If Martial Law were in effect, I would not be able to purchase alcohol, more than 5 people wouldn't be able to gather on the street, and no public meeting could be held without military authority approval. Newspapers and radio shows have not been censored, and military is not running our city, state, or federal government. I'm heavily against SOPA and PIPA, but we are not under Martial Law, sorry. I would have been arrested by now if so.

Martal law is military rule by military authorities; commander & chief is a military authority, & Patriot Act gives him & his agents a great deal of unrestricted power. Not everything needs to be an extreme caricature to satisfy a definition; it's not always machine guns & tanks in the street, which is worst-case. Did you see footage of law-enforcement abusing "Occupy" protesters? Military corporations "invest" in (control) media corporations. It's subdued, but present.
