"Not at fault" does not mean you were driving defensively. The vast majority of accidents are preventable by either driver. When I was a delivery driver on a college campus, I routinely avoided accidents that other (drunk) drivers almost caused. Does this mean I would have been at fault if I had failed to avoid one such accident?
