  • I agree with the precedent argument. Rulings like this just encourage employers to discriminate against the overweight even more. Plus, you don't really *need* the lapband surgery to lose weight. He could achieve the same effect with a liquid diet or another controlled calorie diet. The hospital just wants to milk the company for more money because they can.

  • I don't know if company should have to pay for the weight loss surgery. It could be covered by State Disability maybe, but while the company is culpable for the back injury it is not culpable for the overweight condition.

Ruptured a disc in his spine and for the rest of his life he couldn't sit or stand in one position for more than half an hour. The company made him take an action that prevented him from earning a living for the rest of his life and that's HIS fault? Get over your damn self, narcissist.

  • @redeye117 We have used that system in most of Europe for a very long time. Healthcare is financed by taxes and EVERYONE get the healthcare they need. We take care foe each other here and would never let anyone die like in the system used in USA.

  • Even if he wasn't fat (if it was a different thing as cenk said), they still shouldn't have to pay him for his back surgery. As long as the refrigerator door lived up to all safety standards of refrigerator doors, it was the fat guy who fucked up, not the owners.

If someone is obese the likelihood of an injury and the medical cost of repairing it is greater. It therefore 'costs' more to hire an obese person, putting them at a disadvantage in the labor market. It is a classic case of unintended consequences.

  • I'm surprised at myself for taking the stance that I'm taking but.... imo the pizza company has to pay for both surgeries. For now lets assume that it is their fault that this happened to him. So that means they have to set things right and put him back the way he was. It sucks for them that its 2 surgeries but in order to put him back to the way he was, paying for both surgeries is just something they have to do.

  • You forget the key principle here - the Thin Skull rule basically says that you must take your victim as you find them, so they are liable as that is the situation they find themselves in.

  • They should let the overweight man pay off the fat removal surgery in small ammounts every month directly from his salary, or atleast half. That would be the fairest thing I can think of.

    2. If the company HAS to pay something, just pay for the back surgery. Why? The guy took risks in living that unhealthy of a lifestyle....sure the back injury wasnt his fault, but any EXTRA damages due to his weight are directly his.   • Are you to determine otherwise? It says they are willing 2 pay 4 back surgery. No where did it say that the insurance is "penny pinching" or the employers r "deadbeat" Seems like they are taking responsibility for their part where is the guys? I guess the employer should pay for his knee surgery too from him carrying all that weight & maybe if he has a heart attack they should pay for that 2. It was a pre-existing condition not their doing. He's not just obese but grotesquely obese.
