket is 72$ ooo ahhh. dont go to the bar for a cpl days and maybe you will afford it.
i know officer love is a dick, but its his job to be a dick thats what cops do. they ENFORCE the law,
wish these fags would get their head out of their ass' and put a fucking helmet on. you would of avoided this whole situation.
unfortunatly motorcyclists are required to wear a helmet. doesnt have to be a full one but you still have to wear one. so u where wrong. you have no chance winning that
cycoclown5150 2 years ago
Cyco Clown,
1. I don't go to bars.
BOLTofCalifornia 2 years ago
ok heres my answers to all the listed responses you have givin me.
1. so you dont go to bars. majority of bikers do, or least the ones i know.
2. cops are paid to enforce the law yes, but being straight foward and stern which alot of people consider to be "dick"
3. enoforcing their imagination is one thing, but wearing a helmet on a motorcycle is California LAW.
4.*that fine is pretty low compared to the ones if had, i got a $342 ticket for exhibtion of speed.
cycoclown5150 2 years ago
no helmet on a motorcycle = violation.
and about reading CVC 27803 i have read it, and it seems you are mocking my punctuation here on youtube, this isnt the vacaville reporter we are typing for, its youtube.
i have taken criminal justice classes and have a pretty good understanding of the law. so i wouldnt make assumptions about people you dont know.
cycoclown5150 2 years ago
You have an issue with someone "mocking your punctuation," after you called him a "fag."
Are you serious?
You should have listened in Criminal Justice Classes and in English Class, too.

officer love is an asshole i know, been harrassed by him many times, he could of at least let you off with a warning, because i can tell you are not from vacaville.
cycoclown5150 2 years ago

Sadly, many of these cops would not last a month in real cop jobs, facing real criminals.

is there a law against being an asshole?
playgoog 2 years ago
So whats the point of BOLT? Seems this helmet issue is all about how to cheat or short cut the law. If it was just the biker (w/lame helmet)alone in an accident that suffers head/spinal injuires without others involved, then run yourself into your own wall. Dont assume the law revolves around just you. Im pretty tired of health bills trying to be passed due to high medical/property insurance. I do my VERY best when I'm on the road and dont think its fair when one knowingly wears crap for a hat.
airsoftrocks 2 years ago
airsoftrocks,
The "hat" as you call it is not illegal. Some research on your part would prove that to you. If you had read some of the previous posts, you'd know how uneducated you sound. Ignorance really is bliss, huh?
BOLTofCalifornia 2 years ago
Does it say anywhere in my comment its illegal? I'm totally bliss in ignorance so you'll have to show me. Maybe hat fit better than helmet in the 500 spaces allowed. I used 499. But I'm glad you addressed and cleared up everything about everyone else on the road having to pay extra attention, taxes and premiums. My brother had a mishap on I-101, I'm glad his helmet had sides. You do well with the name calling too. That should really fix everything. I did read previous posts, thus my opinion.
airsoftrocks 2 years ago
@airsoftrocks Bullshit. Enough with the nazzi attitude -telling people what to wear and how to be safe.
Wearing a helment, whether large or small, should only be for the protection of the biker -period. End of the story.
The moment you try to tell others what to wear for driving a bike you become a stupid cop with an bullying attitude.
Vacaville is home to some ignorant citizens who overstep their authority -not just cops, but many who are narrow-minded conservative jerks too.
Maurimu 2 years ago
@Maurimu Liberals are MUCH, MUCH, MUCH worse!
3Mudbone1 1 year ago
Really, the only one who looks ignorant to me is the person arguing with Ofc. Love. He didn't make the law, though he may have voted for it and it's his job to enforce it.
You want the law changed take it back to the ballot. Otherwise keep that crap out of Vacaville, we don't want it here.
Our cops may be ball busters and expect the citizens to live within a reasonable means of the law and the majority likes it that way.
Oh, how'd that turn out for ya? I hear the "bikers" lost the case! lmao
Lisa15231 2 years ago
true this maybe a gay citation but vacaville PD are way better about some rules than FFPD SFPD so even if he is doing his job and it sucks for the person hes still doing his job
Isbeihyo78 2 years ago
If it is his job to violate my 4th Amendment Right and my 14th Amendment Right, and his job to conduct a False Arrest for writing a Notice To Appear without first having Probable Cause, then he has done his job. It doesn't mean the WW2 soldeirs who heaped personal atrocities on human beings are blameless, just because they were doing what they were told. His job, it seems, is to collect $172.00 from riders based on imaginary unwritten standards. That violates Case Law.

Complete BS by the riders. Get a damn life guys. You're idiots!
DavisCalif 2 years ago
You obviously never heard of the 5 California Court cases that restricted what police are allowed to do for enforcing the helmet law.
You saw complete BS in the video, if by BS you mean Bold Stuff.
Why would anybody pay a Stupid Tax when the cop says you are breaking the law and you can prove you're not, and you can prove the cop knows nothing about the rules he's supposed to follow?
It's your duty to train the cop.
BOLTofCalifornia 2 years ago 2
Get real and like Davis Calif said, get a life!

I watched expecting to be on the Bikers side but the bikers are wrong and are wasting police time
They are just pig headed idiots.
Just wear the correct helmet and you will not get harassed- or get the law changed- as they did in Boston - personally I think that you need to be forced to wear the proper helmets
One dollar helmet are for one dollar heads ( or brains in this case)
sparkfishes 2 years ago
smbikerchic,
If you didn't think the cops "look bad" you should read the settled case law on this. At least one cop in the video could lose his job and possibly his savings account.
Didn't look bad? Well, his hair was recently cut.....
But his looks aren't the reason we say, "Bad cop; no donut."
BOLTofCalifornia 2 years ago
ya also have to love how many cops that are there.
demoman3955 2 years ago 2
Jesus, Officer!
My experience? It never happens.
BOLTofCalifornia 2 years ago
Im a Biker. But those bikers were antagonizingly assholes fishing for an equally antagonizing result. All that will comeofthis is that that asswipe cop will continue to be an asshole and thosetwo 'bikers' just made it worse for all bikers.
