So that means they have to set things right and put him back the way he was. You forget the key principle here - the Thin Skull rule basically says that you must take your victim as you find them, so they are liable as that is the situation they find themselves in.

The company should use in store security footage to prove the guy got hit with the refrigerator because he was too fat to move. If he had been in better shape he would not have been injured.

the woman just makes statements that are such stretches. why the hell would this case stop people from hiring overweight people? out of fear that they might get hit my a refrigerator door and needs surgery? that makes no sense. also in my opinion now, no its not fair but it's not fair for the guy to pay for it neccesarily. if you want to get into the tangled mess that we call the law the employer is still liable anyways.

@truemusic53 An employer can be held liable for any injuries their employees sustain on the job. This potential liability is part of the 'cost' of hiring an employee. If someone is obese the likelihood of an injury and the medical cost of repairing it is greater. It therefore 'costs' more to hire an obese person, putting them at a disadvantage in the labor market. It is a classic case of unintended consequences.

I'm surprised at myself for taking the stance that I'm taking but.... imo the pizza company has to pay for both surgeries. For now lets assume that it is their fault that this happened to him. So that means they have to set things right and put him back the way he was. It sucks for them that its 2 surgeries but in order to put him back to the way he was, paying for both surgeries is just something they have to do.
Am I not merciful?

The results ARE going to be discrimination against fat-asses because next time, when they have a heart attack on their working lunch break, business owners will be held accountable for having to pay for a transplant.
Iether way.... it will come out of L&I insurance/ workmans comp. which in turn, will skyrocket their insurance and open the door for his state disability claims in the future.

it may be unfortunate that the company has to pay the extra amount (unless their door was defective, or something that was a 100% their fault) but somebody has to pay and that is what insurance is for. this brings up another related subject. SURGERY IN THE USA IS TOO DAMN EXPENSIVE. WAKE UP. IT'S A BILLION DOLLAR INDUSTRY. THEY WANT PEOPLE FAT AND INJURED.

You forget the key principle here - the Thin Skull rule basically says that you must take your victim as you find them, so they are liable as that is the situation they find themselves in.

1. The dumbass got hurt. Why? He wasn't looking where he was going, being careful, or aware of his surroundings.
The company shouldn't be responsible, but they are legally.
2. If the company HAS to pay something, just pay for the back surgery. Why? Legally, it's the company's fault the he has to have the back surgery, and the dude's fault that he has to have the fat surgery as well, so just have the company pay for the back surgery, and the fat surgery just comes out of his paycheck each month.

Cause in my experience turning your back on a refrigerator is perfectly safe. Also standing near one is perfectly safe. Why wouldn't you stand near a refrigerator? Maybe someone else opened the door and hit him in the back with it? You're acting like he should've foreseen this freak accident happening. I don't get what reasoning that's based on.

ultimately....I think the company should pay the back surgury and a SMALL portion of the Lap Band. The guy took risks in living that unhealthy of a lifestyle....sure the back injury wasnt his fault, but any EXTRA damages due to his weight are directly his. If he doesnt have the money to pay for it....well you cant blame the company for that....you can only blame him for taking the risk in the first place...Its common knowledge, you live unhealthy, eventually it will catch up with you

I don't think they should pay for the lap band. It's not their fault he's so big back surgery will be ineffective. It may not be totally his fault either. He may have a medical condition, bad genes, etc. I think he should come up with the money for the lap band and the pizza place should pay for his back if it really is their fault he hurt his back.

Are you to determine otherwise? It says they are willing 2 pay 4 back surgery. No where did it say that the insurance is "penny pinching" or the employers r "deadbeat" Seems like they are taking responsibility for their part where is the guys? I guess the employer should pay for his knee surgery too from him carrying all that weight & maybe if he has a heart attack they should pay for that 2. It was a pre-existing condition not their doing. He's not just obese but grotesquely obese.
