  • but the judge listened to me, took me on board, said I was right and still gave me the fine. He also said I was right that the cops made at least 3 errors each and didn't dismiss it on that point either, he also said I was right that the legal entity (birth cert) is our vessel for the public venue and not us...I still got the fine because as he said...it's the law...even though he agreed my arguement has a basis in a higher law...shit or what?

  • I used case law and also a constitution to make my arguement, I quoted the right to self-determination, one case says along the lines of the court must observe it's a principal right, another case says it gives us the right to do stuff morally and physically harmful to ourselves provided we're not causing harm to others, the constitution says that it's a fundemental right and gives us the right to choose to be Irish or British or both if we so choose, we can also choose none and it's our right..

  • You're more than welcome to skype me or whatever and pick my brain, I've just came out of court, got a £300 fine for cultivation&possession, I had a fun time questioning the cops and they were stuttering and stammuring all the way...you just have to be prepared and stay the course, if you don't want to get a chat then just be prepared for the fact that the judge is going to just continue on and do whatever he/she wants no-matter how well reasoned you're arguement is..explanation in next comment.

  • the bottom line is ben (i am on your side by the way) but the fact remains the law of this land is not for anyone except for baron or above ..we are still serfs as are the pigs that stole youre bike .(thats why they say your nicked when arrested cos they are stealing you) anyway no one under baron can use the freeman doctrine as we are not free men ,but we will keep chipping away,youd be better going after the cuntsttuble's(del) that took the bike ....good luck anwyway mate take care

  • I wish you luck, if successful you will be setting a huge precedent! I'm sorry to say I think your argument will most probably be ignored in court, even though you are in the right. My advice to you would be to try and get as much media attention as you possibly can. The more people hear your argument, the more they start asking their own questions. If you win, they will feel more empowered. It would be a good catalyst regardless of the ruling in court, if you have good media coverage!

  • Hit wrong button, sorry. You'll want them to have copies of your notices so that jurisdiction is not in doubt. Most courts will want to operate under statute and will try to trick you into consenting.

  • Hi Ben. I think I heard you mention that they are calling some special expert in for some reason. Well when I filed some defense motions in my last case concerning my drivers license they called in a special magistrate. She was trying to test my informatin skills on private vs public. But it was all done in a careful way. I objected to anything I didnt like and I won. The case was dismissed. And I showed the court my Registered Indemnity Bond.

  • 1) Interestingly their expert witness is merely there to state the value of the bike (Section E)...why would they do that if they didn't suspect they were going to end up paying for it?

    2) Some Legal maxims:

    -Any one may renounce a law introduced for his own benefit.

    -One who avails himself of the benefits conferred by statute cannot deny its -validity. - So, logically one who waives the benefits...

    - A contract founded on a base and unlawful consideration, or against good morals, is null.

    - Agreements give the law to the contract.

    - No action arises on an immoral contract.

    - No one is believed in court but upon his oath

    - An act of the court shall oppress no one

    - He who does not forbid a crime while he may, sanctions it.

    Hope that's something good to think about

  • Don't stand behind the dock as u will be found guilty by positioning yourself there. I take it this is going to be on trial in a 'Court de Jure', not 'Court De Facto' which means u will have a Judge and Jury. The Judge will direct the trial as according to COMMON LAW, especially if you put them on there oath...then the jury will make the decision themselves, the Judge only passes sentence according to the COMMON LAW nothing else as it's not their decision as they are public servants.

  • well i wish you all the best in your case ben.!we were in a case 2 days ago..! the courts were willing to use treats and violence .! which they did..! just for simply asking the person on the bench for his oath of office..! i need some advice if people are willing to help..! we are trying to press charges with the help of a good police man.! which he's trying on the grounds of a section 9..!

  • Lawyerss layer thier defence, first is a bare denial then a plan B, then they dispute the amounts so that if they lose they can try and haggle the it down. You want to ask Marc Stevens when you interview him for some advice on cross examination, his stuff is pretty good.

  • My only concern is that you have used the benefit of "Their" currency to purchase the bike in the first place.  Is there any way to claim for only the return of the motorcycle STOLEN by the Police and nothing else in a not negotiable sort of manner?

  • @benlowreyhimself small claims court operates under what jurisdiction? not common law for sure, so it seems like you are trying to claim your sovereignty while granting them the jurisdiction over you, that doesn't seem right, i think you are going to lose, but that's just my opinion, good luck though

  • I sent a questionnaire to many alleged govt employees... before I sent them Notice and Claims / Defaults / bills ... etc. I only got one reply.. from the local sheriff, saying he couldnt answer my questions about 'citizenship, history of the USA, Birth Certificate, or Rite to Travel.. but he did send me a letter back saying he would personally refer my questions to ICE.. (Imigration and Customs EnFORCEment ... Janet Napolitano... I had already sent her the same Questions / Notices, .. No Reply

  • As far as I can see the defendant is not yet disputing the value of the motorbike seized. He seems to have tossed the issue over to the judge and indicated that if the court accepts your valuation of £300 then there's no need for a debate.

  • Oath or afirmation is not available to the public any longer. Now I am speaking from the problems of US code which is British common law mirged with the court of rome to produce the UCC. In a true free world you would file oath and afirmation IE a warrant for him.

  • ben go get an independant psychiactric evaluation just in case they bring a shrink and try and get you sectioned you never know why they would wanna go to court for the sake of £300,protect yourself lad

  • @coolhandfinn it happened to a girl in northern ireland over a row about a parking space with a nieghbour who was well connected and lucky for her she had an independant evaluation done as they tried to have her sectioned she had a nightmare
