How hard is it to understand it doesn't matter what the motivations are on this issue, it's about whether the law is being broken. I was not defending him per say, but rather challenging what the motivations of "birther" movement. I wish that Ron Paul could get the nomination, but the deck seems to stacked against him! If he does not get the nomination, I will not vote!

  • @TheBiotchify It is unfortunate, but we must use the same tactic that Ron Paul seems to be using, which is: play the conspirator's game against them. "Racists" (i.e. White Nationalists) have been on the "correct side" of conspiracy theory for a long time. It is unfortunate, but we cannot deny the good things they say because they have said bad things before. They are not entirely incorrect when they see a conspiracy against their race, it just so happens their racism helped them see it first.

  • @TheBiotchify but have discernment with what i said. I am not accusing every birther or anti-NWO'r of racism. I think they are rightly concerned over matters of their nation, their rights, their properties, and yes, their race. However, I think racial concerns are not the primary motivator. Sheer logic dictates there is something fishy when the supreme court backs an unconstitutional ruling, and when they call the document obsolete, which one judge did recently.

Governor David Dewhurst on board; he killed the anti-TSA bill in our Senate with backroom intimidation.     No, the Supreme Court has never found any such thing. There has never been a case before the Supreme Court about the definition of a natural-born citizen. The reason for that is simple: the ONLY place anywhere in US law where it makes any difference whether a citizen is "natural-born" is the qualifications for the presidency. Since the Supreme Court has never heard a case challenging anybody's eligibility to be President, they've never ruled on the issue.

Although the office of POTUS is the only government office that requires the holder to be a "natural born citizen" government held positions are not the only areas in this country where "natural born citizenship" is a concern. With that in mind, the US Supreme Court has in fact heard no less than four cases where it has defined the term "natural born citizen".

  • @RedXlV The Supreme court first set Prescience on this in 1875 in the Minor Vs. Hapersett. There is not a lower court  (that legally can overturn this) The courts were in error not hearing the case. this is being corrected as the case is moving forward.

    Minor v Hapersett does not, in fact, say anything about natural-born citizenship or presidential eligibility. The issue before the court in that case was whether it was constitutional to deny some citizens the right to vote. The Supreme Court ruled that it was in fact constitutional to do so. Since courts are not ALLOWED to rule on anything other than the actual case they're hearing at the time, not only did Minor v Hapersett not define "natural-born citizen", it COULDN'T.

Also the line where law of Nations is metioned in the constitution "Of Offenses against the Law of Nations" was the title of Blackstone treatise, Book 4, Chapter 5, dealing with Piracy. Guess what that line in the constitution deals with? Piracy.

    Guess what Blackstone thought of citizenship? Birth on soil regardless of parents.

Our founding Fathers wanted the Republic to be sound and protect the freedom of the people and they saw a person's citizenship and the Presidency as a possible threat to the freedom of the people.

As to voting it is our last recourse of peaceful action to restore our republic I will continue to vote. Yet feel there is no viable candidate to restore the republic. The truth is with the NDAA we can look into a number of our non representing representatives and Impeach Convict and in some cases hang or imprison for life the traitors to this country. Obama is one of them.

And not one of those places he was cited dealt with citizenship Lord Blackstone was the 4th most cited source, and Blackstone believed in Birthright citizenship and was cited on citizenhip.

  • It is clear that Obama does not qualify to be on the ballot for the presidency of the United States. He is not a natural born citizen, since his father was never a U.S. citizen. It's ironic that McCain's qualification to run for the presidency was questioned and even went to a hearing. Why was Obama allowed to be on the ballot in 2008? Why no hearing on his qualification?

In addition, if you do a google search, you will find there is no mention of the 2 parent rule prior to June 2008. Jerome Corsi's book "the Obama Nation" never mentioned it, despite the fact it was universally known that Obama's dad was never a citizen. If NBC=2 parents why the hell would Obama write that?

Hapersatt case from 1875. this definition has been upheld by the supreme court on at least 2 other occasions.

    Now I agree that there is a place for debating whether or not Birthright citizenship should be removed from law. England did it in 1984, Ireland in 2004, Australia in 2002 I think. However, sitting there pretending that it never was there in the first place just because you don't like the guy in the oval office has pushed that debate back 10 years.

  • @jjoshaugh I have and if you want can cite more cases upholding this. In reality Minor Vs. Happersatt was over property and a woman right to vote. The case was brought before the court in error. that error lost Minor the case. However the ruling has been upheld and is in other documentation as to avoid a conflict of nationalities in the office of President of the United States. You know Youtube does not allow much space for comments this does not reflect on research

    As for conflict of nationalities, there is no case that says dual citizenship invalidates you from the presidency. None. Spiro Agnew was the son of a natural born greek citizen and a greek citizen by birth according to Greek law, didn't stop him being Nixons VP.

  • @Naterz100 As for case law, Perkins vs Elg, 1902, ruled that attaining and having dual citizenship did not invalidate your NBC status. In addition it quoted Steinkauler's case;

    "Young Steinkauler is a native-born American citizen. There is no law of the United States under which his father or any other person can deprive him of his birthright. He can return to America at the age of twenty-one, and in due time, if the people elect, he can become President of the United States;"

    "Based upon the language of Article II, Section 1, Clause 4 and the guidance provided by Wong Kim Ark, we conclude that persons born within the borders of the United States are “natural born Citizens” for Article II, Section 1 purposes, regardless of the citizenship of their parents."

    There is no case law stating otherwise.

This was the ruling concerning James McClure, despite the fact that his parents had been settled in the country for many years prior to his birth. The article makes clear that the United States Minister to France, General Armstrong, refused diplomatic protection for McClure by denying he was a citizen of the United States.

First James McClures father was naturalized, Second you are referring to a newspaper article which bloggers claim was written by Madison because he used the pseudonym Plubious when he wrote the federalist papers. That was 20 years beforehand, there was no reason for Madison to write to a paper anonymously when he was president,especially to contradict everything he ever wrote. Third, it wasn't a court case it was a letter written to a newspaper.

  • @bsteadman1 It does not matter his place of birth. He could have been born on the steps to the Capitol in Washington D.C. He cannot hold the office because there is NO WAY he can be a Natural Born Citizen as his father is a citizen of Kenya. This removes the need for a birth certificate or place of birth. Best yet Obama admits his father is a citizen of Kenya. he can't back out (at least legally)

However, I do NOT have confidence that our POSSIBLY-COMPROMISED Supreme Court would interpret Minor v Happersett correctly! I believe it would be best to bring CRIMINAL CHARGES FIRST against BHO-II, before SCOTUS can set some STUPID PRECEDENT. The BC-fraud and the SSN-fraud issues can be handled at the State or County level by ordinary law enforcement and don't need to involve SCOTUS. Just my opinion!
