Batman will not kill him even though he's had the opportunity to do so MANY times... and the Joker's entire reason for being is the fact that Batman is out there. For example, when Batman retires in the comic book Dark Knight Returns, the Joker goes catatonic, but when Batman returns after a 10 yr absence, the Joker sees him on TV and immediately springs back to life to cause chaos once more. They complete each other in a twisted sense.
